RESOLUTION TO TRANSFER PROPERTY AND ACCEPT PROPERTY FROM BILLY SARTAIN

WHEREAS, THE CITY OF JONESBORO HAS RECEIVED A DONATION OF PROPERTY FROM NORTH MAIN BAPTIST CHURCH; AND
 
WHEREAS, THE CITY OF JONESBORO NEEDS TO TRANSFER THE FOLLOWING DESCRIBED PROPERTY DONATED BY THE NORTH MAIN BAPTIST CHURCH TO BILLY SARTAIN ET UX, SAID DONATED PROPERTY IS DESCRIBED AS FOLLOWS:
 
Part of Lots 2 and 3 of Pieri Addition to the City of Jonesboro, Craighead County, Arkansas being more particularly described as follows:
 
Begin at the Southeast Corner of Lot 3 of Pieri Addition, Jonesboro, Craighead County, Arkansas; thence South 89°28'24"West along the South line of Lot 3 aforesaid, 95.43 feet to the Southeasterly right- of- way line of State Road #141; thence along said right-of-way line as follows: North 38°52'59" East 111.83 feet, North 38°24'35" East 45.52 feet to the East line of Lots 2 and 3 aforesaid; thence South 1°26'07" West along the said East line of Lots 2 and 3 aforesaid, 121.88 feet to the point of beginning proper, containing 5790.71 square feet
 
WHEREAS, IN EXCHANGE FOR THE ABOVE DESCRIBED PROPERTY BILLY SARTAIN ET UX WILL CONVEY THE FOLLOWING DESCRIBED PROPERTY THEY NOW OWN TO THE CITY OF JONESBORO:
 
Part of the northeast quarter of the southwest quarter of Section 7, T14N, R4E, Craighead County, Arkansas, and being part of Lot 1, Block 2 of the Cartwright and French Addition to the City of Jonesboro, Arkansas, being more particularly described as follows:
 
Permanent Right-Of-Way
 
Beginning at a point in the proposed west line of State Highway 141, said point beginning 30.00 feet left of station 33+83.66 on the proposed centerline of Highway 141 as recorded in Book _________, Page _________, in the office of the Circuit Court Clerk; thence N 00°40' 17" E, 31.34 feet to a point; thence N 21°11' O5" W, 19.86 feet to a point in the existing south line of Center Street; thence with said line N 88°53' 23" E, 12.40 feet to a point in the existing west line of State Highway 141; thence with said line S00°40'17" W, 50.00 feet to a point in the south line of said Lot 1; thence with said line S 88°53' 23" W, 5.00 feet to the point of beginning and containing 0.007 acres (319 sq. ft.).
 
Temporary Construction Easement
 
Beginning at a point, in the proposed west line of State Highway 141, said point being 30.00 feet left of station 33+83.66 on the proposed centerline of State Highway 141; thence S 88° 53' 23" W, 10.00 feet to a point; thence N 00°40' 17" E, 36.84 feet to a point; thence N 43°15'18" W, 17.74 feet to a point in the existing south line of Center Street; thence with said line N 88°53'23" E, 14.92 feet to a point; thence S21°l1'05" E, 19.86 feet to a point; thence S 00°40' 17" W, 31.34 feet to the point of beginning and containing 0.012 acres (512 sq. ft.).
 
Lot 4 of Pieri Addition to the City of Jonesboro, Arkansas, as shown by plat in Deed Record 123 Page 120; subject to easements as shown on recorded plat.
 
Lot 6 of Pieri Addition to the City of Jonesboro, Arkansas as shown by plat in Deed Record 123 page 120, subject to easements as shown on recorded plat.
 
Lot 7 of Pieri Addition to the City of Jonesboro, Arkansas, as shown by Plat in Deed Record 123, page 120, subject to easements as shown on recorded plat.
 
 
WHEREAS, THIS EXCHANGE IS FOR THE PURPOSE OF WIDENING AND IMPROVING HIGHWAY 141 AND;
 
WHEREAS, THE CITY OF JONESBORO BELIEVES SAID IMPROVEMENTS ARE FOR THE USE AND BENEFIT OF THE CITY OF JONESBORO AND ALL ITS RESIDENTS;
 
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF JONESBORO, ARKANSAS THAT:
 
1.  THE CITY OF JONESBORO SHALL TRANSFER THE ABOVE DESCRIBE PROPERTY IN EXCHANGE FOR THE BILLY SARTAIN PROPERTY FOR THE PURPOSES OF WIDENING AND IMPROVEMENT OF SAID HIGHWAY 141.
 
2.  THAT THE MAYOR AND CITY CLERK ARE HEREBY AUTHORIZED TO EXECUTE SUCH DOCUMENTS AS ARE NECESSARY TO EFFECTUATE THIS TRANSFER.  SAID PROPERTY SHOULD BE CONVEYED BY SAME TYPE OF DEED AS DONATED.
 
PASSED AND ADOPTED THIS 4TH DAY OF September, 2001.
