METROPOLITAN AREA PLANNING COMMISSION

NOVEMBER 12, 1996

 

MEMBERS PRESENT:  Coleman, Damron, Gardner, Finley, Beadles, Pitts, Shaw and Phillips

 

MEMBERS ABSENT: Little

 

The minutes of the October 8, 1996 were approved as prepared.

 

#1 SU96-12  Thomas Delk requested approval of placement of a mobile home at 1101 Easley Lane.

 

Mr. Damron moved to approve the request subject to demolition of the house within 30 days after placement of the mobile home.  Ms. Shaw seconded, 7 voted aye, 0 no, REQUEST APPROVED WITH STIPULATION.

 

#2 SU96-13  SU96-13  Scott and Ronda Ruthven requested approval of placement of a mobile home at 7107 C. W. Post Road.

 

Ms. Ruthven's parents were approved for a mobile home a few years ago on adjoining property.

 

Ms. Finley moved to approve the request, seconded by Ms. Shaw.  Seven voted aye, 0 no, REQUEST APPROVED.

 

#3 RZ96-37  Paul Arnold and others requested approval of rezoning from Residential R-1 to Commercial C-3 for 57.93 acres located on the north side of Johnson Avenue, east of Paragould Drive.

 

Skip Mooney, attorney for Mr. Arnold, outlined some of the plans for the property including a church activity center, a parsonage, a city park, a major grocery store, a bank, a veterinarian, an office for the Office of Emergency Services and others.  Roger Lee, Taylor Francis and Robert Ryan, property owners across the road in the Wheeler Heights Subdivision and on Paragould Drive, spoke in opposition to the rezoning.  Mr. Mooney stated that a road would be built all the way to the back of the property that would provide access to other properties.  Mr. Mooney also stated that they would be willing to amend the request to stop at the quarter section line.  There was some concern over the lack of plans for the property though several proposed uses had been stated.

 

Mr. Pitts moved to deny the request, seconded by Ms. Shaw.  Seven voted aye, 0 no, REQUEST DENIED. 

 

#4 RZ96-38  M. J. Fox requested approval of rezoning from Residential R-1 to Commercial C-3 for 18.79 acres located on the east side of Brown's Lane, north of Race Street and west of Bernard Street.

 

Ms. Shaw moved to approve the request subject to a site plan being submitted for each tract and 12 copies of the corrected plat revising the 11-5-96 copies.  Mr. Pitts seconded, 7 voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS. 

 

#5 RZ96-39  Kenneth Sulcer requested approval of rezoning from Commercial C-3 to Industrial I-1 for Lot 1A of the replat Lots 1 & 2 of the replat of Lots 4, 5 & 6, Block B of White Plaza.  The property is located on the south side of Conrad Drive, west of Caraway Road.

 

Skip Mooney, Sr., representing Hugh Vick, stated opposition to the request which adjoins the University Auto Dealership for a distance.  The property adjoins an existing lot zoned I-1.

 

Ms. Shaw moved to approve the request subject to site plan with landscaping being submitted to the MAPC before development.  Ms. Finley seconded, 7 voted aye, 0 no, REQUEST APPROVED WITH STIPULATION.

 

#6 RP96-55  Kenneth Sulcer requested approval of a replat of Lot 4, Block B of a replat of a replat of Lots 4, 5 & 6, Block B of White Plaza.  The property is located on the south side of Conrad Drive, west of Caraway Road.

 

Ms. Shaw moved to approve the replat, seconded by Ms. Finley, 7 voted aye, 0 no, REQUEST APPROVED.

 

#7 RZ96-40  Allen Fike, dba Big Al's, requested approval of rezoning from Residential R-1 to Commercial C-3 for .75 acre located on the northwest corner of Patrick Street and Magnolia Road.

 

Dr. Beadles moved to approve the request with the acknowledgment that the dedication of right of way on Magnolia Road will result in  monitoring wells and fuel tanks being in the right of way and that nothing has to be removed at this time.  Both can remain in the right of way until such time as the tanks have to be replaced at EPA's request.  If the right of way is used before that time the City will have to pay for their relocation.  The owner will be responsible for environmental hazards in the future, should there be any.  Ms. Shaw seconded, 7 voted aye, 0 no, REQUEST APPROVED WITH STIPULATION. 

 

#8 RZ96-41  Jay Harmon requested approval of rezoning from Residential R-1 to Residential R-3 for 27.47 acres located on the east side of Kathleen Street, north of Morton Drive.

 

Dr. Beadles moved to approve the rezoning subject to a site plan being submitted to MAPC prior to development.  Mr. Pitts seconded, 7 voted aye, 0 no, REQUEST APPROVED WITH STIPULATION.

 

#9 MP96-37  Jay Harmon requested approval of a one lot minor plat containing 27.47 acres and located on the east side of Kathleen Street and north of Morton Drive.

 

It was stated that there would be no possibility of gaining additional right of way on the west side of Kathleen Street due to the fact that there is an existing railroad with its own right of way.  Kathleen Street, according to the master street plan, is a major street leading from the industrial park to Highway 49 on the north end.

 

Dr. Beadles moved to approve the request subject to:

1.  The dedication of 90' right of way on northwest side of the property where it adjoins the railroad in accordance with the master street plan.

2.  The dedication of 50' right of way on west property line in accordance with the master street plan

3.  Site plan submitted to MAPC before development

Ms. Shaw seconded, 6 voted aye, 0 no, one absent for vote, REQUEST APPROVED WITH STIPULATIONS.

 

#10 RZ96-42  Jay Harmon requested approval of rezoning from Agricultural AG-1 to Industrial I-1 for the SE 1/4, SW 1/4 of S24, T14N, R4E, less and except the south 270' of said SE 1/4, SW 1/4.  The property is located on the north side of Highland Drive, east of Moore Road.

 

Ms. Shaw moved to approve the request subject to:

1.  Submitting a site plan to MAPC before development

2.  Verification on right of way on Moore's Ditch with City Engineer's office

Mr. Damron seconded, 7 voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS. 

 

#11 RZ96-43  Jay Harmon requested approval of rezoning from Residential R-1 to Industrial I-1 for 49.74 acres located on the west side of Cottage Home Road, north of C. W. Post Road.

 

Dr. Beadles moved to approve the rezoning, seconded by Mr. Pitts.  Six voted aye, 0 no, one absent for vote, REQUEST APPROVED. 

 

#12 MP96-38  Jay Harmon requested approval of a two lot plat containing 49.74 acres and located on the west side of Cottage Home Road, north of C. W. Post Road.

 

Mr. Pitts moved to approve the request subject to elevation certificates being provided at the time of development.  Dr. Beadles seconded, six voted aye, 0 no, one absent for voted, REQUEST APPROVED WITH STIPULATION.

 

#13 SP96-29  Jay Harmon requested approval of site plans for an industrial development to be located on the west side of Cottage Home Road, north of C. W. Post Road.

 

Mr. Phillips moved to approve the site plan, seconded by Mr. Damron.  Seven voted aye, 0 no, REQUEST APPROVED. 

 

#14 RZ96-44  Phillip A. Jones requested approval of rezoning from Residential R-1 to Commercial C-3 for Lot 2A of Fowler Replat of Lot 2 of Fowler First Replat of part of Block A of Marlo Acres First Addition.  The property is located on the southwest corner of Culberhouse Street and Southwest Drive.

 

Mr. Pitts moved to approve the request subject to a site plan being submitted to MAPC before development.  Ms. Shaw seconded, 7 voted aye, 0 no, REQUEST APPROVED WITH STIPULATION.

 

#15 RZ96-45  Bobby Burrow requested approval of rezoning from Residential R-1 to Industrial I-1 for 2.0 acres located on the south side of Parker Road, east of Industrial Drive.

 

Dr. Beadles moved to approve the rezoning, seconded by Mr. Pitts.  Seven voted aye, 0 no, REQUEST APPROVED.

 

#16 MP96-40  Bobby Burrow requested approval of a one lot minor plat containing 2.0 acres located on the south side of Parker Road, east of Industrial Drive.

 

Ms. Shaw moved to approve the request subject to site plan review by the Commission prior to development.  Ms. Finley seconded the motion.  Seven voted aye, 0 no, REQUEST APPROVED WITH STIPULATION.

 

#17 RZ96-46  David Onstead requested approval of rezoning from Commercial C-4 to Commercial C-3 for 1.82 acres located on the east side of Harrisburg Road, south of Gladiolus Drive. 

 

It was noted that in 1989 a request for C-3 zoning had been upgraded to a C-4 zoning and then approved by the MAPC and City Council.  Questions were raised in relation to the proposed development as a Dollar General Store.  Objecting to the rezoning were area residents Willie Simpson, Harry Puddephatt, David Burgess, David Doyle and Chris White. 

 

Mr. Gardner moved to approve the request, seconded by Mr. Damron.  Two voted aye, four voted no, one abstained, REQUEST DENIED.

 

#18 MP96-39  David Onstead requested approval of a two lot plat containing 1.824 acres and located on the east side of Harrisburg Road, south of Gladiolus Drive.

 

Because of Item #17 being disapproved, Item #18 WITHDRAWN.

 

#19 SP96-31  David Onstead requested approval of site plans for a commercial building to be located on Lot 1 of the Poseyville Annex Commercial Addition.  The property is located on the east side of Harrisburg Road, south of Gladiolus Drive.

 

Because of Item #17 being disapproved, Item #19 WITHDRAWN.

 

#20 RZ96-47  Marion Heeb requested approval of rezoning from Residential R-1 to Residential R-2 for .50 acre located on the north side of Utnage Drive, west of Forest Hill Road. 

 

Ms. Shaw moved to table the request due to lack of representation and unanswered questions, seconded by Dr. Beadles.  Six voted aye, 0 no, one absent for vote, REQUEST TABLED. 

 

#21 MP96-36  Marion Heeb requested approval of a one lot minor plat containing .50 acre located on the north side of Utnage Drive, west of Forest Hill Road.

 

REQUEST TABLED in motion on Item # 20.

 

#22 RZ96-48  Keith Meredith requested approval of rezoning from Residential R-1 to Residential R-3 for .32 acre located on the southeast corner of Nettleton Avenue and Smoot Drive.

 

Mr. Phillips moved to table this item and Item 23 at the request of George Hamman, seconded by Ms. Finley.  Five voted aye, one no, one absent for vote, REQUESTS TABLED.

 

#23 MP96-20  Keith Meredith requested approval of a two lot minor plat containing .32 acres located on the southeast corner of Nettleton Avenue and Smoot Drive.

 

REQUEST TABLED IN ABOVE MOTION. 

 

#24 FP96-10  Keith Meredith requested final approval of subdivision plans for Meredith Subdivision Phase II containing 6 lots on 1.54 acres.  The property is located on the south side of Nettleton Avenue, west of Smoot Drive.

 

Mr. Gardner moved to table until information requested on the preliminary is provided.  Mr. Damron seconded, 6 voted aye, 0 no, one absent for vote, REQUEST TABLED. 

 

#25 SU96-2  Brad Powell requested approval of placement of a mobile home at 3319 Southwest Drive.

 

WITHDRAWN by owner and attorney.

 

#26 FP96-11  Bob Gibson requested final approval of subdivision plans for Griffin Park Phase II, containing 20 lots on some acres and located on the west side of Southwest Drive, north of Oak Park Circle.

 

Ms. Shaw moved to approve the request subject to:

1.  Right of way on Highway 49 being shown on plat

2.  Complete legal description on new plat

3.  Staff Comments on inlets and CWL easement

Mr. Gardner seconded, 7 voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS.

 

#27 FP96-12  Robert Rees requested final approval of subdivision plans for Highland Park Subdivision containing 48 lots on 10.93 acres located on the north side of Highland Drive, east of Amanda Drive.

 

Dr. Beadles moved to approve the request subject to:

1.  Showing the portion of Lot 23 that is in floodway on plat

2.  Work out drainage revisions with the City Engineer, particularly the placement of Moore's ditch

3.  Incorporate revised street specifications in plan

Mr. Gardner seconded, 7 voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS.

 

#28 SP96-30 Max Steiner, Precision Tune, requested approval of site plans for a commercial development to be located on the southwest corner of Highland Drive and Bernard Street.

 

Donnie Kissinger, a neighbor, was in attendance and voiced concerns about the project and the need for privacy fencing. 

 

Mr. Gardner moved to approve the request subject to:

1.  Minimum height of 6' privacy fence on north, east and on the west sides to a minimum distance of 10' south of the building

2.  Obtain necessary AHTD permits for driveway cuts

3.  Make at least one 40' drive to permit left turns

Dr. Beadles seconded, 7 voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS.

 

#29 PP96-13  Phillip A. Jones requested approval of subdivision plans for Heritage Village Addition containing 15 lots on 3.70 acres.  The property is located on the northwest corner of Harrisburg Road and Craighead Forest Road.
