PUBLIC HEARING 6:15 P.M. - A public hearing was conducted for the purpose of vacating an alley running north and south between Van Dyne Street and Bridge Street, adjacent to and between the west side of Lots 12, 13, 14 and the east side of Lots 9, 10, 11 and all of Block 5 of Matthews Addition. The public hearing was requested by Mr. and Mrs. Randy Simpkins, and Ms. Jerrilyn Beeson. No opposition was voiced.

 

CITY COUNCIL MINUTES - May 21, 2001

 

The Jonesboro City Council met Monday, May 21, 2001, at 6:30 p.m. A full quorum was in attendance. Present were: Mayor Hubert Brodell, City Attorney Phillip Crego, and nine council members. Those members were: Kelton, McCall, Crockett, Rorex, Rega, Province, Copeland, Moore, and Roddy. Councilmen Tate, Young, and Perrin were unable to attend. Mrs. Billie Black recorded the meeting for City Clerk, Donna Jackson who was away on city business.

 

Councilman Rega moved, seconded by Councilman Rorex to approve the minutes of May 7, 2001, as provided. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, McCall, Crockett, Rorex, Rega, Province, Copeland, Moore, and Roddy.

 

Councilman Roddy offered the following ordinance for first reading:

 

ORDINANCE TO VACATE AND ABANDON AN ALLEY RUNNING NORTH AND SOUTH BETWEEN VAN DYNE STREET AND BRIDGE STREET, ADJACENT TO AND BETWEEN THE WEST SIDE OF LOTS 12, 13, 14 AND THE EAST SIDE OF LOTS 9, 10, 11 ALL OF BLOCK 5 OF MATTHEWS ADDITION. (Mr. and Mrs. Randy Simpkins and Ms. Jerrilyn Beeson)

 

Councilman Roddy moved, seconded by Councilman Rega to suspend the rules and place on second reading. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, McCall, Crockett, Rorex, Rega, Province, Copeland, Moore, and Roddy. Councilman Rega moved, seconded by Councilman Roddy to further suspend the rules and place on third and final reading. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, McCall, Crockett, Rorex, Rega, Province, Copeland, Moore, and Roddy. Councilman Rega moved, seconded by Councilman Roddy for the adoption of the ordinance. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, McCall, Crockett, Rorex, Rega, Province, Copeland, Moore, and Roddy. Councilman Rega moved, seconded by Councilman Copeland for the adoption of the emergency clause. A roll call vote was taken resulting in all members voting aye. Those members were: Kelton, McCall, Crockett, Rorex, Rega, Province, Copeland, Moore, and Roddy. The ordinance was assigned ordinance number 3293.

 

Councilman Kelton offered the following ordinance for first reading:

 

ORDINANCE TO REZONE PROPERTY FROM RESIDENTIAL (R-1) TO INDUSTRIAL (I-1), LOCATED ON THE EAST SIDE OF COTTAGE HOME ROAD. (Jonesboro Industrial Development, Chamber of Commerce)

 

Councilman Rega moved, seconded by Councilman Roddy to suspend the rules and place on second reading. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, McCall, Crockett, Rorex, Rega, Province, Copeland, Moore, and Roddy. Councilman Rega moved, seconded by Councilman Roddy to further suspend the rules and place on third and final reading. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, McCall, Crockett, Rorex, Rega, Province, Copeland, Moore, and Roddy. Councilman Copeland moved, seconded by Councilman Roddy for the adoption of the ordinance. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, McCall, Crockett, Rorex, Rega, Province, Copeland, Moore, and Roddy. The ordinance was assigned ordinance number 3294.

 

Councilman Moore offered the following ordinance for first reading:

 

ORDINANCE AMENDING THE JONESBORO CODE OF ORDINANCES, SECTION 8.40.15 TO INCREASE THE MAXIMUM TOWING CHARGES THAT COMPANIES MAY CHARGE WHEN RESPONDING TO CALLS BY THE JONESBORO POLICE DEPARTMENT.

 

Councilman Moore moved, seconded by Councilman Crockett to suspend the rules and place on second reading. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, McCall, Crockett, Rorex, Rega, Province, Copeland, Moore, and Roddy. Councilman Moore moved, seconded by Councilman Crockett to further suspend the rules and place on third and final reading. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, McCall, Crockett, Rorex, Rega, Province, Copeland, Moore, and Roddy. Councilman Moore moved, seconded by Councilman Roddy for the adoption of the ordinance. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, McCall, Crockett, Rorex, Rega, Province, Copeland, Moore, and Roddy. The ordinance was assigned ordinance number 3295.

 

Item D - Ordinance to waive competitive bidding authorize purchase of Police Radios for the Police Department was pulled from the agenda at the request of Councilman Crockett, Chairman of the Police Committee.

 

Councilman Kelton offered the following ordinance for first reading:

 

ORDINANCE ADOPTING BY REFERENCE A CERTAIN TECHNICAL CODE ENTITLED, “CITY OF JONESBORO, ARKANSAS ZONING ORDINANCE” TO REPLACE EXISTING TITLE 14 (ZONING) OF THE JONESBORO MUNICIPAL CODE.

 

Councilman Moore moved, seconded by Councilman Roddy to suspend the rules and place on second reading. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, McCall, Crockett, Rorex, Rega, Province, Copeland, Moore, and Roddy. Councilman Kelton requested the ordinance be held on second reading, to allow Council time to review the 112 page document.

 

Councilman Kelton moved, seconded by Councilman Roddy for the adoption of a resolution requesting City Water and Light to provide a free water meter for the sprinkler system for a community park located at 401 Union Street, and free electrical for the Master signal controller on top of the water tower, located at 1823 Old Greensboro Road (Hwy 351). A voice vote was taken resulting in all members voting aye. Those members were: Kelton, McCall, Crockett, Rorex, Rega, Province, Copeland, Moore, and Roddy. The resolution was assigned resolution number 2001:18.

 

Councilman Moore moved, seconded by Councilman Copeland for the adoption of a resolution requiring all future surveys tie to Jonesboro GPS GRID survey monuments. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, McCall, Crockett, Rorex, Rega, Province, Copeland, Moore, and Roddy. The resolution was assigned resolution number 2001:19.

 

Councilman Copeland moved, seconded by Councilman Roddy for the adoption of a resolution certifying Packaging Plus, located at 2810 Willow Road, to participate in the Advantage Arkansas Program. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, McCall, Crockett, Rorex, Rega, Province, Copeland, Moore, and Roddy. The resolution was assigned resolution number 2001:20.

 

Councilman Rega moved, seconded by Councilman Moore for the adoption of a resolution to amend the 457 Plan and Trust for Non-Uniform Employees, effective April 1, 2001, by allowing participants to execute a Voluntary Salary Deferral Agreement at anytime. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, McCall, Crockett, Rorex, Rega, Province, Copeland, Moore, and Roddy. The resolution was assigned resolution number 2001:21.

 

Under new business, Councilman Rega offered the following ordinance for first reading:

 

ORDINANCE GRANTING A FRANCHISE TO TCA CABLE PARTNERS, A DELAWARE GENERAL PARTNERSHIP (D/B/A COX COMMUNICATIONS), ITS SUCCESSORS AND ASSIGNS, TO OPERATE AND MAINTAIN A CABLE TELEVISION SYSTEM IN THE CITY OF JONESBORO, ARKANSAS AND SETTING FOR THE CONDITIONS ACCOMPANYING THE GRANTING OF THE FRANCHISE.

 

Councilman Rega moved, seconded by Councilman Crockett to suspend the rules and place on second reading. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, McCall, Crockett, Rorex, Rega, Province, Copeland, Moore, and Roddy. Councilman Rega moved, seconded by Councilman McCall to further suspend the rules and place on third and final reading. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, McCall, Crockett, Rorex, Rega, Province, Copeland, Moore, and Roddy. Councilman Kelton moved, seconded by Councilman Rega for the adoption of the ordinance. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, McCall, Crockett, Rorex, Rega, Province, Copeland, Moore, and Roddy. The ordinance was assigned ordinance number 3296.

 

Mr. Bill Ebbert was on the agenda to address the Council regarding past salary increase decisions, and for copying charges regarding “Freedom of Information” requests. Mr. Ebbert withdrew his request.

 

With no further business, the meeting was adjourned.
