AN ORDINANCE ABANDONING AND VACATING A UTILITY EASEMENT LOCATED ON FRIENDLY HOPE ROAD AS REQUESTED BY MARSHALL MORRISON

Being located on the west side of Friendly Hope Road, approximately twenty three hundred feet (2,300') feet south of the intersection with Woodsprings Road, and being located approximately three hundred feet (300') west of the center-line of Friendly Hope Road.
WHEREAS, the City Council at its regular meeting on September 20, 2005 pursuant to Ark. Stats. Section 14-301-302 through 14-301-304 heard the request of Mr. Marshall Morrison to abandon a utility easement; and
WHEREAS, the City Council held a public hearing and heard all persons desiring to be heard in connection with this matter; and
WHEREAS, all utility companies have consented to said abandonment; and
WHEREAS, the abandonment of said easement would not adversely affect any utility companies and would be in the best interest of all parties concerned.
NOW, THREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that;
SECTION 1: The City of Jonesboro, Arkansas hereby vacates and abandons all of its rights together with the right of the public generally, in and to the utility easement:
Being located on the west side of Friendly Hope Road, approximately twenty three hundred feet (2,3000') feet south of the intersection with Woodsprings Road, and being located approximately three hundred feet (300') west of the center-line of Friendly Hope Road; more particularly described as follows:
A part of Section 33, Township 14 North, Range 3 East, Craighead County, and City of Jonesboro, Arkansas more particularly described as follows: From the southwest corner of the Northeast Quarter of the Southeast Quarter of said Section 33;
Thence run N 89°48'48" E, a distance of 318.92 feet to a point;
Thence run N 26°31'38" E, a distance of 1,471.10 feet to a point;
Thence run N 10°47'45" W, a distance of 372.87 feet to a point;
Thence run S 73°20'17" E, a distance of 166.80 feet to a point;
Said point being the POINT OF BEGINNING of a utility easement fifty feet (50') in width, same being twenty-five feet (25') either side of the following described center-line:
Thence run N 26°49'15" E, a distance of 165.5 feet to appoint;
Thence run 26°13'22" E, a distance of 90.95 feet to a point; said point being the end of the easement as positioned on Mr. Morrison's property.
SECTION 2: A copy of this Ordinance duly certified by the City Clerk shall be filed in the office of the Recorder of Craighead County at Jonesboro, Arkansas, and recorded in the Deed of Records of Craighead County, Arkansas.
SECTION 3: The closing, vacating and abandonment by the City of its rights and the rights of the public generally in the above described easement are in a public interest and will promote the public and welfare
