CITY COUNCIL MINUTES - MAY 15, 2000

 

The Jonesboro City Council met Monday, May 15, 2000 at 6:30 p.m. A full quorum was in attendance. Present were: Mayor Hubert Brodell, City Clerk Donna Jackson, City Attorney, Phillip Crego, and 12 council members. Those members were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy.

 

Councilman Perrin moved, seconded by Councilman Moore to approve the minutes as previously provided. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy.

 

Mayor Brodell made the following presentations:

 

•Crowley’s Ridge Girl Scout Troop 193 and Adult Troop Leader, Laura McCain for the completion of a Youth Service Arkansas community project.

 

•National Peace Officers Memorial Week - May 15 - 19, 2000 and National Peace Officers Day - May 17, 2000

 

Council reviewed the following legal documents pertaining to the 1% sales and use tax:

 

A-1                     Councilman Young moved, seconded by Councilman Moore for the adoption of a resolution stating the Jonesboro City Council’s intent for calling a special election for a one percent (1%) city sales and use tax; stating the City Council’s priority list for Capital Improvement and other funds collected from said tax; and for other purposes. A roll call vote was taken resulting in all members voting aye. Those members were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. The resolution was assigned number 2000:21.

 

A-2                     The following ordinance was on the third and final reading:

 

ORDINANCE PROVIDING FOR THE LEVY OF A ONE PERCENT SALES AND USE TAX WITHIN THE CITY OF JONESBORO, ARKANSAS; ONE HALF (1/2) OF ALL PROCEEDS DERIVED FROM THE SALES AND USE TAX WILL BE FOR FINANCING CAPITAL IMPROVEMENTS OF A PUBLIC NATURE AND THE REMAINING ONE HALF (2) WILL BE FOR GENERAL OPERATING PURPOSES; AND PRESCRIBING OTHER MATTERS PERTAINING THERETO.

 

Mr. Keith Carle was recognized by Mayor Brodell and moved to the front of the agenda in order to address Council regarding the clarification of wording and effect of the ballot title, and other ordinances pertaining to the 1% Sales and Use Tax. Mr. Carle stated even though the community believes Council has the best interest of Jonesboro in mind, the resolution and ordinances state of the money collected, one-half will be used for capital improvements of a public nature, not just drainage and street programs as reported by the media. He explained the ballot title uses the term “Capital Improvements of a Public Nature”, which could include a whole list of improvements besides streets and drainage as defined by A.C.A. 26-75-203.

 

Mr. Carle argued the Citizens of Jonesboro may not want their money spent on some of those improvements and recommended amending the ordinance, using more restrictive language, defining exactly what the money is to be used for rather than allow future councilmen or future mayors to use the funds for something other than street projects and drainage. He explained this will avoid questions later on about what was done and what was intended. Mr. Carle finished by saying that several funds are set in separate accounts, (pension fund, advertising & promotion fund, cemetery fund, and cafeteria plan) beyond the reach of the city council, and if Council believes it is important enough to do this with their own money, then why not the money of the community, guaranteeing it will be used as intended. Mayor Brodell responded saying the attorney who wrote the resolution and ordinances has spoken with other cities and the Arkansas Municipal League and has made every effort to follow the law. Councilman Young moved, seconded by Councilman Roddy for the adoption of the ordinance. A roll call vote was taken resulting in all members voting aye. Those members were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. The ordinance was assigned number 3221.

 

A-3                      The following ordinance was on the third and final reading:

 

ORDINANCE CALLING A SPECIAL ELECTION IN THE CITY OF JONESBORO, ARKANSAS, ON THE QUESTION OF LEVYING A ONE PERCENT SALES AND USE TAX WITHIN THE CITY OF JONESBORO, PRESCRIBING OTHER MATTERS PERTAINING THERETO; AND DECLARING AN EMERGENCY.

 

Councilman Kelton moved, seconded by Councilman Crockett to amend the ordinance to insert the date of adoption and Ordinance No. (3221) in this particular ordinance. A roll call vote was taken resulting in all members voting aye. Those members were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. Councilman Kelton moved, seconded by Councilman Perrin for the adoption of the ordinance as amended. A roll call vote was taken resulting in all members voting aye. Those members were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. Councilman Kelton moved, seconded by Councilman Perrin for the adoption of the emergency clause. A roll call vote was taken resulting in all members voting aye. Those members were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. The ordinance was assigned ordinance number 3222.

 

A-4                     The following ordinance was on the third and final reading:

 

ORDINANCE TO REPEAL THE CITY’S SANITATION DOMESTIC REFUSE FEE; THE MOSQUITO CONTROL FEE AND THE 2.1 MILL GENERAL CITY PROPERTY TAX UPON THE APPROVAL OF A ONE PERCENT (1%) CITY SALES AND USE TAX A THE 2000 SPECIAL ELECTION; REESTABLISHING SAID FEES UPON THE ABOLISHMENT OF SAID TAX; AND FOR OTHER PURPOSES.

 

Councilman Copeland moved, seconded by Councilman Perrin for the adoption of the ordinance. A roll call vote was taken resulting in all members voting aye. Those members were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. The ordinance was assigned number 3223.

 

Councilman Perrin offered the following ordinance for the first reading:

 

ORDINANCE TO REZONE PROPERTY FROM RESIDENTIAL (R-2) TO RESIDENTIAL (R-1), LOCATED AT THE 2100 BLOCK OF HARRISBURG ROAD. (CHARLES SMITH)

Councilman Tate moved, seconded by Councilman Young to suspend the rules and place on second reading. A voice vote was taken resulting in all members voting aye. Councilman Tate moved, seconded by Councilman Young to further suspend the rules and place on third and final reading. Those members voting nay were: Rega, Province, Copeland, and Moore. Councilman Crockett moved, seconded by Councilman Rega for the adoption of the ordinance. Councilman Province offered the following ordinance for the first reading:

Councilman Kelton moved, seconded by Councilman Crockett for the adoption of a resolution expressing the willingness of the City of Jonesboro, Arkansas to participate in the 1998 and 1999 Local Law Enforcement Block Grant (LLEBG) program. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. The resolution was assigned resolution number 2000:22.

 

Councilman Tate moved, seconded by Councilman Crockett for the adoption of a resolution placing traffic signs at the following locations:

 

SPEED LIMIT:

35 M.P.H. on Crowley’s Ridge Road between Harrisburg Road and the south city limits.

 

STOP SIGN:

Changing a 2-way STOP sign to a 4-way STOP sign at School Street and Dewey Street.

A voice vote was taken resulting in all members voting aye. Those members were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. The resolution was assigned resolution number 2000:23.

 

Under new business, Councilman Tate made the recommendation to move MAPC meetings to Council Chambers where it would be more comfortable since the MAPC meetings can be rather lengthy. Mayor Brodell gave MAPC permission to use Council Chambers.

 

Councilman Rega reported the soccer tournament held at the new sports complex was a success, with a large number of people attending from all over the State of Arkansas. Councilman Rega thanked the Street Department and the Parks Department for helping prepare for the event. Mr. Rega also announced a meeting of the Personnel, Insurance, and Professional Services Committee for 5:00 p.m. in the Haworth Room on May 16, 2000 for the purpose of discussing the Cable Franchise Agreement.

 

Councilman Moore reported that Vector Mosquito Control had started abatement for the year 2000, and if anyone had a special outside activity, contact Vector and they would spray the area. He also requested a street light be placed at Stadium Blvd. on Parkwood toward the park. Mayor Brodell stated they would take care of it.

 

Councilman Perrin requested council members to review the 911 report and the many calls they are handling.
