AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS, DATED AUGUST 8, 1976, ASSIGNING SAID ANNEXED TERRITORY TO WARD 3, ZONING SAID ANNEXED TERRITORY (R-3) DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court of Craighead County, Arkansas, on April 2, 1976; and
WHEREAS, said petition for the annexation of said lands was duly signed by the sole owners of all the acreage to be annexed to the City of Jonesboro; and
WHEREAS, an Order setting a hearing on said petition was entered, notice was duly published of said hearing, and the hearing upon said petition was duly had and held in the County Court of Craighead County, Arkansas, on August 8, 1976, at which hearing it was duly found and declared that said Petition for annexation was right and proper and that such lands, hereinafter described, should be annexed to the City of Jonesboro, Arkansas; whereupon an Order of Annexation was made and entered; and
WHEREAS, thirty (30) days have expired since the Order of Annexation dated August 8, 1976, and no proceedings to prevent said annexation have been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas, said annexation proceedings were in all things confirmed by the County Court of Craighead County, Arkansas, by its order of September 16, 1976:
NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territories and lands annexed to the City of Jonesboro by Order of the County Court of Craighead County, Arkansas, by its Order of August 8, 1976, be, and are hereby, accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all of the privileges and rights of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: That the lands and territories hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows:
A part of the Southwest Quarter of the Southeast Quarter of Section 8, Township 14 North, Range 4 East, Craighead County, Arkansas, and being more particularly described as follows: Beginning at the Southwest Corner of the Southwest Quarter of the Southeast Quarter of Section 8, Township 14 North, Range 4 East, Craighead County, Arkansas; thence East 457.38 feet to the point of beginning proper; thence North 1 Degree 23 Minutes East 794.4 feet; thence South 88 Degrees 37 Minutes East 595.8 feet; thence South 1 Degree 22 Minutes West 780.0 feet to the center line of Belt Avenue; thence West 596.2 feet to the point of beginning proper, and containing 10.77 acres, more or less, and being subject to an easement along the South side of the tract for the aforementioned Belt Avenue; and
A part of the Southwest Quarter of the Southeast Quarter of Section 8, Township 14 North, Range 4 East, more particularly described as follows: Beginning at a point 282.48 feet East of the Southwest Corner of said Southwest Quarter of the Southeast Quarter; thence North 1,391.94 feet to public road; thence North 50 Degrees 28 Minutes East 125.72 feet along said public road; thence in a Southeasterly direction 460 feet along a fence line, which line if extended would intersect the South line of said Southwest Quarter of the Southeast Quarter at a point 457.38 feet East of the Southwest Corner of said Southeast Quarter for a point of beginning proper; thence continue South along said fence line extended a distance of 947.52 feet; thence West 75 feet, more or less, to a point 382.38 feet East of the West line of said Southwest Quarter of the Southeast Quarter; thence South 125 feet to the South line of said Southwest Quarter of the Southeast Quarter; thence West along said South line 99.9 feet; thence North 1,011.94 feet; thence East to the point of beginning proper.
Section 3: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward 3 of the City of Jonesboro, Arkansas.
Section 4: That said lands hereinabove described are hereby zoned residential (R-3).
Section 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of said territory described herein can be entitled to fire, police, zoning and other protection and benefits and that said benefits and protection are urgently needed now in order to allow orderly growth and development of said land and territory.
THEREFORE, an emergency is hereby declared to exist and this Ordinance, being necessary for the preservation of the public peace, health and safety, shall take effects and be in full force and effect from and after its passage and approval.
