AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORY TO WARD 4; ZONING SAID ANNEXED TERRITORY RESIDENTIAL (R-2); DECLARING AN EMERGENCY; AND FURTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter more fully described, was duly filed in the County Court of Craighead County, Arkansas on April 6th, 1984; and,

 

WHEREAS, said petition for the annexation of the land was duly signed by the sole owners of all of the acreage to be annexed to the City of Jonesboro; and,

 

WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published of said hearing and a hearing upon said petition was duly had and held in the Quorum Court of Craighead County, Arkansas, on May 14th, 1984 at 7:00 O’clock p.m., at which hearing it was duly found and declared that eh petition for annexation was right and proper and that the lands hereinafter more fully described should be annexed to the City of Jonesboro, Arkansas, whereupon an order of annexation was made and entered; and,

 

WHEREAS, thirty (30) days have expired since the order of annexation was filed on May 15th, 1984 and no proceedings to prevent the annexation have been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas, the annexation proceedings were in all things confirmed by the Quorum Court of Craighead County, Arkansas, by its order of June 18th, 1984.

 

NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council for the City of Jonesboro, Arkansas:

 

Section 1: The territories and lands annexed to the City of Jonesboro, Arkansas by order of the Quorum Court of Craighead County, Arkansas filed May 15th, 1984 be and are hereby accepted by the City of Jonesboro, Arkansas, and the territory hereinafter more fully described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas and the inhabitants residing therein shall have and enjoy all the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.

 

Section 2: The lands and territories hereby annexed to and accepted by the City of Jonesboro, Arkansas are move fully described as follows:

 

Part of the North Half Southeast Quarter Section 23, Township 14 North, Range 3 East, to-wit: From the Northeast Corner of Lot 1 of a re-plat of Lot 1, Block D, Briarwood 6th Addition to Jonesboro, Arkansas, run N.00°45’ W30.00 feet, then run N 89°15’ East 141.5 feet, then run S. 79°47’20” E 53.28 feet to the point of beginning proper, then run S 89°48’07” E 248.06 feet, then run N 21°08’ E 39.10 feet, then run N 21°59’30” E 129.20 feet, then rung S 89°36’30” W 311.20 feet, then run S 00°23’30” E 155.00 feet to the point of beginning, containing 1.00 acres.

 

Section 3: The lands and territories annexed to the City of Jonesboro are hereby accepted by the City of Jonesboro and assigned and attached to Ward 4 of the City of Jonesboro, Arkansas.

 

Section 4: The lands and territories hereby annexed to the City of Jonesboro are hereby zoned Residential (R-2).

 

Section 5: It is hereby found and declared by the City Council for the City of Jonesboro, Arkansas that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas , so that the property and the citizens of the territory described above can be entitled to fire, police, zoning, water, sewage and other protections and benefits and that these benefits and protections are urgently needed now in order to allow orderly growth and development of the lands and territories hereinabove described.

 

THEREFORE, an emergency is hereby declared to exist and this Ordinance being necessary for the preservation of the public peace, health and safety shall take effect and be in full force from and after its passage and approval.

 

PASSED and ADOPTED this 2nd day of July, 1984.
