AN ORDINANCE TO COMPLY WITH THE PROVISIONS OF THE REVENUE SHARING ACT OF 1972 AS AMENDED IN 1976 TO INCLUDE DISCRIMINATION PROHIBITIONS OF SECTION 504 OF THE FEDERAL REHABILITATION ACT OF 1973

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

 

Section 1: Handicapped parking space shall be provided at the City Hall Parking Lot and at the Justice Complex.

 

Section 2: The grievance procedure in Section IV, 4.1 of the employees handbook adopted by the City Council January 17, 1977, shall apply. This procedure shall be available at the Mayor’s Office for public inspection. Complaints alleging handicapped discrimination may be directed to the Mayor’s Office. Such complaints shall receive a review within ten (10) working days. If the Mayor’s Office, after the review, cannot resolve the complaint, the matter shall be presented to the City Council at the first City Council meeting following a period of fifteen (15) days from the date of the complaint. After hearing the complaint, the City Council shall apply all due process standards to a resolution of the complaint.

 

Section 3: Structural changes shall be made to the City Hall Building in order that accessibility to all public meetings and governmental functions is afforded to all handicapped persons. Structural changes shall include, but not limited to; necessary ramps for entrance, doors, elevators or lift devices and restroom modifications.

 

Section 4: Structural changes shall be made at the Community Center in order that accessibility to recreational programs and functions is afforded to all handicapped persons. Structural changes shall include, but not be limited to; necessary remaps for entrance, doors, pool lift devices, foot bath bridges and restroom modifications.

 

Section 5: It shall be the intent of the City Council to complete the specified structural changes within one year after the passage of this Ordinance. The Mayor shall be responsible for implementing the plan for all structural changes and shall make periodic progress reports to the full Council.

 

Section 6: Upon seventy-two (72) hours notice to the Mayor’s Office, the City shall provide, at the Cities public meetings or functions, an interpreter for persons with hearing disabilities.

 

Section 7: It is found and declared by the City Council that this Ordinance being necessary for the public peace, health and safety, an emergency is hereby declared to exist and this Ordinance shall take effect from and after its passage and approval.
