RESOLUTION TO CREATE HOUSING AUTHORITY AND URBAN RENEWAL AGENCY

BE IT RESOLVED by the City Council of the City of Jonesboro, Arkansas:

 

That the City Council of Jonesboro, Arkansas, hereby determines, finds and declares, pursuant to the provisions of Chapter 30 of the Statutes of Arkansas (Ark. Stats. #19-3001 through 19-3074), together with any and all provisions of Act No. 298 of the General Assembly for the year 1937, Act No. 212 of 1945, Act No. 189 of 1957, Act No. 40 of 1961, and all Acts amendatory thereto, that:

 

1.  One or more slum blighted, deteriorated or deteriorating areas exist, together with insanitary, unsafe, inhabited dwelling accommodations in the City of Jonesboro, Ark; and

 

2.  The rehabilitation, conservation, development, re-development, or a combination thereof, of such areas and the providing of safe and sanitary dwelling accommodations for families of low income, or a combination of such actions, is necessary in the interest of public health, safety, morals and welfare of the residents of the City, and there is a need for a Housing Authority and Urban Renewal Agency in the City of Jonesboro, Ark., and

 

3.  The Mayor of the City of Jonesboro, Ark., be promptly notified of the adoption of this resolution; and

 

4.  The Mayor be, and he hereby is, directed to file in the office of the City Clerk of Jonesboro, Ark., the necessary certificate evidencing the appointment of commissioners and designating the first chairman of such authority and agency pursuant to the applicable acts of the Legislature of Arkansas.

 

5.  After a study has been made and if a housing project or Urban Renewal Project is recommended, the Council shall refer each project to a vote of the people of the qualified voters in the City of Jonesboro before such project shall be approved. If more than 50% of the qualified voters voting in the City of Jonesboro shall approve the project, it may be entered into by the City Council and the authority. If less than 50% approve the project, it shall not be entered into by the City Council and the authority.

 

6.  Deteriorated, unsafe and crowded buildings and residences constitutes a hazard to occupants thereof and to others, increase the spread of disease, increase the exposure of persons to injury by fire and accident and contribute to violation of laws and ordinances; therefore, the adoption of this resolution is necessary for the preservation of the public peace, health and safety, and the same shall take effect and be in force immediately upon its adoption.
