AN ORDINANCE ADOPTING BY REFERENCE A CERTAIN TECHNICAL CODE ENTITLED "SEWER USE PRE-TREATMENT ORDINANCE"; AUTHORIZING CODIFICATION THEREOF AS A NEW CHAPTER 10.04 OF THE JONESBORO MUNICIPAL CODE; AND DECLARING AN EMERGENCY (NOTE: THIS ORDINANCE WAS AMENDED BY ORD-12:009 ON MARCH 20, 2012)

WHEREAS, in an effort to comply with the Clean Water Act, and provide for the health, safety, and welfare of Jonesboro's citizens, City Water & Light Plant has prepared and recommends adoption by the City Council of technical regulations, standards, and codes concerning the use of public and private sewers; private sewage disposal; the installation, construction, maintenance and connection of building sewers; the discharge of waters and wastes into the public sewer system; penalties for the violation thereof; and for other purposes, all pertaining to the sewer system within the City of Jonesboro; and
WHEREAS, such technical regulations, standards, and codes are contained in a printed booklet entitled "Sewer Use-Pretreatment Ordinance"; and
WHEREAS, all filing, public notice, and public hearing requirements have been met, thus enabling the adoption of said document by reference.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
SECTION l: That the document entitled "Sewer Use Pre-treatment Ordinance", prepared by City Water & Light Plant, and filed in the City Clerk's office for public examination be, and the same is hereby adopted by reference.
SECTION 2: That Chapter 10.04 of the Jonesboro Municipal Code, entitled "Sewer Regulations" is hereby repealed in its entirety.
SECTION 3: That three (3) copies of the document entitled "Sewer Use Pre-treatment Ordinance", duly certified by the Mayor and City Clerk, shall be filed for use and examination by the public in the Office of the City Clerk; and the provisions thereof shall be codified as Chapter 10.04, Sections 10.04.01 - 10.04.19 of the Jonesboro Municipal Code.
SECTION 4: That this ordinance being necessary for the immediate preservation of the public health, safety, and welfare, an emergency is hereby declared to exist and this ordinance shall be in full force and effect from and after the date of its passage and approval.
