AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORY TO WARD 6; ZONING SAID ANNEXED TERRITORY COMMERCIAL THREE (3) AND AGRICULTURAL; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court of Craighead County, Arkansas, on May 5, 1986; and
WHEREAS, said petition for the annexation of said lands was duly signed by the sole owners of all of the acreage to be annexed to the City of Jonesboro, Arkansas; and
WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published of said hearing and a hearing upon said petition was duly had and held in the County Court of Craighead County, Arkansas, on May 5, 1986, at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas; whereupon an order of annexation was made and entered; and
WHEREAS, thirty days having expired since the order of annexation dated May 5, 1986, and no proceedings to prevent said annexation having been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas, said annexation proceedings were in all things confirmed by the County Court of Craighead County, Arkansas, by its order of May 5, 1986.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territory and lands annexed to the City of Jonesboro by order of the County Court of Craighead County, Arkansas, by its order of June 10, 1986, be and are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all of the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas:
Section 2: The lands and territory annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows: (Gene and Kay Barnett, Fred H Barnett, Bera Barnett and Larry Peterson. East of Old Paragould Hwy., S. of Prospect Rd and N. of Hwy 49, 19.1 acres)
A part of the south half of the Northwest Quarter of Section 11, Township 14 North, Range 4 East, more particularly described as follows: Beginning at the Southwest Corner of said Northwest Quarter; thence North 509.0 feet; thence N 89°30’ E 1100.0 feet to the center line of a ditch; thence S 63°25’ E along the center of said ditch 1118.1 feet to the South line of said Northwest Quarter; thence S 89°30’ W 2100 feet to the point of beginning, containing 19.1 acres more or less and being subject to a 30 foot road right-of-way along the West side thereof.
Section 3: Said lands and territory annexed to the City of Jonesboro are hereby classified for purposes of zoning according to the following:
TRACTS 1 and 2 - - Commercial Three
A part of the south half of the Northwest Quarter of Section 11, Township 14 North, Range 4 East, more particularly described as follows: Beginning at the Southwest Corner of said Northwest Quarter; thence North 361.85 feet; thence N 88°17’ E 558.38 feet; thence South 373.74 feet to the south line of said Northwest Quarter; thence S 89° 30’ W 558.15 feet to the point of beginning containing 4.7 acres more or less and being subject to a 30 foot road right-of-way along the West side thereof.
TRACT 3 - - AGRICULTURAL
A part of the South half of the Northwest Quarter of Section 11, Township 14 North, Range 4 East, more particularly described as follows: Beginning at the Southwest Corner of said Northwest Quarter; thence North 361.85 feet to the point of beginning proper; thence continue North 147.15 feet; thence N 89°30’ E 1100.00 feet to the centerline of a ditch; thence S 63°25’ E along the center of said ditch 1118.1 feet to the South Line of said Northwest Quarter: thence S 89° 30’ W 1541.85 feet; thence North 373.74 feet; thence S 88°17’ W 558.38 feet to the point of beginning proper; containing 14.1 acres more or less and being subject to a 30 foot road right-of-way across the West side thereof.
Section 4: To install a water line and a fire hydrant to service the present buildings on property being annexed.
Section 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that property and the citizens and property owners of said territory described herein can be entitled to fire, police, zoning and other protection and benefits and that said benefits and protection are urgently needed now in order to allow orderly growth and development of said lands and territory, Therefore, an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, it shall take effects and be in full force from and after its passage.
