ORDINANCE TO AMEND THE ZONING ORDINANCE OF THE CITY OF JONESBORO, ARKANSAS

WHEREAS, the following described land is currently zoned “C-3” general commercial district:

 

A parcel of land lying in the Northeast Quarter (N.E.1/4) of the Southwest Quarter (S.W.1/4) of Section 23, Township 14 North, Range 3 East, Craighead County, at Jonesboro, Arkansas, being more particularly described as follows:

 

Beginning at the Northeast Corner of The Northeast Quarter (N.E.1/4) of the Southwest Quarter (S.W.1/4) of Section 23 aforesaid, thence south 88°27'16" west, along the north line of the northeast quarter (n.e.1/4) of the southwest quarter (s.w.1/4) of said section 23, a distance of 799.37 feet to a point, said point lying on the west line of stone creek, Pud - 2nd revision, as recorded in plat cabinet “c”, at page 103, in and for the public records of Craighead County, at Jonesboro, Arkansas, said point also lying on the centerline of a 100' Powerline Right-Of-Way; thence South 18°21’41” East, along the West Line of said Plat and along the centerline of said Power Line Right-Of-Way and departing from said North Line, a distance of 204.68 feet to a point lying on the North Right-Of-Way Line of West Nettleton Avenue (60’ Right-Of-Way); thence South 89°58'24" West, along said North Right-Of-Way Line, a distance of 530.51 feet to a point of intersection with the Easterly Right-Of-Way Line of Strawfloor Road (variable width); thence North 1°22'59" West, along said Easterly Right-Of-Way Line, a distance of 163.51 feet to a point: thence North 47°02'54" West, continuing along said Easterly Right-Of-Way Line, a distance of 32.00 feet to a point lying on the North Line of the Northeast Quarter (N.E.1/4) of the Southwest Quarter (S.W.1/4) of said Section 23; thence North 88°55’41” East, along the North Line of the Northeast Quarter (N.E.1/4) of the Southwest Quarter (S.W.1/4) of said Section 23 and departing from said Easterly Right-Of-Way Line, a distance of 493.49 feet to the point of beginning.

 

Containing in all 95,496 sq. ft. Or 2.192 acres, more or less.

 

Subject to Easements, Restrictions, Reservations and Rights-Of-Way of Record; And

 

WHEREAS, the above described land is now owned by Farmer Enterprises, Inc.; and

 

WHEREAS, the Jonesboro Metropolitan Area Planning Commission has recommended that said land be rezoned to “R-1” single-family medium-density district; and

 

WHEREAS, it appears to the City Council that all applicable laws of the State of Arkansas and of the City of Jonesboro have been complied with in presenting this ordinance to the City Council.

 

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that:

 

SECTION 1: The Zoning Ordinance of the City of Jonesboro, Arkansas, codified as Title 14 of the Jonesboro Municipal Code, should be, and it hereby is amended so that the land hereinabove described is zoned “R-1” single-family medium-density district. 

 

SECTION 2: All ordinances and parts of ordinances in conflict herewith are hereby repealed.

 

SECTION 3: The City Clerk is hereby directed to amend the official zoning district boundary map of the City of Jonesboro, Arkansas, insofar as it relates to the land described hereinabove so that the zoning classification of said land shall be in accordance with the provisions of this Ordinance.
