AN ORDINANCE TO VACATE AND ABANDON PART OF DONALD STREET AND PART OF LEROY STREET

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that:
SECTION 1: The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all of its rights, together with the rights of the public generally, in and to the unnamed street designated as follows:
DESCRIPTION - Donald Street Closure
That part of Donald Street lying North of Oliver Street and South of Leroy Street, all lying in the Southeast Quarter of Section 27, Township 14 North, Range 4 East, Jonesboro, Craighead County, Arkansas being more particularly described as follows: begin at the Northwest Corner of Block "F" of Dudley's Subdivision, Jonesboro, Arkansas: thence South 00°41'01" West, along the East Right of Way line of Donald Street, 412.03 feet to a point lying on the North Right of Way Line of Oliver Street, said point being the Southwest Corner of Block "F" of Dudley's Subdivision: thence North 89°52'44" West, along said North Right of Way Line, 40.00 feet to a point lying on the West Right of Way Line of Donald Street; thence North 00°41'01" East, along said West Right of Way Line, 412.89 feet; thence South 88°38'59" East, departing from said West Right of Way Line, 40.00 feet to the point of beginning proper. Containing in all 16,499 sq feet or 0.38 acres.
DESCRIPTION - Leroy Street Closure
That part of Leroy Street lying East of Block "F" of Dudley's Subdivision and North of Lloyd Harlan's Replat in Block "E" of Dudley's Subdivision, all lying in the Southeast Quarter of Section 27, Township 14 North, Range 4 East, Jonesboro, Craighead County, Arkansas, being more particularly described as follows: begin at the Northeast Corner of Block "F" of Dudley's Subdivision, Jonesboro, Arkansas: thence South 43°19'11" East, along the West Right of Way Line of Leroy Street, 87.78 feet to the point of beginning proper; thence North 46°31'28" East 40.00 feet to a point lying on the East Right of Way Line of Leroy Street; thence South 43°19'11" East, along said East Right of Way Line, 321.07 feet; thence South 68°10'57" West, departing from said East Right of Way Line, 42.99 feet to a point lying on the West Right of Way Line of Leroy Street; thence North 43°19'11" West, along said West Right of Way Line, 305.20 feet to the point of beginning proper. Containing in all 12,525 sq. feet or 0.29 acres.
SECTION 2: A copy of the ordinance duly certified by the City Clerk shall be filed in the office of the recorder of Craighead County, Arkansas and shall be filed in the Deed Records of such office.
SECTION 3: The City Council of the City of Jonesboro, Arkansas finds and declares that the above utility easement is not necessary for the general benefit and welfare of the public; that the owner of all the property abutting the above easement is in favor of the closure and vacation of the above easement and therefore an emergency is declared to exist and this ordinance shall take effect and be in full force from and after its passage and approval.
