AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, CRAIGHEAD COUNTY, ARKANSAS, BY ORDER OF THE COUNTY COURT DATED FEBRUARY 28, 1975, ASSIGNING SAID ANNEXED TERRITORY TO WARD 4; DECLARING AN EMERGENCY AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described was duly filed with the County Clerk of Craighead County, Arkansas, Western District, on January 20, 1975; and
WHEREAS, said petition for the annexation of said lands was signed by a majority of the real estate owners owning a majority of the acreage annexed to the City of Jonesboro; and
WHEREAS, an order setting a hearing on said petition was entered, and notice was duly published of said hearing, and hearing upon said petition was duly had and held in the County Court on the 28th day of February, 1975, at 9:30 a.m., at which hearing it was duly found and declared by the curt that said petition for annexation was right and proper, and that said lands hereinafter described should be annexed to the City of Jonesboro, whereupon an order of annexation was made and entered; and
WHEREAS, thirty (30) days have expired since the order of annexation dated February 28, 1975, and no proceedings to prevent said annexation have been filed in the Circuit Court of the Western District of Craighead County, Arkansas;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
Section 1: That territory and lands annexed to the City of Jonesboro, Arkansas, by order of the County Court of Craighead County, Arkansas, Western District, dated February 28, 1975, be and they are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be deemed and taken to be part and parcel of the limits of the City of Jonesboro, Arkansas, and inhabitants within the new annexation shall have and enjoy all the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territory annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows:
Part of the Northeast Quarter of the Southeast Quarter (0.04 acres) and part of the Northwest Quarter of the Southeast Quarter (18.23 acres), all being in Section 26, Township 14 North, Range 3 East, Craighead County, Arkansas, and being more particularly described as follows: Commencing at the Southeast corner of the Northwest Quarter of the Southeast Quarter of Section 26, aforesaid; thence North 1°14’ East along the East line of the Northwest Quarter of the Southeast Quarter 976.9 feet, to the point of beginning proper; thence North 89°40’ East 1.5 feet; thence South 27°29’ East 61.3 feet; thence South 62° 31’ West 422 feet’ thence South 27°29’ East 179.4 feet; thence South 60°36’ West 215.2 feet; thence South 29° 24’ East 15 feet; thence South 60°36’ West 187.2 feet; thence South 89° 14’ West 293.3 feet; thence North 39°35’ West 161.4 feet; thence South 34°54’ West 140 feet; thence North 55°06’ West 61.8 feet; thence South 34°54’ West 108.4 feet; thence South 89°14’ West 141.9 feet to the west line of the Northwest Quarter of the Southeast Quarter; thence North 0°42’ East along said line 808.7 feet; thence South 89°18’ East 225.4 feet; thence South 0°42’ West 33feet, Thence South 74°26’ East 279.4 feet; thence North 87°06’ East 112 feet; thence North 55°18’ East 60 feet; thence South 34°42’ East 17.7 feet; thence along the arc of an 18.142 degree curve to the right, in a Southeasterly direction, 31 feet; thence North 60°56’ East 137.7 feet; thence South 27°29’ East 44.7 feet; thence North 62°31’ East 220 feet; thence South 27°29’ East 10 feet; thence North 62°31’ East 202 Feet; thence South 27°29’ East 115 feet; thence North 62°31’ East 88 feet; thence South 1°14’ West 185.9 feet to the point of beginning proper, and containing, in all, 18.27 acres, more or less, and being subject to an easement of 100 feet, being 50 feet on either side of the power transmission line as shown on the plat, along the easterly side of the tract.
Section 3: The lands and territory annexed to the City of Jonesboro are hereby accepted by the City and assigned and attached to Ward 4.
Section 4: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that immediate plans for development of the area hereby annexed to the City of Jonesboro, Arkansas, require the immediate extension of fire, police, zoning, water, and other protection and benefits in order to allow the orderly growth and development of said lands and territory, and an emergency in hereby declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety shall take effect from and after its passage.
