SPECIAL CALLED MEETING CITY COUNCIL MINUTES - JULY 27, 1998
The Jonesboro City Council met Monday, July 27, 1998, at 5:15 p.m. A full quorum was in attendance. Present were: Mayor Brodell, City Clerk, Donna K. Jackson, City Attorney, Phillip Crego and 11 council members. Those members were: Kelton, Rorex, Province, Davis, Tate, Crockett, Rega, Pratt, Young, Bowers, and Roddy.
Councilman Kelton offered the following ordinance for first reading:
ORDINANCE TO AMEND SECTION 2.08.02 OF THE JONESBORO CODE OF ORDINANCES TO ESTABLISH NEW WARD BOUNDARIES
At the request of Mayor Brodell, Marc Miles, Information Systems Director, reviewed the new ward map with Council. He explained the new ward boundaries were drawn around numeration districts so to prevent recounting. He stated the new ward boundaries vary at an average of 4.8 percent as required by law, and established without displacement of any aldermen. Councilman Davis questioned if redistricting ward boundaries was necessary since the last census was a special census and not a decennial census. Mayor Brodell stated it was his understanding that it was necessary after every census, and did not want any lawsuits due to it not being done. City Attorney, Phillip Crego stated A. C. A. 14-43-311 does not specify a particular type of census. Councilman Bowers asked if ward boundaries would have to be redistricted after the year 2000. Mr. Miles stated they would be due to the growth of Jonesboro. Councilman Kelton questioned the boundaries surrounding Ward 1. Mr. Miles explained everyone in Brookhaven (both sides of the street) are in ward one, and from Rosemond south everyone on Broadmoor (both sides of the street) are in ward four. Councilman Rega moved, seconded by Councilman Pratt to suspend the rules and place on second reading. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Rorex, Province, Davis, Tate, Crockett, Rega, Pratt, Young, Bowers, and Roddy. Councilman Young moved, seconded by Councilman Crockett to further suspend the rules and place on third and final reading. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Rorex, Province, Davis, Tate, Crockett, Rega, Pratt, Young, Bowers, and Roddy. Councilman Rega moved, seconded by Councilman Roddy for the adoption of the ordinance. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Rorex, Province, Davis, Tate, Crockett, Rega, Pratt, Young, Bowers, and Roddy. The ordinance was assigned number 3068.
Councilman Young moved, seconded by Councilman Roddy declaring a vacancy for the position of Alderman, Ward 3, and Position 2 effective July 31, 1998. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Rorex, Province, Davis, Tate, Crockett, Rega, Pratt, Young, Bowers, and Roddy.
Councilman Rega moved, seconded by Councilman Bowers for the nomination of Mr. Harold Perrin to fill the unexpired term of Alderman, Ward 3, Position 2 effective July 31, 1998. The motion and second were withdrawn after City Attorney, Phillip Crego read A.C.A. 14- 43 - 411, that states vacancies (for alderman) are to be filled at any regular meeting, after the occurrence of the vacancy. Mr. Crego explained the vacancy must be filled at a regular council meeting, after July 31, 1998.
Attorney Charles (Skip) Mooney, who represents Mr. J. D. Crocker in the zoning matter for property located on the north side of Highland Drive, east of Hillcrest Drive addressed Council regarding a meeting he had with the Jonesboro School Board. Mr. Mooney reported that a compromise was discussed in which Mr. Walden, an investor for the property, would deed to the school board a one foot strip of land all the way across the property, plus 1.2 acres of land on the backside of the property (currently zoned R-1). The estimated cost of the donation was $250,000.00. He explained in order to make the donation, appraisals must be done (for tax purposes) and all the property must be zoned Commercial Three. Mr. Mooney stated at the next council meeting he would amend the current ordinance to read Commercial Three, and in addition introduce a new ordinance zoning the rest of the property to Commercial Three.
