AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORY TO WARD 4; ZONING SAID ANNEXED TERRITORY RESIDENTIAL (R-1); DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas hereinafter described, was duly filed in the County Court of Craighead County, Arkansas on May 24, 1978; and
WHEREAS, said petition for the annexation of said lands was duly signed by the sole owners of all of the acreage to be annexed to the City of Jonesboro; and
WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published of said hearing and a hearing upon said petition was duly had and held in the County Court of Craighead County, Arkansas on June 30, 1978, at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas, whereupon an order of annexation was made and entered; and
WHEREAS, thirty days (30) having expired since the order of annexation dated June 30, 1978 and no proceedings to prevent said annexation having been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas said annexation proceedings were in all things confirmed by the County Court of Craighead County, Arkansas by its order of August 1, 1978.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territory and lands annexed to the City of Jonesboro by order of the County Court of Craighead County, Arkansas by its order of June 30, 1978, be and are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas and the inhabitants residing therein shall have and enjoy all the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas are more particularly described as follows:
All of the Northeast Quarter of the Northwest Quarter; all of the Southwest Quarter of the Northwest Quarter of the Northeast Quarter; a part of the Northwest Quarter of the Southwest Quarter of the Northeast Quarter; a part of the Southeast Quarter of the Northwest Quarter; and a part of the East Half of the Southwest Quarter of the Northwest Quarter, all in Section 26, Township 14 North, Range 3 East of the 5th Principal Meridian in Craighead County, Arkansas, more particularly described as follows:
From the Southeast Corner of the Southeast Quarter of the Northwest Quarter of said Section 26, the point of beginning, thence South 88 degrees 35 minutes 51 seconds West 1268.22 feet along the South line of the Southeast Quarter of the Northwest Quarter of said Section 26 to the Southwest Corner of Lot 2 of Schroeder Sub-division of part of the Southeast Quarter of the Northeast Quarter of Section 26, Township 14 North, Range 3 East; as shown on the recorded plat thereof; thence North 00 degrees 14minutes 38 seconds West 208.85 feet along the West line of said Lot 2 to a point in the centerline of Arkansas Highway 226, thence along said centerline South 51 degrees 26 minutes 48 seconds West 75.00 feet to a point on the West line of the Southeast Quarter of the Northwest Quarter of Section 26, thence North 00degrees 00 minutes 00 seconds East 257.72 feet along the West line of the Southeast Quarter of the Northwest Quarter of said Section 26 to a point, thence South 88 degrees 44 minutes 05 seconds West 665.49 feet to a point on the East line of the East Half of the Southwest Quarter of the Northwest Quarter of said Section 26, thence North 00degrees 02 minutes 57 seconds East 396.00 feet along the West line of the East Half of the Southwest Quarter of the Northwest Quarter of said Section 26 to a point, thence North 88 degrees 43 minutes 58 seconds East 665.15 feet to a point on the West line of the East Half of the Southwest Quarter of the Northwest Quarter of said Section 26, thence North 00 degrees 00 minutes 00 seconds East 1819.04 feet to the Northwest Corner of the Northeast Quarter of the Northwest Quarter of said Section 26, thence North 88 degrees 33 minutes 57 seconds East 1327.95 feet along the North line of the Northeast Quarter of the Northwest Quarter of said Section 26 to the Northeast Corner thereof; thence South 00 degrees 38 minutes 36 seconds West 664.19 feet along the East line of the Northeast Quarter of the Northeast Quarter of the Northwest Quarter of said Section 26 to the Southeast Corner thereof, thence North 88 degrees 35 minutes 56 seconds East 668.60 feet along the North line of the Southwest Quarter of the Northwest Quarter of the Northeast Quarter of said Section 26.to the Northeast Corner thereof, thence South 00 degrees 41minutes 50 seconds East 665.76 feet along the East line of the Southwest Quarter of the Northwest Quarter of the Northeast Quarter of Section 26 to the Southeast Corner thereof, thence South 89 degrees 27 minutes 04 seconds West 415.97 feet along the South line of the Southwest Quarter of the Northwest Quarter of the Northeast Quarter of said Section 26 to a point in the centerline of Arkansas highway 226, thence along said highway along a curve to the left a distance of 180.34 feet to a point, said curve having a radius of 573.05 feet and a central angle of 18 degrees 01 minutes 52 seconds, continue thence along said centerline South 19 degrees 06 minutes 50 seconds West 201.44 feet to a point, continue thence along said centerline along a curve to the right a distance of 221.23 feet to a point on the East line of the Southeast Quarter of the Northwest Quarter of said Section 26, said curve having a radius of 712.72 feet and a central angle of 17 degrees 47 minutes 03 seconds, thence South 00 degrees 03 minutes 47 seconds East 776.32 feet to the point of beginning, said tract deriving some 40.089 acres from said Northeast Quarter of the Northwest Quarter, deriving some 10.158 acres from said Southwest Quarter of the Northwest Quarter of the Northeast Quarter; deriving some 1.603 acres from said Northwest Quarter; of the Southwest Quarter of the Northeast Quarter; deriving some 39.862 acres from said Southeast Quarter of the Northwest Quarter, deriving some 6.047 acres from said East Half of the Southwest Quarter of the Northwest Quarter; and containing in the aggregate some 97.759 acres, more or less.
Section 3: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward 4 of the City of Jonesboro, Arkansas.
Section 4: Said lands and territory annexed to the City of Jonesboro are hereby zoned Residential (R-1).
Section 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas so that said property and the citizens and property owners of said territory described herein can be entitled to fire, police, zoning and other protection and benefits and that said benefits and protection are urgently needed now in order to allow orderly growth and development of said lands and territory. Therefore, an emergency is hereby declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety shall take effect and be in full force from and after its passage.
