METROPOLITAN AREA PLANNING COMMISSION

DECEMBER 10, 1996

 

MEMBERS PRESENT: Coleman, Little, Damron, Gardner, Finley, Beadles Pitts, Shaw and Phillips

 

MEMBERS ABSENT: None

 

A motion was made to approve the minutes of the November 12, 1996 meeting as amended (adding a second to Item 16).

 

Item of business left from last meeting, David Onstead requested approval of a two lot plat containing 1.824 acres located on east side of Harrisburg Road, south of Gladiolus. The item was withdrawn at last month’s meeting and they asked that it be brought back up and a vote be taken on the replat only.

 

Dr. Beadles moved to bring the matter back up for the replat only, seconded by Ms. Shaw. Seven voted aye, one absent for vote.

 

Mr. Damron moved to approve the replat subject to:

1. Showing existing sewer easement

2. Showing effect of top of ditch on Lot 1

3. Satisfy City Engineer with ditch easement

Ms. Finley seconded, eight voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS.

 

#1 AZ96-2 David Cossey, Mike Young and others requested approval of annexation for 99.475 acres located in the NW 1/4 of the SW 1/4 of Section 26, T15N, R4E and the SW 1/4 of the SW 1/4 of Section 26, T14N, R4E. A zoning classification of Residential R-1 is requested for all of the property. The property is principally located on the north side of Macedonia Road, with a portion of the property being on the south side of Macedonia Road, all of it east of Highway 351.

 

Ms. Shaw moved to approve the annexation and recommend to the City Council the R-1 zoning subject to:

1. Appropriate ROW for a section line be granted

2. Show existing development as it is now on plans

3. Bring all roads and streets into compliance with city codes

 

Mr. Pitts seconded, 8 voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS.

 

#2 RZ96-37 Paul Arnold and others requested approval of rezoning from Residential R-1 to Commercial C-3 for 40 acres located on the north side of Johnson Avenue, east of Paragould Drive.

 

Mr. Mooney, representing the property owners, presented new plans with less acreage and conceptual plans showing a proposed layout for several businesses.

 

Commissioners expressed concern about rezoning a large tract C-3 and the possibility that this might be for a fairgrounds. Mr. Mooney assured everyone that this was not the purpose of the rezoning and that the owners would voluntarily agree to a 99 year legal document to prevent use as a fairground. They also state they would submit plans on each phase of the development as it progresses.

 

Nearby property owners opposing the rezoning were Taylor Francis, Roger Lee, Becky Lee and Verla Gerdes.

 

Mr. Pitts prefaced his motion by agreeing that the campus-like zones, rather than stretching the development out along the highway frontage, would be much nicer. The motion was for approval subject to site plans and subdivision approval. Mr. Little seconded, 6 voted aye, 2 no, REQUEST APPROVED WITH STIPULATION.

 

#3 RZ96-47 Marion Heeb requested approval of rezoning from Residential R-1 to Residential R-2 for .50 acre located at 706 Utnage Drive.

#4 MP96-36 Marion Heeb requested approval of a minor plat containing .50 acre and located at 706 Utnage Drive.

#5 RZ96-48 Keith Meredith requests approval of rezoning form Residential R-1 to Residential R-3 for .32 acre located on the southeast corner of Nettleton Avenue and Smoot Drive.

 

Mr. Coleman advised commissioners that notes on plat stipulate for single family only. Houses would be in the $90,000 to $110,000 and 1400 to 1500 square feet. Andrew Jackson, who lives adjacent to the property, spoke in opposition to the rezoning. Spot zoning was raised as an issue of concern also that could lead to other requests in the area should this stipulated R-3 zoning be approved. It was noted that a request for R-2 zoning a few months ago was disapproved.

 

Ms. Finley moved to deny the request as spot zoning, seconded by Dr. Beadles. Five voted aye, 3 no, REQUEST DENIED.

 

#6 MP96-20 Keith Meredith requested approval of a minor plat containing two lots on .32 acre. The property is located on the southeast corner of Nettleton Avenue and Smoot Drive.

 

Item WITHDRAWN.

 

#7 FP96-10 Keith Meredith requested final approval of subdivision plans for Meredith Subdivision, Phase II containing 6 lots on 1.54 acres and located on the south side of Nettleton Avenue, east of Smoot Drive.

 

Ms. Shaw moved to deny the final as submitted as being an overkill of the property and with the recommendation that it be reduced to five instead of six lots and incorporated with the two corner lots. This eliminates the bubble and would bring the noncomplying lots into compliance. Ms. Finley seconded, 7 voted aye, 1 no, REQUEST DENIED.

 

#8 RZ96-49 Mark Keller requested approval of rezoning from Residential R-2 to Commercial C-3 for Lot 2 and part of Lot 1 of Haltom's 2nd Addition. The property is located on the south side of Matthews Avenue, east of Kitchen Street.

 

Mr. Damron moved to approve the request subject to amending the zoning to C-5 instead of C-3. Ms. Finley seconded, 8 voted aye, 0 no, REQUEST APPROVED WITH STIPULATION.

 

#9 RP96-64 Mark Keller requested approval of a replat for the east 45' of Lot 18 and all of Lot 2 in block I of Haltom's Second Addition. The property is located on the south side of Matthews Avenue, east of Kitchen Street.

 

Ms. Shaw moved to approve the replat, seconded by Mr. Damron. Eight voted aye, 0 no, REQUEST APPROVED.

 

#10 RZ96-50 David Abernathy requested approval of rezoning from Residential R-1 to Residential R-3 for 6.66 acres located at 4300 Aggie Road.

 

Mr. Gardner moved to approve the request subject to site plans being submitted before development. Mr. Pitts seconded, 7 voted aye, 1 no, REQUEST APPROVED WITH STIPULATION.

 

#11 RZ96-51 The Humane Society requested approval of rezoning from Residential R-1 to Commercial C-3 for 2.37 acres located on the southwest corner of Strawfloor Drive and Matthews Avenue.

#12 RZ96-52 Tom Hendrix and others requested approval of rezoning from Residential R-2 to Commercial C-3 for part of Lot 21, Block B of Stallings Fifth Addition. The property is located on the northeast end of Bernice Circle, south of Matthews Avenue.

 

Mr. Damron moved to approve the request, seconded by Ms. Finley. Seven voted aye, 0 no, one absent for vote, REQUEST APPROVED.

 

#13 RP96-65 Tom Hendrix and others requested approval of a replat of Lot 1 of Discovery Island III Replat and Lots 2, 3 & 21 of Block B of Stallings 5th Addition. The property is located on the northeast end of Bernice Circle, south of Matthews Avenue.

 

Mr. Damron moved to approve the replat request subject to the rezoning being approved by the City Council. Mr. Pitts seconded, 7 voted aye, 0 no, one absent for vote, REQUEST APPROVED WITH STIPULATION.

 

#14 SU96-15 Dallas Elrod requested approval of placement of a mobile home on the east side of Barnhill Road, north of Frito Lay Drive.

 

Mr. Damron moved to approve the request, seconded by Dr. Beadles. Eight voted aye, 0 no, REQUEST APPROVED.

 

#15 PP96-14 Danny Wallis and others requested preliminary approval of plans for Ridge Run Subdivision, Phase II containing 24 lots on 8.25 acres. The property is located on the west side of Paragould Drive, south of Shagbark Lane.

 

Carlos Wood, project engineer, stated they would comply with the staff comments.

 

Dr. Beadles moved to approve the request subject Staff Comments. Ms. Shaw seconded, 8 voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS.

 

#16 RP96-63 Joe Verser requested approval of a replat of the replat of Lot 2 of the replat of Lot 1 of Big Creek Farms Addition. The property is located on the east side of Friendly Hope Road, at the east end of Big Creek Cove.

 

Mr. Pitts moved to approve the request, seconded by Mr. Gardner. Seven voted aye, 0 no, one absent for vote.

 

#17 PP96-15 Bob Troutt, Ed Troutt and Kent Arnold requested preliminary approval of plans for Sage Meadows Subdivision, Phase I-A. The first phase of the development covers 30.57 acres and contains 73 lots. The property is located on the east side of Highway 351, south of Macedonia Road.

 

Ms. Shaw made a motion to approve the request subject to compliance with the staff comments and utility easement requests. MATA should also be consulted concerning right of way requirements for Macedonia Road. The motion was seconded by Dr. Beadles. Seven voted in favor, one abstained, REQUEST APPROVED WITH STIPULATIONS.

 

#18 SP96-33 Artesian Properties, LLC requested approval of plans for an industrial development containing 6,000 square feet in the first phase and located on the east side of Quality Way, north of C. W. Post Road.

 

Dr. Beadles made a motion to approve the request subject to complying with the City Engineer's need for a drainage easement along the east line of the property leading to the big ditch. The width of the drive and the need for a culvert needs to be evaluated as well. Landscaping is to be included in revised plans. The motion was seconded by Ms. Shaw. Seven voted in favor, one abstained, REQUEST APPROVED WITH STIPULATIONS.

 

#19 SP96-34 Diversified Packaging requested approval of site plans for an expansion of their existing facility. The proposed expansion contains 15,000 sf and is located at 3411 One Place.

 

Mr. Pitts moved to approve the request subject to compliance with the Master Street Plan concerning right of way for Willow Road at 40' from centerline. The motion was seconded by Ms. Finley. Seven voted in favor, one abstained, REQUEST APPROVED WITH STIPULATIONS.

 

#20 SP96-32 Bruce Burrow, Belz×Burrow, requested approval of site plans for Ridge Park Centre, a commercial development containing a Wal-Mart Supercenter and three outlots. The property is located on the west side of Parker Road, south of Woodsprings Road.

 

Dennis Zolpher made several statements concerning the development mostly related to buffering and landscaping at the rear of the property. In addition to the 100' of wooded area that remained R-1, 50' additional feet will have landscaping on Wal-Mart property. The fence on the 100' buffer line will be moved to the curb line to help keep trash and debris out of the wooded area and stated that they would work with the property owners on doing a zig zag fence where necessary based upon land contours. The drives on Parker Road will be widened to 40' to permit left turns. The drainage issues will be resolved with the City Engineer. Because of additional landscaping being added the parking spaces will be reduced from 918 to 905 spaces.

 

Mr. Zolpher stated they had no problem complying with the staff comments as well. They are also having their engineers look at acceleration and deceleration lanes as well as left turn lanes and an additional outlet on the north side and will install whatever improvements that come out of the study that the Arkansas Highway Department will approve. Deeds for the 100' of property as offered by the owners will be recorded upon approval of site plans and building permits. Landscaping around the detention ponds is also going to be added to the site.

 

Don Parker, speaking on behalf of his clients, stated that he was not there to oppose the site plan but rather to interject some ideas and recommendations for the site plan and protection for his clients. The items that were included in this list was to complete the traffic study and install the recommended improvements. Additional lanes be added to Parker Road for acceleration and deceleration. A request was also made to make a one way lane only off of Woodsprings Spur to the Wal-Mart site. There would be no left turns onto this ingress road.

 

Five traffic signals are requested to be installed by the developer at the locations marked on his map. Additional landscaping is requested that would include islands with trees. Mr. Parker also asked that evergreens or Magnolias or other trees that don't lose their leaves to be added as additional sound proofing. Making the memorandum of understanding a condition of approval is also requested. With regard to outdoor lighting Mr. Parker stated they wanted all lighting to be facing toward the building and use the lowest light possible. Lighting is requested for continuous 24 hour service with poles to be spaces 140' apart with a pole height of 39' and 1.5' candles. Instead of 8' fencing, Mr. Parker stated they wanted 10' or maybe 12' fencing with some type of soundproofing material and further that it be installed prior to beginning footings. Limit construction hours from 6:00 a.m. to 7 or 8:00 p.m. Add camouflaging to the rear of the building instead of the traditional bright colors. No trailer storage on the lot, temporary or otherwise. Add an attractive facade on the building across the front and north sides. Proper, ongoing maintenance of the detention ponds. Provide parking lot security.

 

Dr. Beadles made a motion to approve the site plan with the following stipulations:

 

1. Attach the memorandum of understanding to the minutes as part of the official record and compliance with conditions therein

2. Installation of a deceleration lane for right turns into the site and a left turn lane and make whatever improvements are recommended as a result of the traffic study if the AHTD approves the installations

3. Recording of deeds for the 100' buffer as offered

4. Provide a more intense landscape plan that includes a variety of trees that don't lose their leaves and additional plantings on the parking lot to include both entrances and the detention ponds

5. Installation of an ingress only from the Woodsprings Road Spur if approved by the AHTD

6. Install one traffic signal on the westernmost intersection of Woodsprings Road and the access to Parker Road if approved by the AHTD

7. Install 8' fencing using some type of sound proof material and providing details on fencing in revised plans. Fence to be installed on the curb line and work with the neighbors on the zig zagging fence to match contours

8. Perform regular maintenance on the detention ponds

9. Install outdoor lighting using globes specifically designed to direct light inward with pole spacing to be 140' using 39' poles and 1.5' candles. Lights to be used from dusk to dawn.

10. Use split faced block on the sides of the building visible from the street and dark gray painting as a camouflage on the west side of the building

11. Follow through with plans to widen accesses to Parker Road

12. Work with the City Engineer to provide proper drainage from the site

13. Provide revised site plans to include the stipulations above.

 

The motion was seconded by Ms. Shaw. Eight voted in favor, 0 opposed, REQUEST APPROVED WITH STIPULATIONS.

 

#21 Bruce Burrow, Belz×Burrow, requested approval of subdivision plans for Ridgepark Centre containing 4 lots and located on the southwest corner of Woodsprings Road and Parker Road. Mr. Damron moved to approve the minor plat, seconded by Ms. Finley. Eight voted aye, 0 no, REQUEST APPROVED.

 

Other business:

 

#22 Bobby Burrow requested approval of site plans for a trucking terminal to be located on the south side of Parker Road, east of Industrial Drive.

 

Ms. Shaw moved to defer approval of the minor plat and site plan to city staff if the staff is comfortable with the plans. If not, the matter will be referred to MAPC for approval. The motion was seconded by Ms. Finley. Eight voted aye, 0 no, REQUEST APPROVED WITH STIPULATION.

 

#23 Aycock Pontiac requested approval of site plans for a third building to be added to their site at 2907 E. Parker Road.

 

Ms. Shaw moved to defer approval of site plans to city staff. If staff is not comfortable with the plans they should be referred back to the planning commission for approval. The motion was seconded by Mr. Pitts. Eight voted aye, 0 no, REQUEST APPROVED WITH STIPULATION.

 

#24 Midwest Institute Inc. requests approval of plans to place therapeutic group homes at two locations in Jonesboro, one zoned R-2 at 1101 Dupwe Drive and one zoned R-3 at 4703 John Cones Place.

 

It was pointed out that very little information has been provided to the MAPC and the City Attorney concerning the request. There was discussion about whether this was a detention facility or a group home. The facility will be used for males, ages 12 to 18, who have had minor brushes with the law, not serious offenders. Kids are not placed here by choice, but by court order. Mr. Keglar stated in a letter that the kids handled at this facility will be handled similar to those by Consolidated Youth Services. Consolidated Youth Services cannot located in a residential zoning and there is a good possibility that this type of facility cannot located in residential zoning either. A representative for Shelvy Keglar stated that it was for the minimum risk juvenile delinquents, kids from Arkansas. The State of Arkansas is contracting with this Indianapolis, IN organization to provide facilities for Arkansas kids. The Commission stated that before any action could be taken on this issue, much more information is needed about the facility.
