PUBLIC HEARING - 6:15 - A public hearing was conducted for the purpose of vacating a portion of Commerce Drive. Mr. Ron Kendall with Burlington Northern Railroad, and Mr. T.V. Wallace, a local resident spoke in favor of the abandonment. No further discussion was held.

 

CITY COUNCIL MINUTES - May 4, 1998

                     

The Jonesboro City Council met Monday, May 4, 1998, at 6:30 p.m. A full quorum was in attendance. Present were: City Clerk, Donna K. Jackson, City Attorney, Phillip Crego and 11 council members. Those members were: Kelton, Rorex, Davis, Tate, Crockett, Rega, Pratt, Young, Fletcher, Bowers, and Roddy. Councilman Province was unable to attend. Councilman Kelton presided over the meeting in the absence of Mayor Brodell.

 

The minutes for April 20, 1998, were approved as delivered, by Councilman Roddy, seconded by Councilman Tate. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Kelton, Rorex, Davis, Tate, Crockett, Rega, Pratt, Young, Fletcher, Bowers, and Roddy.

 

The following ordinance was on the third and final reading:

 

ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES (Dan Hatch)

 

Councilman Tate moved, seconded by Councilman Davis for the adoption of the ordinance. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Rorex, Davis, Tate, Crockett, Rega, Pratt, Young, Fletcher, Bowers, and Roddy. The ordinance was given the number 3045.

 

Councilman Bowers offered the following ordinance for the first reading:

 

AN ORDINANCE TO VACATE AND ABANDON AN UNIMPROVED PORTION OF COMMERCE DRIVE.

 

Councilman Bowers moved, seconded by Councilman Tate to suspend the rules and place on second reading. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Rorex, Davis, Tate, Crockett, Rega, Pratt, Young, Fletcher, Bowers, and Roddy. Councilman Tate moved, seconded by Councilman Crockett to further suspend the rules and place on third and final reading. At the request of Councilman Pratt, both the motion and the second were withdrawn. Councilman Pratt stated delaying the ordinance would allow time for comments from the community. Councilman Kelton stated Mayor Brodell had requested the ordinance only be read twice as well. No further action was taken regarding this ordinance.

 

Councilman Rorex moved, seconded by Councilman Bowers to allow for the temporary placement of a mobile home at 2100 Moore Road due to the medical needs of Mrs. Mary A. Crain. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Rorex, Davis, Tate, Crockett, Rega, Pratt, Young, Fletcher, Bowers, and Roddy.

 

Councilman Tate moved, seconded by Councilman Pratt for the adoption of a resolution to proceed with condemnation action on Jonesboro property located at 902 and 904 Creath; and property located at 804 Warren. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Rorex, Davis, Tate, Crockett, Rega, Pratt, Young, Fletcher, Bowers, and Roddy. The resolution was assigned number 1998:24.

 

Councilman Young moved, seconded by Councilman Roddy for the adoption of a resolution to place traffic signs at the following locations:

 

Two STOP signs within the City Land Fill

Two 25 MPH speed signs within the City Land Fill                     

Pedestrian Right of Way sign within the City Land Fill

 

A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Rorex, Davis, Tate, Crockett, Rega, Pratt, Young, Fletcher, Bowers, and Roddy. The resolution was assigned number 1998:25.

 

Councilman Crockett moved, seconded by Councilman Pratt for the adoption of a resolution endorsing World Color, located at 4708 Krueger Drive to participate in the Arkansas Enterprise Zone Program. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Rorex, Davis, Tate, Crockett, Rega, Pratt, Young, Fletcher, Bowers, and Roddy. The resolution was assigned number 1998:26.

                                                                                    

Councilman Young moved, seconded by Councilman Roddy for the adoption of a resolution amending the provision dealing with the name of the purchasers of Lot 3 of the Industrial Mini Park from Basic Material, Inc. to Robert L. and Sharon K. Sanders (Resolution 1997:48 was amended). A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Rorex, Davis, Tate, Crockett, Rega, Pratt, Young, Fletcher, Bowers, and Roddy. The resolution was assigned number 1998:27.

 

Councilman Rega moved, seconded by Councilman Young to table the appointments of Herb Davis to the Advertising and Promotion Commission and Joanie Gardner Hannah to the Nature Center until May 18, 1998. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Rorex, Davis, Tate, Crockett, Rega, Pratt, Young, Fletcher, Bowers, and Roddy.

 

Under new business, Councilman Tate moved, seconded by Councilman Rega to allocate $4,829.64 from unappropriated sales tax, to cover election costs of the Restaurant Tax. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Rorex, Davis, Tate, Crockett, Rega, Pratt, Young, Fletcher, Bowers, and Roddy.

 

Councilman Crockett moved, seconded by Councilman Bower’s to amend a resolution placing traffic signs at the following locations:

The resolution was amended to change speed limit signs from 20 MPH to 25 MPH. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Rorex, Davis, Tate, Crockett, Rega, Pratt, Young, Fletcher, Bowers, and Roddy. Councilman Rega moved, seconded by Councilman Crockett for the adoption of the resolution as amended. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Rorex, Davis, Tate, Crockett, Rega, Pratt, Young, Fletcher, Bowers, and Roddy. The resolution was assigned number 1998:28.

 

Councilman Rega requested members of the Personnel Committee to review applications for Fire Chief and be prepared to discuss the matter at a called meeting of the Personnel Committee early next week.

 

Councilman Pratt congratulated those involved with the Special Olympics, and reported it was a big success.

 

Vice Mayor Kelton, recommended setting a new policy requiring plats be 8’by 14 inches with legible street names, so the property may be readily located. It was explained since notification signs get blown down it is sometimes difficult to locate the property. Councilman Young suggested calling Mr. Brian Wadley of the Inspection Department, so Brian could show Council the location of property. In response, Vice Mayor Kelton explained it is not always possible to coincide work schedules. Councilman Pratt asked City Clerk, Donna Jackson if the new policy would create a problem for her office. Mrs. Jackson stated it would not be a problem, and explained there was already an Ordinance requiring plats be 8’ by 14 inches, but explained the Ordinance did not contain a legibility requirement. Councilman Young questioned Vice Mayor Kelton as to how often the problem occurs. Vice Mayor Kelton stated based on recent plats submitted to Council, it happens frequently. Councilman Young questioned if it had been through the MAPC before coming to Council. Vice Mayor Kelton explained it had, but MAPC is provided the full drawn plans. The decision was made to hold discussion till the next council meeting when an ordinance could be introduced.

 

Vice Mayor Kelton reported he was requesting Mayor Brodell to initiate an internal investigation of the Jonesboro Fire Department as to the events occurring April 26, 1998, pertaining to an accident on Caraway Road which resulted in a natural gas main being damaged and a large amount of gas escaped into the atmosphere. The questions Vice Mayor Kelton wanted addressed in the investigation were: Time of notification to the 911 Center, Time the first engine arrived on the scene; which Officer was in command; what time was the Fire Marshall notified; What time was Chief Bradley notified; How long were firemen on the scene before evacuation of the area was considered; and were all department policies followed. It was explained the purpose of the investigation was to evaluate whether or not it is necessary to amend or totally revise the department’s policies. The Fire Committee after reviewing the investigative report will inform Council and make recommendations for approval.
