AN ORDINANCE TO AMEND TITLE 14, KNOWN AS THE ZONING ORDINANCE OF THE CITY OF JONESBORO, ARKANSAS, PROVIDING FOR CHANGES IN ZONING BOUNDARIES

WHEREAS, the following described lands located in Jonesboro, Craighead County, Arkansas, are currently zoned R-1, single family residential:
 
Lot 3 in Block "B" of Marlo Acres, First Addition, Jonesboro, Craighead County Arkansas, as shown on Plat recorded in Plat Book 123, Page 116 at Jonesboro, Arkansas.
 
WHEREAS, all applicable laws, rules and regulations have been complied with in presenting this Ordinance to the City Council.
 
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that:
 
SECTION I:      The Zoning Ordinance of the City of Jonesboro, Arkansas, codified as Title 14 of the Jonesboro Municipal Code, should be, and hereby is amended so that the Property described herein shall be zoned as C-4 L.U.O. with the uses set forth in Section II.
 
SECTION II:      The following uses are hereby allowed by approval of the City Council:
 
a)      Animal care, limited
b)      Automated teller machine
c)      Bank or financial institution
d)      Bed and breakfast
e)      Church
f)      Day care, limited (family home)
g)      Day care, general
h)      Government service
i)      Library
j)      Medical service/office
k)      Museum
l)      Nursing home
m)      Office, general
n)      Parks and recreation
o)      Recreation/entertainment, indoor
p)      Retail/service
q)      Safety services
r)      School, elementary/middle & high
s)      Vocational school
 
SECTION III: The following uses may not be used pursuant to this C-4 L.U.O. zoning for the subject property:
 
1.      Animal care, general
2.      Auditorium or stadium
3.      Car wash
4.      Cemetery
5.      College or university
6.      Communication tower
7.      Construction sales and service
8.      Convenience store
9.      Funeral home
10.      Golf course
11.      Hospital
12.      Recreation/entertainment, outdoor
13.      Recreational vehicle park
14.      Restaurant, fast-food
15.      Restaurant, general
16.      Service station
17.      Sign, off-premise
18.      Vehicle repair, limited
 
SECTION IV: The following conditions are required pursuant to the C-4 L.U.O. rezoning for the subject property:
 
1.  Upon reuse or redevelopment of the property, privacy fencing shall be maintained or erected along the eastern and northern boundaries.
 
2.  That a future site development plan be submitted and reviewed by the MAPC prior to any future redevelopment of the site.
 
3.  All future improvements shall remain consistent with the residential character of the area.
 
SECTION V: All ordinances and parts of ordinances in conflict herewith are hereby repealed.
 
SECTION VI: The City Clerk is hereby directed to amend the official zoning district boundary map of the City of Jonesboro, Arkansas, insofar as it relates to the Property, so that the zoning classification of the Property shall be in accordance with the provisions of this Ordinance.
