CITY COUNCIL MINUTES, AUGUST 17, 1981

 

The Jonesboro City Council met in regular session, Monday, August 17, 1981, at 7:30 P.M. Present, City Attorney, City Clerk and all Aldermen. Vice Mayor Park presided over the meeting in the absence of Mayor.                     

 

The minutes of August 3, 1981, were approved as mailed on motion by Mr. Sanderson, seconded by Mr. Hinson.

 

Permission was granted for placing a mobile home at 340 N. Bridge, seconded by Mr. Johnson. Voting aye: Park, Stricklin, Johnson, Sanderson, Province, Mays. Voting nay: Hinson, Shelton, Bridger, Minx, Hannah, Haggenmacher. Motion failed

 

A public hearing was held concerning the issuance of Act 9 Bonds for McNeil Corporation. Mr. Tom Leggett spoke concerning the issue.

 

After the public hearing, Mr. Hannah offered the following ordinance:

 

AN ORDINANCE AUTHORIZING THE ISSUANCE OF INDUSTRIAL DEVELOPMENT REVENUE BONDS FOR THE PURPOSE OF PROVIDING PERMANENT FINANCING FOR INDUSTRIAL FACILITIES: AUTHORIZING A TRUST INDENTURE SECURING THE BONDS; AUTHORIZING A LOAN AGREEMENT BETWEEN THE CITY OF JONESBORO, ARKANSAS AND MCNEIL CORPORATION: AUTHORIZING AND PRESCRIBING OTHER MATTERS PERTAINING THERETO: AND DECLARING AN EMERGENCY

 

Mr. Sanderson moved for suspension of the rules and the ordinance be placed on 2nd reading, seconded by Mr. Hannah, all aye. Mr. Hannah moved the rules be further suspended and the ordinance be placed on 3rd reading, seconded by Mr. Mays, all aye. Mr. Hannah moved for the adoption of the emergency clause, seconded by Mr. Sanderson, all aye and the ordinance was assigned #1772.

 

Mr. Shelton offered the following ordinance:

 

AN ORDINANCE DESIGNATING CERTAIN TRAFFIC CONTROL DEVICES; PROVIDING PENALTIES FOR VIOLATIONS THEREOF AND DECLARING AN EMERGENCY AND FOR OTHER PURPOSES

 

Mr. Sanderson moved the rules be suspended and the ordinance be placed on 2nd reading, Seconded by Mr. Shelton, all aye. Mr. Hannah then moved the rules be further suspended and the ordinance be placed on 3rd reading, seconded by Mr. Minx, all aye. Mr. Hannah moved for the adoption of the ordinance to include the emergency clause, seconded by Mr. Johnson all aye. The ordinance was given the number 1789A.

 

The following ordinance was on 2nd reading:

 

AN ORDINANCE DESIGNATING CERTAIN TIME LIMITS ON CERTAIN STREETS WITHIN THE CITY OF JONESBORO, ARKANSAS

 

The following ordinance was on 3rd reading:

 

AN ORDINANCE TO AMEND SECTION 10-11 OF THE CODE OF ORDINANCE OF THE CITY OF JONESBORO, ARKANSAS: INCREASING THE MONTHLY GARBAGE FEES FOR RESIDENTIAL UNITS (SINGLE FAMILY DWELLINGS AND MULTIFAMILY DWELLINGS) AND DECLARING AN EMERGENCY

 

Mr. Minx offered the following amendment to the ordinance:

 

Residential rate from $4.95 to $5.50

Multifamily rate from $4.40 to $4.95

 

The amendment was seconded by Mr. Hannah and all council voted aye. Mr. Hannah then moved for the adoption of the ordinance as amended to include the emergency clause, seconded by Mr. Sanderson. Mr. Mays and Haggenmacher voted nay, all others voted aye. The ordinance was given the number 1771.

 

City Attorney Lusby discussed with council the lawsuit pending against the City brought by the Jonesboro Sun and advised them that he had a conflict of interest in the suit, his firm having represented the Sun is past. He suggested that the council consider hiring counsel for representation. Mr. Sanderson moved that Mr. Park appoint a committee to hire same and the following were appointed: Sanderson, Province, Haggenmacher.

 

The City received no bids on the used mosquito foggers and Mr. Sanderson moved that they be re-advertised, seconded by Mr. Hinson, all aye.

 

The following bids were received for mosquito fogger:

 

Public Health Equip                     London Aire Mdl. H                     $3,795.00

                     London Aire Mdl. XK                     4,245.00

 

Holiman Equip                     LPCO Mdl. HO                     4,913.00

 

Mr. Minx moved that the low bid be approved, seconded by Mr. Hannah. Voting nay, Shelton, Sanderson, Mays, Haggenmacher. Voting aye: Park, Stricklin, Hinson, Bridger, Minx, Hannah, Johnson, and Province. Motion adopted.

 

Mr. Mays offered the following resolution:

 

RESOLUTION REQUESTING MISSOURI PACIFIC TO INSTALL A MECHANICAL LIGHTED WARNING DEVICE AT CROSSING AT MANILA STREET, JONESBORO, ARKANSAS

 

Mr. Mays then moved for the adoption of the resolution, seconded by Mr. Hinson, all aye. The resolution was given the number 1981:12.

 

Mr. Hannah moved that the City Solicit bids’ for structure at 3004 Race Street, all aye.

 

There being no further business, council adjourned.
