AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS BY ORDER OF COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORY TO WARD 6; ZONING SAID ANNEXED TERRITORY COMMERCIAL (C-3) AND INDUSTRIAL (I-2); DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court of Craighead County, Arkansas, on July 25, 1985; and
WHEREAS, said petition for the annexation of said lands was duly signed by the sole owners of all of the acreage to be annexed to the City of Jonesboro, Arkansas; and
WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published and said hearing and a hearing upon said petition was duly had and held in the County Court of Craighead County, Arkansas, on August 28, 1985 at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas; whereupon an order of annexation was made and entered; and
WHEREAS, thirty days having expired since the order of annexation dated August 28, 1985, and no proceedings to prevent said annexation having been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas, by its order of September 30, 1985.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territory and lands annexed to the City of Jonesboro by order of the County Court of Craighead County, Arkansas, by its order of August 28, 1985, be and are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all of the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows: (Robert Harvey & City Water and Light, 63 Bypass & West of Willow Road - Skip Mooney)
TRACT I: All that part of the Northeast Quarter of Section 34, Township 14 North, Range 4 East of the 5th Principal Meridian in Craighead County, Arkansas, lying South and East of the U.S. Highway 63 Bypass and lying South and East of the South frontage road of U.S. Highway 63 Bypass;
TRACT II: A part of the Northwest Quarter of the Northwest Quarter of Section 35, Township 14 North, Range 4 East of the 5th Principal Meridian in Craighead County, Arkansas, more particularly described as follows: From the Southwest corner of the Northwest Quarter of the Northwest Quarter of said Section 35, thence North along the West line of said Section 35, 611.8 feet to the point of beginning; continue thence North 95.6 feet along the West line of said Section 35 to a point on the Southerly right-of-way of U.S. Highway 63 Bypass frontage road at Kathleen Street; thence North 88°56’ East 40.4 feet along said right-of-way to a point; thence North 01°04’ West 97.5 feet along said right-of-way to a point; thence North 87°08’ East 378.5 feet to a point; thence South 208.7 feet to a point; thence South 87°08’ West 417.4 feet to the point of beginning, containing some 1.9 acres, more or less, subject to the right-of-way of a public road on the West side thereof;
TRACT III: A part of the Northwest Quarter of the Northwest Quarter of Section 35, Township 14 North, Range 4 East of the 5th Principal Meridian in Craighead County, Arkansas, more particularly described as follows: From the Southwest Corner of the Northwest Quarter of the Northwest Quarter of said Section 35; thence North 411.8 feet along the West line of said Section 35 to the point of beginning; continue thence North 200 feet along the West line of said Section 35 to a point; thence North 87°08’ East 242.8 feet to a point; thence South 00°20’ East 200.6 feet to a point; thence South 87°16’ West 244.2 feet to the point of beginning, containing some 1.12 acres, more or less, subject to the right-of-way of an existing public road along the West side thereof.
Section 3: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward 6 of the City of Jonesboro, Arkansas.
Section 4: Said lands and territory annexed to the City of Jonesboro are hereby zoned Industrial (I-2) for Tract I and Commercial (C-3) for Tracts II and III.
Section 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there if now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of said territory described herein can be entitled to fire, police, zoning and other protection and benefits and that said benefits and protection are urgently needed now in order to allow orderly growth and development of said lands and territory. Therefore, an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, it shall take effect and be in full force from and after its passage.
PASSED and ADOPTED this 21st day of October, 1985.
