CITY COUNCIL MINUTES - April 15, 2002

 

The Jonesboro City Council met Monday, April 15, 2002, at 6:30 p.m. A full quorum was in attendance. Present were: City Clerk, Donna K. Jackson, and twelve council members. Those members were: Kelton, Tate, Rorex, Crockett, McCall, Rega, Province, Moore, Young, Perrin, Copeland, and Roddy. City Attorney, Phillip Crego was absent due to illness, and Vice Mayor Young presided over the meeting in the absence of Mayor Brodell.

 

Councilman Rega moved, seconded by Councilman Kelton to approve the minutes of April 1, 2002, as previously delivered. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, Tate, Rorex, Crockett, McCall, Rega, Province, Moore, Young, Perrin Copeland and Roddy.

 

Councilman Rega offered the following ordinance for first reading:

 

ORDINANCE TO REZONE PROPERTY FROM RESIDENTIAL (R-1) TO COMMERCIAL (C-3), LOCATED ON THE NORTH SIDE OF SOUTHWEST DRIVE, EAST OF DARR HILL ROAD. (ROY AND NELL BEARDEN)

 

Councilman Tate moved, seconded by Councilman Perrin to suspend the rules and place on second reading. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, Tate, Rorex, Crockett, McCall, Rega, Province, Moore, Young, Perrin Copeland and Roddy. Councilman Tate moved, seconded by Councilman Rorex to further suspend the rules and place on third and final reading. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, Tate, Rorex, Crockett, McCall, Rega, Province, Moore, Young, Perrin Copeland and Roddy. Councilman Tate moved, seconded by Councilman Roddy for the adoption of the ordinance, but the motion was later withdrawn. After hearing from both sides of the issue Councilman Tate moved, seconded by Councilman Rorex for the adoption of the ordinance. A roll call vote was taken resulting in a ten (10) to two (2) vote against the motion. Those members voting nay were: Kelton, Tate, Crockett, McCall, Province, Moore, Young, Perrin Copeland and Roddy. Those voting aye were: Rorex and Rega. The ordinance was denied.

 

Councilman Tate offered the following ordinance for first reading:

 

ORDINANCE TO REZONE PROPERTY FORM RESIDENTIAL (R-1) TO COMMERCIAL (C-3 LU), LOCATED ON THE SOUTH SIDE OF WASHINGTON AVENUE, APPROXIMATELY 1.000 FEET WEST OF STRATFORD DRIVE. (MARY CRAFT)

 

Councilman Rega moved, seconded by Councilman Perrin to suspend the rules and place on second reading. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, Tate, Rorex, Crockett, McCall, Rega, Province, Moore, Young, Perrin Copeland and Roddy. Councilman Tate moved, seconded by Councilman Moore to further suspend the rules and place on third and final reading. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, Tate, Rorex, Crockett, McCall, Rega, Province, Moore, Young, Perrin Copeland and Roddy. Councilman Moore moved, seconded by Councilman Kelton for the adoption of the ordinance. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, Tate, Rorex, Crockett, McCall, Rega, Province, Moore, Young, Perrin Copeland and Roddy. Councilman Rega moved, seconded by Councilman Perrin for the adoption of the emergency clause. A roll call vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, Rorex, Crockett, McCall, Rega, Province, Moore, Young, Perrin Copeland and Roddy. The ordinance was assigned ordinance number 3350.

 

Councilman Perrin offered the following ordinance for first reading:

 

ORDINANCE TO REZONE 1.14 ACRES FROM RESIDENTIAL (R-1) TO COMMERCIAL (C-3 LU), LOCATED ON THE NORTH SIDE OF WINDOVER ROAD, WEST OF BROWN’S LANE. (MAX DACUS, JR.)

 

Councilman Tate moved, seconded by Councilman Moore to suspend the rules and place on second reading. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, Tate, Rorex, Crockett, McCall, Rega, Province, Moore, Young, Perrin Copeland and Roddy. Councilman Tate moved, seconded by Councilman Kelton to further suspend the rules and place on third and final reading. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, Tate, Rorex, Crockett, McCall, Rega, Province, Moore, Young, Perrin Copeland and Roddy. Councilman Rega moved, seconded by Councilman Perrin for the adoption of the ordinance. A voice vote was taken resulting in all members voting aye. Councilman Kelton offered the following ordinance for first reading:

 

ORDINANCE TO REZONE 2.30 ACRES FROM RESIDENTIAL (R-1) TO COMMERCIAL (C-3 LU), LOCATED ON THE NORTH SIDE OF WINDOVER ROAD, WEST OF BROWN’S LANE. (MAX DACUS, JR.)

 

Councilman Rega moved, seconded by Councilman Perrin to suspend the rules and place on second reading. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, Tate, Rorex, Crockett, McCall, Rega, Province, Moore, Young, Perrin Copeland and Roddy. Councilman Kelton moved, seconded by Councilman Tate to further suspend the rules and place on third and final reading. A voice vote was taken resulting in all members voting aye. Councilman Kelton offered the following ordinance for first reading:

 

ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZE PURCHASE OF MAINTENANCE CONTRACT FOR POLICE DEPARTMENT MOBILE DATA SYSTEM

 

Councilman Perrin moved, seconded by Councilman Crockett to suspend the rules and place on second reading. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, Tate, Rorex, Crockett, McCall, Rega, Province, Moore, Young, Perrin Copeland and Roddy. Councilman Perrin moved, seconded by Councilman Rega to further suspend the rules and place on third and final reading. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, Tate, Rorex, Crockett, McCall, Rega, Province, Moore, Young, Perrin Copeland and Roddy. Councilman Copeland moved, seconded by Councilman Tate for the adoption of the ordinance. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, Tate, Rorex, Crockett, McCall, Rega, Province, Moore, Young, Perrin Copeland and Roddy. The ordinance was assigned ordinance number 3353.

 

Councilman Perrin moved, seconded by Councilman Moore for the adoption of a resolution requesting City Water and Light to provide free utility service to 600 Lawson Road for the Nature Center. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, Tate, Rorex, Crockett, McCall, Rega, Province, Moore, Young, Perrin Copeland and Roddy. The resolution was assigned number 2002:17.

 

Councilman Perrin moved, seconded by Councilman Kelton for the adoption of a resolution expressing the willingness of the City of Jonesboro to utilize Federal-Aid monies for signalization of U.S. Highway 18 and Highway 351 (Cathleen Street). A voice vote was taken resulting in all members voting aye. Those members were: Kelton, Tate, Rorex, Crockett, McCall, Rega, Province, Moore, Young, Perrin Copeland and Roddy. The resolution was assigned number 2002:18.

 

Council made the decision to set an appeal hearing for May 6, 2002, at 6:15 p.m. regarding the Metropolitan Area Planning Commission recommendation to deny a zoning change from Residential (R-1) to Commercial (C-3) for property located on the northwest corner of Johnson Avenue and Clinton School Road. The appeal request was for Mr. Millard Cooper.

 

Under new business, Vice Mayor Young provided a letter from the U.S. Department of Justice pertaining to Community Oriented Policing Services, providing for additional grant opportunities.

 

Councilman Tate moved, seconded by Councilman Moore to accept the low bid meeting bid specifications of Barber Concrete for concrete labor (sidewalks, curb & gutter, driveway, pouring stamp concrete, handicap ramps, ect.). Councilman Tate read from the bid sheet that was provided by the City of Jonesboro to the vendors. It read, “It is expressly understood that the City does not obligate itself to purchase any specific quantity or to make purchases at any specific time. It is further understood that all work requested by the City to the successful bidder shall be done in an immediate and timely manner or the specific job will go to the next low bidder at the City’s desecration.” Discussion followed regarding the process of budgeting for annual maintenance bids. Vice Mayor Young stated he wanted the Finance Committee to review that process. A voice vote was taken resulting in all members voting aye.
