MINUTES

METROPOLITAN AREA PLANNING COMMISSION

MAY 14, 1996

 

MEMBERS PRESENT:  Coleman, Damron, Beadles, Shaw and Phillips                     

 

MEMBERS ABSENT:   Little, Finley and Pitts

 

Consideration of the Comprehensive Land Use Plan as prepared by Al Raby, of the RM Plan Group from Nashville, TN.

 

Members of the Commission and the audience raised various issues related to the comprehensive land use plan.  Some issues were also raised by way of written comments to the Commission.  At the conclusion of the discussion a motion was made by Ms. Shaw, seconded by Dr. Beadles and passed unanimously that the Planning Commission adopt a resolution requesting the land use planners to seriously consider all matters that had been discussed tonight for inclusion in the plan, or as map amendments.  They further asked that the planners submit the revised plan quickly so that the plan may go forth.

 

The main topics of discussion were as follows:

 

1.  Make Casey Springs Road a major road through to Hwy 349

2.  Extend Washington to Hwy 349 for a truck route

3.  Extend Wineland Road to the north to Strawfloor Road and south to Woodsprings Road

4.  Extend residential uses to the west and south, in the south probably one to two miles either side of the ridge probably in  size equal to the residential shown on the north side

5.  Reduce green belt on S. Culberhouse to just follow ditch.  210 acres of development already approved or approval pending

6.  Commercial node on top of Children's Colony misplaced, should be about 3 miles south in the vicinity of Lawson and Stadium

7.  Move southern route to somewhere in the vicinity of Otwell, about 3 miles south of where it is now, leave extension up to 49 south

8.  Move regional shopping center in the northeast, needs to stay on the west side of the tracks

9.  More than one regional commercial is needed, possibly on 63 Bypass near Herget interchange, also in Valley View since 49 is to be widened and extend to Highway 67

10. Take arterial designation off Thomas Green Road

11. Where did the numbers come from specifically on the village residential?  51% single, 7% two family, 9% two family? Formulas need to be reworked.

12. Why would you limit two family and not multi-family?

13. 20% open is too excessive for open space, no one will be  willing to take risk?

14. Why are golf courses not counted as open space?

15. Is this intended to replace the PUD Ordinance?

16. Omit the specific numbers from the land use plan related to village residential but leave the concept there.  Incorporate specifics in the codes portion.

17. Do not limit the combination of owners in village residential to those only with 10 acres or more.

18. Drive through provisions are needed in village residential.

19. Take northern route above Bono, remove curve.

20. Regional airport consideration in conjunction with the City of Paragould for mutual benefit.

21. Bike lanes - incorporate city's current 5 year plan which has been federally funded for the first two phases in the land use book.

22. Don't restrict churches and schools in Village Residential.

23. Remove black star park zone from the Pomona Drive area.

24. Why are there no greenways in the north to northeast areas?

 

Minutes of the April 9, 1996 meeting were approved as submitted.

 

#1 SU96-1  Troy and Sue Martin requested approval of placement of a mobile home on the east side of Easley Lane, adjacent to 1202 Easley Lane.

 

Ms. Shaw moved to approve the request, seconded by Mr. Damron.  Four voted aye, 0 no, REQUEST APPROVED. 

                     

#2 SU96-2  Brad Powell requested approval of placement of a mobile home on the west side of Southwest Drive at 3319 Southwest Drive.

 

Ms. Shaw moved to table the request while awaiting an opinion from the City Attorney.  Mr. Damron seconded, four voted aye, 0 no, REQUEST TABLED. 

 

#3 RZ96-12  Mike and Marcie Walters requested approval of rezoning from R-1 to C-3 for .39 acre located on the west side of Forest Hill Road, north of June Drive.

 

Skip Mooney, attorney for the property owner, explained the history of the property and that is was formerly used as commercial.  Property owners desire to use the building as a dry-wall business with an office and storage of materials.  Mr. Coleman asked if a   C-4 zoning would serve the purpose since everything surrounding this is residential.  Mr. Phillips moved to approve the request amending to C-4 zoning, subject to a 6' privacy fence on the north, south and west sides with green visual barriers.  Dr. Beadles seconded, five voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS. 

 

#4 RZ96-13  Jonesboro Roofing Co., Inc. requested approval of rezoning from R-1 to C-3 for 2.129 acres located on the north side of Washington Avenue Extended, west of Jeramy Drive and east of Matthews Avenue Extended.

 

It was suggested that the property owner petition the City Council to abandon the road ROW on the west side of this property. 

 

Mr. Damron made the motion to approve the request subject to:

1. Road easements shown on the plat or proceed with abandonment

2. Show utility easements on north side

3. 60' from the center line on West Washington needs to be shown

4. Fence on south side will have to be moved out of ROW if requested to do so 

Dr. Beadles seconded, five voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS. 

 

#5 MP96-15  Bobby and Tracy Cupp requested approval of a one lot minor plat containing 1.85 acres and located on the southeast corner of Matthews Avenue and Strawfloor Road.

 

The owners plan to demolish one house after the other house is remodeled. 

 

Ms. Shaw moved to approve the request subject to a 40' ROW on Strawfloor.  Approval is with the understanding that one of the two homes will be renovated and the City is to be notified which one.  The other home will be destroyed and removed from the site within one year of this date or 60 days after occupancy of the renovated home, whichever comes first.  Quit Claim Deeds are to be verified and recorded, and old pins that do not agree are to be removed from property and plat also.  Dr. Beadles seconded, four voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS.

 

#6 RZ96-14  Robert Rees requested approval of rezoning from R-2 to C-4 for Lot 1 of Hughey's Replat of the east half of Lots 11 and 12 of Gregg and Houghton's Subdivision.  The property is located on the southwest corner of Church Street and Campus Street.

 

It was noted that the western and southern adjoining parcels of land had been rezoned in recent weeks to C-4 also.  This property has an existing home on it to be removed as did the previously rezoned property.  Those homes have been or will be removed to make way for commercial development to take place. Mr. Damron moved to approve the zoning change subject to a site plan being submitted and approved by the Planning Commission prior to development.  Streets, traffic, access to the property, drainage and buffering all need to be addressed on the site plan in addition to things typically seen on a site plan.    Ms. Shaw seconded, five voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS.

 

#7 RP96-23 Robert Rees requested approval of a replat of the west 1/2 of Lots 11 & 12 and the north 25' of Lot 13 of Gregg & Houghton's Subdivision and Lot 1 of Hughey's Replat.  The property is located on the east side of Main Street, south of Campus Street and west of Church Street.

 

Mr. Rees was advised that the 7 1/2' utility easement crossing the property from north to south is to remain open and cannot be built upon.  Traffic, building placement and drainage concerns were discussed in depth with Mr. Rees.  It was noted that two single family homes are being replaced with commercial development.

 

Ms. Shaw made a motion to approve the replat subject to:

1.  Main Street property being brought into compliance with MAPC previous resolution regarding right of way in accordance with the Master Street Plan

2.  Campus Street ROW being 30' from centerline in accordance with the Master Street Plan

3.  Church Street ROW being 30' from centerline in accordance with the Master Street Plan

4.  Sewer easement being maintained in its current location

5.  Site plan submitted and approved by Planning Commission before development

Mr. Damron seconded, four voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS. 

 

#8 MP96-12 Ronnie West requested approval of a two lot minor plat containing 1.76 acres.  The property is located on the north side of Casey Springs Road, east of Tall Birch Road.

 

Mr. Damron moved to approve the request subject to an additional 10' ROW on Casey Springs, and the understanding that the shop building cannot be used as commercial.  Dr. Beadles seconded, four voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS. 

 

#9 SP96-12  Joel Sharp requested approval of site plans for a warehouse development to be located on the east side of Old Greensboro Road, north of Johnson Avenue.

 

Mr. Damron made a motion to approve the request subject to:

1.  6' privacy fence to within 10' or so of northwest corner, then slatted chain link to northeast corner of developed property

2.  Landscaping, including trees and shrubs, in the front

3.  Acknowledgement that the building will be on fill -engineering required.

 

Ms. Shaw seconded, four voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS.

 

#10 PP96-6 Gene Barnett requested preliminary approval of subdivision plans for Morrow Acres, a subdivision containing 36 lots on 11.8 acres.  The property is located on the east side of Paragould Drive, and is an extension of Crepe Myrtle Drive.

 

Mr. Phillips make a motion to approve the request subject to:

1.  Addition of engineering comments

2.  Verification of ownership of land between this property and the creek

3.  Final plat with vicinity map included

4.  Final plat with location of Murray Creek Subdivision on the north side

5.  Verification on need of 15' easements (see if they could be lessened)

6.  Installation by owner of 8' fence on the south and west lines adjoining the buggy factory property

 

Mr. Damron seconded, four voted aye, 0 no, REQUEST APPROVED WITH   STIPULATIONS.

 

#11 FP96-1  Lamco requested final approval of subdivision plans for a commercial development.  The subdivision contains 5 lots on 15.26 acres and is located on the south side of Parker Road, on the north and south sides of Sunny Meadow Drive.

 

Item withdrawn prior to meeting.

 

#12 SP96-13  Lamco requested approval of site plans for a commercial development to be located on the northwest corner of Sunny Meadow Cove and Lamberth Lane.

#13 SP96-10 Robert Sartin requested approval of site plans for multiple buildings to be located on the same property.  The proposal includes a series of greenhouses, equipment and truck buildings, retail and office space.  The property is located on the west side of S. Culberhouse Street, south of Parish Lane. 

 

Mr. Damron made a motion to approve the request.  Dr. Beadles seconded, four aye, 0 no. REQUEST APPROVED.

 

#14 MP96-13 STT, Inc. requested approval of a one lot minor plat containing 3.03 acres located on the northwest corner of Highland Drive and Gulley Road.

 

Dr. Beadles made a motion to approve subject to an additional 10' of right-of-way on Gulley Road.  Ms. Shaw seconded, four aye, 0 no, REQUEST APPROVED WITH STIPULATIONS.

 

#15 SP96-11 STT, Inc. requested approval of site plans for a truck terminal to be located on the northwest corner of Highland Drive and gulley Road.

 

Ms. Shaw made a motion to approve the request subject to:

1.  Paved drive to parking

2.  Full pavement without curb and gutter to north line of tract

3.  Landscaping along Highland

4.  Show setbacks on site plan when building permit is obtained

Dr. Beadles seconded, four voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS.

 

#16 RZ96-15 Farmer Enterprises requested approval of rezoning from C-3 to I-1 for 2.88 acres located on the south side of Hwy. 63 Bypass, west of Commerce Drive.

 

Ms. Shaw moved to approve the rezoning, seconded by Dr. Beadles. Five voted aye, 0 no, REQUEST APPROVED.

 

#17 MP96-14 Farmer Enterprises requested approval of a minor plat containing 9.219 acres and located on the south side of Hwy. 63 Bypass, west of Commerce Drive.

 

Ms. Shaw made a motion to approve the request, seconded by Dr. Beadles.  Four voted aye, 0 no, REQUEST APPROVED.

 

#18 SP96-14 Troy Coleman requested approval of site plans for a convenience store to be located on the southeast corner of Matthews Avenue and Gee Street.

 

This intersection has been approved for a stop light.  Traffic concerns and visibility on this corner were mentioned as great concerns.  Curbs to control access is needed because of poor visibility. 

 

Dr. Beadles made a motion to approve the request subject to:

1.  Controlled access by installing curbs on Matthews and Gee Streets as far back from intersection as possible with the approval of the City Engineer

2.  The drainage will have to be reworked based on the plan submitted.  These plans must be approved by the City Engineer.

3.  Cooperate with the city to facilitate the installation of a traffic signal.

 

The motion was seconded by Ms. Shaw.  Four voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS.

 

In other business regarding the St. Bernard's Planned Unit Development, Ms. Shaw made a motion to remove the work session stipulation from the Commission's previous action on April 9, 1996.  Dr. Beadles seconded the motion.  Five voted aye, 0 no, MOTION CARRIED.
