WHEREAS, engineering professionals have determined that building conditions at 100 W. Washington present an immediate public safety risk; and

WHEREAS, it is likely that professional services associated with the building analysis will exceed purchasing guidelines and engineering department budget allocations; and

WHEREAS, it is likely that engineers will recommend protective elements to be constructed or purchased to protect surrounding buildings and to allow for further research on the stability of the primary structure; and

WHEREAS, immediate stabilization efforts of the building may be necessary in order to best protect the general public and nearby buildings that would likely exceed engineering budget allocations.

WHEREAS, Arkansas code allows for necessary expenditures and to waive bidding, purchasing and procurement guidelines in the event of an emergency in accordance with the terms of A.C.A. Section 14-58-303 

NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF JONESBORO, ARKANSAS THAT

SECTION 1: An emergency does exist at 100 W. Washington, commonly referred to as the Citizens Bank Building

SECTION 2: The Jonesboro City Council waives competitive bidding in the interest of public health, safety and welfare in accordance with the terms of A.C.A. Section 14-58-303

SECTION 3: The Jonesboro City Council authorizes Mayor Harold Copenhaver, or his designee, to take reasonable and necessary actions to ensure the public safety of Jonesboro residents in connection with the structure commonly known as the Citizens Bank Building.
