AN ORDINANCE LEVYING AN ADDITIONAL ONE DOLLAR ON THE COURT COSTS FOR MISDEMEANOR OR TRAFFIC VIOLATIONS COMMITTED WITHIN THE CORPORATE LIMITS OF THE CITY; AUTHORIZING SAID INCREASED COSTS TO BE USED FOR THE SALARY AND EXPENSES OF THE CITY ATTORNEY’S OFFICE; AND FOR OTHER PURPOSES

WHEREAS; Act 860 of 1983 authorizes the governing body of a municipality wherein a Municipal Court is located to increase the costs levied and collected from each defendant upon a plea of guilty, nolo-contendere, forfeiture of bond, or determination of guilt for a misdemeanor or traffic violation is said Court by a sum not to exceed $3.00 to be used by said municipality solely for administration of justice purposes; and

 

WHEREAS; the primary function of the office of the City Attorney is the administration of justice;

 

THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

 

Section 1: The City Council of the City of Jonesboro, Arkansas hereby increases the Court costs levied and collected from each defendant in the Municipal Court for Craighead County, Arkansas upon a plea of guilty, nolo contendere, forfeiture of bond or determination of guilt for a misdemeanor or traffic offense committed within the corporate limits of the City of Jonesboro by one dollar.

 

Section 2: The funds generated from this increase in Court costs shall be used to increase the salary of the City Attorney by $3,000 and the balance shall be used to defray the costs of operating the office of City Attorney.

 

Section 3: It is hereby found by the City Council that the work load of the City Attorney’s office is steadily increasing and that the salary presently provided is not sufficiently adequate to compensate the City Attorney for her services. It is further found that without the said increase in Court costs the City would have no funds from which to pay the increased salary. Therefore, an emergency is hereby declared to exist and this ordinance being necessary for the immediate preservation of the public peace, health and safety, this Ordinance shall take effect from and after its passage and approval.
