Minutes from the City Council meeting on November 21, 1994

PUBLIC HEARING 6:50 P.M. - A public hearing was conducted for the purpose of vacating street easements along lots G, H and K in the Caldwell's Subdivision. Mr. Guy Lowes expressed his concerns of a 1300 foot right-of-way, with no cul-de-sac and is a dead end. Mr. Rhiddlehoover explained all the homes egress and ingress from a different road. No other opposition was voiced.

 

PUBLIC HEARING 7:00 P.M. - A public hearing was conducted for the purpose of vacating and abandoning a portion of Higginbottom Creek easement across the back of Mickey Seeman's property. Mr. Skip Mooney represented Mr. Seeman in this matter. Mr. Mooney stated he had faxed a copy of a Safe Harmless Agreement to Mr. Guy Lowes, City Engineer. Councilman Kelton questioned if anything had changed from the last time this matter was brought before the Council. Mr. Mooney answered, no it had not.

 

CITY COUNCIL MINUTES, NOVEMBER 21, 1994

 

The Jonesboro City Council met in regular session, Monday, November 21, 1994, at 7:30 P.M. A full quorum was in attendance. Present were City Attorney, City Clerk and all council members with the exception of Councilman Evans who was unable to attend. Councilman Harpole was late due to other city business. Vice Mayor Hannah presided over the meeting in the absence of Mayor Brodell.

 

The minutes of November 7, 1994, were approved as mailed on motion by Councilman Perrin seconded by Councilman Wise. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were: Wise, Ingram, Province, Mullenix, Bowers, Perrin, Kelton, Vance, Mays, and Hannah.

 

The following ordinance was on the third reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954, KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES. (Robin Holeman)

 

Mr. B. G. Pickering of 903 Pickering Drive spoke in opposition to this rezoning stating it would cause a domino effect of Residential Two zoning in the area. Mr. and Mrs. Holeman presented a "Covenant" agreeing to conditional zoning which would cancel the Residential Two Zoning, should the Holeman's move. Councilman Kelton moved, seconded by Councilman Vance for the adoption of the ordinance. A roll call vote was taken resulting in all council members voting nay. Those members voting nay were: Wise, Ingram, Province, Mullenix, Bowers, Perrin, Kelton, Vance, Mays, and Hannah. The ordinance was denied.

 

The following ordinance was on the third reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954, KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES. (Farmer Enterprises)

 

Councilman Mays moved, seconded by Councilman Vance for the adoption of the ordinance. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were: Wise, Ingram, Province, Mullenix, Bowers, Perrin, Kelton, Vance, Mays and Hannah. The ordinance was given the number 2584.

 

The following ordinance was on the third reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954, KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES. (Larry Robertson)

 

Councilman Vance moved, seconded by Councilman Perrin for the adoption of the ordinance. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were: Wise, Ingram, Province, Mullenix, Bowers, Perrin, Kelton, Vance, Mays and Hannah. The ordinance was given the number 2585.

 

The following ordinance was on the third reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954, KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES. (Ron Montgomery)

 

Councilman Vance moved, seconded by Councilman Perrin for the adoption of the ordinance. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were: Wise, Ingram, Province, Mullenix, Bowers, Perrin, Kelton, Vance, Mays and Hannah. The ordinance was given the number 2586.

 

Councilman Kelton offered the following ordinance for the first reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954, KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES. (David Gary)

 

Councilman Kelton moved, seconded by Councilman Wise to suspend the rules and place the ordinance on second reading. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were: Wise, Ingram, Province, Mullenix, Bowers, Perrin, Kelton, Vance, Mays, and Hannah.

 

Councilman Mays offered the following ordinance for the first reading:

 

AN ORDINANCE ABANDONING A PORTION OF EASEMENT FOR HIGGINBOTTOM CREEK LOCATED IN THE CITY OF JONESBORO, ARKANSAS. (Mickey Seeman)

 

After much debate Vice Mayor Hannah requested Mr. Lowes, City Engineer to give his opinion regarding the matter. Mr. Lowes stated in his opinion the easement would not be needed by the City and recommended abandoning the five foot easement. Councilman Mays moved, seconded by Councilman Wise to suspend the rules and place on second reading. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were: Wise, Ingram, Province, Mullenix, Bowers, Perrin, Kelton, Vance, Mays, and Hannah. Councilwoman Ingram moved, seconded by Councilman Wise to further suspend the rules and place on the third and final reading. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were: Wise, Ingram, Province, Mullenix, Bowers, Perrin, Kelton, Vance, Mays, and Hannah. Councilman Mays moved, seconded by Councilman Ingram for the adoption of the ordinance. A roll call vote was taken resulting in a seven to three vote in favor of the motion. Those members voting aye were: Wise, Ingram, Mullenix, Bowers, Perrin, Mays and Hannah. Those members voting nay were: Province, Kelton and Vance. The ordinance was given the number 2587.

 

Councilman Vance offered the following ordinance for the first reading:

Councilman Bowers moved, seconded by Councilman Perrin to suspend the rules and place the ordinance on second reading. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were: Wise, Ingram, Mullenix, Bowers, Perrin, Kelton, Vance, Mays, and Hannah. Councilman Province had stepped out of the meeting for a few minutes and did not vote.

 

Councilwoman Ingram offered the following ordinance for the first reading:

 

AN ORDINANCE SETTING STANDARDS FOR PERSONS OR FIRMS TO OPERATE EMERGENCY TRANSPORT SERVICES WITHIN THE CITY LIMITS

 

Councilman Vance moved, seconded by Councilman Perrin to suspend the rules and place the ordinance on second reading. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were: Wise, Ingram, Province, Mullenix, Bowers, Perrin, Kelton, Vance, Mays, and Hannah.

 

The following bids were reviewed:

 

94:44 - Dual Side Loader - Sanitation Department

On the recommendation of the Sanitation Committee and Mr. Lowes, Councilman Perrin moved, seconded by Councilman Kelton to reject all bids due to a lack of data. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were: Wise, Ingram, Province, Mullenix, Bowers, Perrin, Kelton, Vance, Mays, and Hannah.

 

94:42 - 25 Cubic Yard Truck - Sanitation Department

On the recommendation of the Sanitation Committee and Mr. Lowes, Councilman Perrin moved, seconded by Councilman Bowers to accept a second truck from bid from Blackwell Baldwin at $79,661.00. This amount included a five year warranty. Councilman Vance questioned City Attorney Pam Honeycutt on the legalities of accepting a bid on a second truck. Ms. Honeycutt stated she believed it was appropriate to accept this bid because we are buying the same piece of equipment from the same company at the same bid price. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were: Wise, Ingram, Province, Mullenix, Bowers, Perrin, Kelton, Vance, Harpole (Councilman Harpole had arrived late, due to a MATA meeting), Mays, and Hannah.

 

The following Millage Resolutions were reviewed:

 

Fireman's Pension Millage -

Councilman Province moved, seconded by Councilman Wise for the adoption of the resolution. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were: Wise, Ingram, Province, Mullenix, Bowers, Perrin, Kelton, Vance, Harpole (Councilman Harpole had arrived late, due to a MATA meeting) Mays, and Hannah. This resolution was given the number 1994:63.

 

Library Millage -

Councilman Kelton moved, seconded by Councilman Perrin for the adoption of the resolution. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were: Wise, Ingram, Province, Mullenix, Bowers, Perrin, Kelton, Harpole, Mays, and Hannah. (Councilman Vance left the meeting for a few minutes and did not vote). This resolution was given the number 1994:64

 

Policemen's Pension Millage -

Councilman Perrin moved, seconded by Councilman Wise for the adoption of the resolution. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were: Wise, Ingram, Province, Mullenix, Bowers, Perrin, Kelton, Vance, Harpole, Mays, and Hannah. This resolution was given the number 1994:65

 

City Millage -

Councilman Perrin moved, seconded by Councilman Mullenix for the adoption of the resolution. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were: Wise, Ingram, Province, Mullenix, Bowers, Perrin, Kelton, Vance, Harpole, Mays, and Hannah. This resolution was given the number 1994:66.

 

Councilman Harpole moved, seconded by Councilman Bowers for the adoption of a resolution condemning two properties, 224 S. Fisher and 3815 E. Highland. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were: Wise, Ingram, Province, Mullenix, Bowers, Perrin, Kelton, Vance, Harpole, Mays, and Hannah. This resolution was given the number 1994:67.

 

Under new business, Councilman Kelton offered the following ordinance for the first reading:

 

AN ORDINANCE TO REPEAL ORDINANCE NO. 2484 AND AMEND ORDINANCE NO. 2280, THE NON-CONFORMING USE ORDINANCE, SECTION 13, TO EXTEND THE FILING DEADLINE CONFORMING USE AS IT EXISTED ON APRIL 7, 1989; AND FOR OTHER PURPOSES

 

Councilman Kelton explained it was necessary to extend the deadline one more time so that notification could be announced using local media, to assure all citizens had been notified of the deadline. Councilman Kelton moved, seconded by Councilman Wise to suspend the rules and place the ordinance on second reading. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were: Wise, Ingram, Province, Mullenix, Bowers, Perrin, Kelton, Vance, Harpole, Mays, and Hannah. Councilman Wise moved, seconded by Councilman Perrin to further suspend the rules and place the ordinance on third and final reading. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were: Wise, Ingram, Province, Mullenix, Bowers, Perrin, Kelton, Vance, Harpole, Mays, and Hannah. Councilman Vance moved, seconded by Councilman Kelton for the adoption of the ordinance. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were: Wise, Ingram, Province, Mullenix, Bowers, Perrin, Kelton, Vance, Harpole, Mays, and Hannah. The ordinance was given the number 2588.

 

Councilman Harpole moved, seconded by Councilman Vance to set a public hearing for 6:30 p.m. on December 5, 1994, for the purpose of considering the MATA Plan. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were: Wise, Ingram, Province, Mullenix, Bowers, Perrin, Kelton, Vance, Harpole, Mays, and Hannah.

 

With no further business the meeting was adjourned.
