CITY COUNCIL MEETING JULY 19, 1976

 

The Jonesboro City Council met in regular session, Monday, July 19, 1976, at 7:30 p.m. there were present, Mayor, City Clerk, City Attorney, and the following named aldermen: Sanderson, Bridger, Burns, Stricklin, Minx, Smith, Hinson, Haggenmacher, Johnson Hannah and Darling. Absent: Bowers.

 

Harold Ray, minister of the Nettleton Baptist Church gave the invocation.

 

Ronda Etter, representing a group of teenagers, gave to council a petition containing 682 names of persons interested in the teenagers having a place to park their cars without being arrested for loitering. The Mayor suggested that the Parks Committee be giving the petitions for their suggestions.

 

Residents from Owens Street advised council of their drainage problem and Mr. Burns suggested that Mr. Joe Moore bring his recommendations to council at the next meeting.

 

The following ordinance was on first reading and offered by Mr. Stricklin.

                     

AN ORDINANCE AUTHORIZING A LEASE AND AGREEMENT BY AND BETWEEN THE CITY OF JONESBORO, ARKANSAS, AS LESSOR AND ARKANSAS AERO, INC., AS LESSEE IN SUBSTANTIALLY THE FORM AND WITH THE CONTENTS SET FORTH AND MADE A PART OF THE ORDINANCE: AUTHORIZING THE EXECUTION AND DELIVERY OF THE LEASE AND AGREEMENT: PRESCRIBING OTHER MATTERS RELATING THERETO: AND DECLARING AN EMERGENCY

 

Mr. Darling moved that the rules be suspended and the ordinance be placed on 2nd reading, seconded by Mr. Stricklin, all voted aye. After the ordinance was read, Mr. Darling moved that the rules be suspended and the ordinance be placed on 3rd reading, seconded by Mr. Hinson, all voted aye. Mr. Minx then moved for the adoption of the ordinance to include the emergency clause, seconded by Mr. Hannah. All voted aye and the ordinance was given #1517.

 

The following ordinance was on 1st reading and offered by Mr. Stricklin.

 

AN ORDINANCE AUTHORIZING THE ISSUANCE OF INDUSTRIAL DEVELOPMENT REVENUE BONDS UNDER ACT NO. 9 OF THE FIRST EXTRAORDINARY SESSION OF THE SIXTY-SECOND GENERAL ASSEMBLY OF THE STATE OF ARKANSAS, APPROVED JANUARY 21, 1960, AS AMENDED FOR THE PURPOSE OF PROVIDING PERMANENT FINANCING OF THE COSTS OF SECURING AND DEVELOPING INDUSTRY (THE PARTICULAR INDUSTRIAL PROJECT IS DESCRIBED IN THE ORDINANCE); AUTHORIZING THE EXECUTION AND DELIVERY OF A TRUST INDENTURE SECURING THE BONDS: AUTHORIZING AND PRESCRIBING OTHER MATTERS PERTAINING TO THE ACQUISITION, CONSTRUCTION AND EQUIPMENT OF THE INDUSTRIAL PROJECT AND THE FINANCING THEREOF; AND DECLARING AN EMERGENCY

 

Mr. Darling moved that the rules be suspended and the ordinance be placed on second reading, seconded by Mr. Sanderson, all aye. After the ordinance was read, Mr. Darling moved that the rules be suspended and the ordinance be placed on 3rd reading, seconded by Mr. Stricklin, all voted aye. Mr. Darling then moved that the ordinance be adopted to include the emergency clause, seconded by Mr. Sanderson. All voted aye and the ordinance was given #1518.

 

The following bids were opened for three trucks:

Mr. Minx moved that the low bid be accepted from O’Neal Ford, seconded by Mr. Darling, all voted aye.

 

The following bids were opened for a rear loader:

Moody Equipment                     8,647.00

Scruggs Equipment                                          8,361.00                     (Mark III)

                     8,865.00                     (Mark IV)

 

The following bids were opened for 2 side loaders:

 

Hawkins                     $22,626.00

 

Mr. Sanderson moved that the low bids be accepted that met the specifications, honoring the 5% bid law if so required, seconded by Mr. Burns, all voted aye.

 

The following ordinance was on 3rd reading:

 

AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURTHOUSE OF CRAIGHEAD COUNTY, ARKANSAS, ASSIGNING SAID ANNEXED TERRITORY TO WARD 3; ZONING SAID ANNEXED TERRITORY RESIDENTIAL (R-2); DECLARING AN EMERGENCY: AND FOR OTHER PURPOSES

 

Mr. Hannah moved for the adoption of the ordinance to include the emergency clause, seconded by Mr. Hinson. All voted aye and the ordinance was given #1519.

 

The following ordinances were on 3rd reading:

 

AN ORDINANCE TO REPEAL SECTION 2-19 OF THE CODE OF ORDINANCES OF THE CITY OF JONESBORO, ARKANSAS, TITLED CITY TREASURER AND TO CONSOLIDATE THE OFFICE OF CITY TREASURER AND CITY CLERK INTO AN OFFICE TO BE DESIGNATED AS CLERK-TREASURER AND FOR OTHER PURPOSES

 

AN ORDINANCE TO TRANSFER THE FINANCIAL DUTIES OF THE OFFICE OF CITY TREASURER TO THE DEPARTMENT OF FINANCE AND ADMINISTRATION AND FOR OTHER PURPOSES

 

Mr. Hannah moved for the adoption of the ordinances, seconded by Mr. Sanderson. Roll call, voting aye: Sanderson, Bridger, Burns, Stricklin, Minx, Smith and Hannah. Voting nay: Hinson, Haggenmacher and Darling. Mr. Johnson passed. Motion carried. The ordinances were given #1520 & 1521.

 

The following ordinance was on 3rd reading:

 

AN ORDINANCE CREATING THE POSITION OF PUBLIC WORKS DIRECTOR/CITY ENGINEER FOR THE CITY OF JONESBORO, ARKANSAS; PRESCRIBING THE QUALIFICATIONS THEREOF AND RESPONSIBILITIES THEREOF

 

Mr. Burns moved that the ordinance be tabled for thirty days, seconded by Mr. Minx with unanimous vote of council.

 

The following ordinance was on 1st reading and offered by Mr. Hannah.

 

AN ORDINANCE TO PROVIDE CERTAIN TRAFFIC CONTROL DEVICES: TO PROVIDE PENALTIES FOR VIOLATIONS THEREOF: AND FOR OTHER PURPOSES

 

Mr. Hinson moved that the rules be suspended and the ordinance be placed on 2nd reading, seconded by Mr. Smith, all voted aye. After the ordinance was read, Mr. Hannah moved that the rules be suspended and the ordinance be placed on 3rd reading, seconded by Mr. Johnson. Mr. Johnson then moved for the adoption of the ordinance to include the emergency clause, seconded by Mr. Hannah. All voted aye, the ordinance was given #1522.

 

The following ordinance was on 2nd reading:

 

AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT DATED MAY 20, 1976; ASSIGNING SAID ANNEXED TERRITORY TO WARD                     ; ZONING SAID ANNEXED TERRITORY RESIDENTIAL (R-1); AND FOR OTHER PURPOSES

 

Mr. Stricklin moved that the appointment of Wilson Cox to the Electrical Board be accepted, seconded by Mr. Smith, all voted aye.

 

Mr. Stricklin offered the following ordinance:

 

AN ORDINANCE TO AMEND ORDINANCE #1434 WHICH AMENDS ORDINANCE #776 THE SAME BEING AN ORDINANCE PROVIDING FOR THE LICENSING OF ELECTRICIANS, CONTACTORS, AND ETC., UNDER THE ELECTRICAL CODE FOR THE CITY OF JONESBORO, ARKANSAS

 

Mr. Haggenmacher moved that the request for a load limit to be placed on West Washington from Floyd to Gee Street be tabled for two weeks seconded by Mr. Hinson, all voted aye.

 

Mr. Haggenmacher moved that three lots on East Street, belonging to JUR, be sold to Mr. Thomas C. Martin at his bid price of $15,000.00. Motion seconded by Mr. Johnson, after some discussion on the matter, moved that the matter be tabled for up to 60 days, seconded by Mr. Sanderson. All voting aye: Sanderson Bridger, Burns, Stricklin, Minx, Smith Hinson, Johnson and Hannah. Voting nay: Haggenmacher and Johnson.

 

RESOLUTION DATED 7/19/76 AUTHORIZING ACCEPTANCE OF OFFER AND APPROVING THOMAS C. MARTIN AS RE-DEVELOPER AND APPROVING CONTRACT FOR SALE OF LAND FOR PRIVATE RE-DEVELOPMENT OF PARCELS 13-1, 13-2 AND 13-5 NDP PROGRAM

 

The resolution was given the number 1976:13.

 

Mr. Hannah moved that the Church of God in Christ be given permission to solicit for 30 days, seconded by Mr. Stricklin, all voted aye.

 

After a report from Ralph Morrison, Mr. Burns moved that the City Attorney draw an ordinance changing the right-of-way on South Madison from 82’ to 60’, seconded by Mr. Stricklin, all members voting aye.

 

Mr. Sanderson offered the following ordinance:

 

AN ORDINANCE TO AMEND ORDINANCE #954, KNOWN AS THE ZONING ORDINANCE PROVIDING FOR THE CHANGES IN ZONING BOUNDARIES

 

Mr. Smith moved that the ordinance placing a 20 MPH speed zone on Willow road from Race Street south to the city limits be repealed, seconded by Mr. Haggenmacher, all aye.

 

There being no further business, council adjourned.
