BE IT ENACTED BY THE CITY OF JONESBORO, ARKANSAS AN ORDINANCE TO WAIVE BIDDING REQUIREMENTS:

WHEREAS, one of the City’s breathalyzers is non-functioning and being used for parts to keep the other one functioning. The second one is in very poor condition and may cease to function at any time; and,

 

WHEREAS, all police officers are currently certified on the Smith and Wesson Model 900A. Changing from this model would create considerable expense to the City for recertification of all officers; and,

 

WHEREAS, the purchasing agent has talked with Smith and Wesson and learned from them that the dealers located in our geographical area are in Little Rock, Memphis and Jackson, Mississippi; and,

 

WHEREAS, since the City will be purchasing a specific brand and model, no detailed specifications are required and since the above mentioned dealers are the only dealers in our geographical area, it is more feasible to waive formal bidding procedures and solicit telephone quotations from these dealers. This would eliminate the cost of advertising for formal bids and allow the purchasing agent to order the equipment on April 5 rather than April 19. Due to the present condition of our breathalyzer this earlier order date is needed; and,

 

WHEREAS, the breathalyzer will cost approximately $1300.00, therefore, it will be necessary for the City Council to waive only the City ordinance pertaining to formal bids.

 

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

 

Section 1: Section 2-3.3 of the Code of Ordinances of the City of Jonesboro, Arkansas should be waived to permit the City purchasing agent to purchase a Smith and Wesson Model 900A Breathalyzer without formal bidding procedures.

 

Section 2: Due to the present condition of the City’s breathalyzer and emergency is therefore declared and this ordinance being necessary for the preservation of the public peace, health and safety shall be in full force and effect from and after its passage and approval.
