SPECIAL CALLED CITY COUNCIL MEETING MINUTES - AUGUST 24, 2001

 

The Jonesboro City Council met Friday, August 24, 2001, at 12:00 p.m. in Council Chambers, located at 900 W. Monroe. A full quorum was in attendance. Present were: City Clerk Donna Jackson, City Attorney Phillip Crego, and 9 council members. Those members were: Kelton, Tate, Crockett, Rorex, Rega, Province, Moore, Perrin and Roddy. Mayor Brodell and Councilmen McCall, Young, and Copeland were unable to attend. Vice Mayor Perrin presided over the meeting in the absence of Mayor Brodell.

 

The special meeting was called for the purpose of considering a resolution authorizing the Mayor and City Clerk of the City of Jonesboro, Arkansas to execute documents for the transfer of a permanent easement to the Arkansas Highway Transportation Department in return for the widening and improvement of Highway 49 South by the Arkansas Highway Department. Glenwood Limited Partnership had donated the property to the City of Jonesboro.

 

Prior to reading the resolution Councilman Kelton moved, seconded by Councilman Moore to amend Section 3 to read as follows: “That the Mayor and City Clerk are hereby authorized to execute such documents as are necessary to effectuate this transfer. Said property should be conveyed by Special Warranty Deed, conveying said property with warranty for only those defects in title as may arise out of, and during the city’s ownership.” Councilman Kelton explained the difference between a Warranty Deed, Quitclaim Deed and a Special Warranty Deed. Unlike a Quitclaim Deed, a warranty deed provides the owner will defend indefinitely, any other claims against the title of the property. He explained a Special Warranty Deed would hold the City of Jonesboro liable only until the transfer of the property is completed. A voice vote was taken resulting in all members voting aye in favor of the amendment. Those members voting aye were: Kelton, Tate, Crockett, Rorex, Rega, Province, Moore, Perrin and Roddy. Councilman Rega moved, seconded by Councilman Roddy for the adoption of the resolution as amended. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, Crockett, Rorex, Rega, Province, Moore, Perrin and Roddy. The resolution was assigned resolution number 2001:45.

 

Council requested City Clerk, Donna Jackson to present to the Planning Committee, Personnel Committee and Info-Systems Committee a records management policy for their consideration.

 

With no further business, the meeting was adjourned.
