CITY COUNCIL MINUTES AUGUST 6, 1979

 

The Jonesboro City Council met in regular session, Monday, August 6, 1979, at 7:30 p.m. Present: Mayor City Attorney, City Clerk and all aldermen.

 

A Public Hearing was held concerning an Act 9 Bond Issue for Delta, Incorporated.

 

Mr. Park moved that the minutes of July 16, be approved as mailed, seconded by Mr. Shelton. All voted aye.

 

Mr. Sanderson offered the following ordinance:

 

AN ORDINANCE AUTHORIZING THE ISSUANCE OF INDUSTRIAL DEVELOPMENT REVENUE BONDS FOR THE PURPOSE OF PROVIDING PERMANENT FINANCING FOR INDUSTRIAL FACILITIES: AUTHORIZING A TRUST INDENTURE SECURING THE BONDS; AUTHORIZING A LEASE AND AGREEMENT BETWEEN THE CITY OF JONESBORO, ARKANSAS, AS LESSOR AND DELTA, INC. OF ARKANSAS, AS LESSEE, AUTHORIZING THE SALE OF THE BONDS AND THE EXECUTION OF A BOND PURCHASE AGREEMENT IN CONNECTION THEREWITH; AUTHORIZING AND PRESCRIBING OTHER MATTERS RELATING THERETO: AND DECLARING AND EMERGENCY 

 

Mr. Sanderson moved that the rules be suspended and the ordinance be placed on 2nd reading, seconded by Mr. Mays. All voted aye. After the reading, Mr. Park moved that the rules be further suspended and the ordinance placed on 3rd and final reading, seconded by Mr. Shelton. All voted aye. Mr. Sanderson then moved for the adoption of the ordinance subject to an agreement being made for payment in lieu of taxes being made before the signing of the bonds. The motion was seconded by Mr. Minx with all council voting aye. Mr. Sanderson then moved for the adoption of the emergency clause, seconded by Mr. Stricklin. All voted aye. The ordinance was given the number 1690.

 

Wilburn Green with the Crowley Ridge Traditional Music Guide expressed thanks to the Council for their efforts in obtaining the Forum and explained the purpose of the Guild. He also presented tickets to City officials for their next performance.

 

Mr. Charles Mooney, representing Mr. William Lawson in an appeal from a decision rendered by the Board of Zoning Adjustment, which allowed the adjoining property owners to erect a carport within one foot of the property line, expressed the following objections:

(a) The Lawson’s did not receive a seven-day notice for the Board.

(b)                     The adjustments should be made only in case of extreme hardship.

(c)                     Building restrictions in the Bill of Assurance are violated.

 

Mr. Park moved that the decision of the Board of Zoning Adjustment concerning the variance granted at 710 Valley Drive be overruled and the building permit be declared void and null. The motion was seconded by Mr. Shelton. Voting aye: Park, Sanderson, Shelton, Bridger, Minx, Hannah, Haigler, Stricklin, Province and Mays. Voting nay: Hinson and Haggenmacher. Motion carried.

 

The following ordinance was on 2nd reading:

 

AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS: ASSIGNING SAID ANNEXED TERRITORY TO WARD 6; ZONING SAID ANNEXED TERRITORY COMMERCIAL (C-3): DECLARING AN EMERGENCY AND FOR OTHER PURPOSES

 

Mr. Sanderson offered the following ordinance:

 

AN ORDINANCE TO AMEND SECTION 5-8 AND 5-9, AS AMENDED, THE SAME DEALING WITH ADOPTION OF THE BUILDING CODE FOR THE CITY OF JONESBORO, ARKANSAS

 

Mr. Sanderson moved that rules be suspended and the ordinance be placed on 2nd reading, seconded by Mr. Park, all voted aye. Mr. Sanderson then moved that the rules be further suspended and the ordinance be placed on 3rd reading, seconded by Mr. Park. All voted aye. Mr. Sanderson then moved for the adoption of the ordinance to include the emergency clause, seconded by Mr. Park. All voted aye and the ordinance, was assigned #1691.

 

Mr. Sanderson offered the following ordinance:

 

AN ORDINANCE TO AMEND SECTION 5-40 OF THE CODE OF ORDINANCES OF THE CITY OF JONESBORO ARKANSAS, AS AMENDED, THE SAME DEALING WITH THE ADOPTION OF THE SOUTHERN STANDARD HOUSING CODE

 

Mr. Mays moved that the rules be suspended and the ordinance be placed on 2nd reading, seconded by Mr. Sanderson. All voted aye. Mr. Sanderson then moved the rules be further suspended and the ordinance be placed on 3rd and final reading. All voted aye. Mr. Sanderson moved for the adoption of the ordinance to include the emergency clause, seconded by Mr. Shelton. All voted aye and the ordinance, was assigned #1692.

 

Mr. Stricklin offered the following ordinance:

 

AN ORDINANCE ESTABLISHING MATERIAL STANDARDS FOR SANITARY SEWER LINES WHICH SHALL BE CONSTRUCTED UNDER STREET AND HIGHWAY RIGHT-OF-WAY; AND FURTHER PROVIDING METHODS OF CONSTRUCTING SEWER LINES UNDER STREET AND HIGHWAY RIGHT-OF-WAY AND PROVIDING PENALTIES FOR VIOLATIONS THEREOF

 

Mr. Sanderson moved that the rules be suspended and the ordinance placed on 2nd reading, seconded by Mr. Park. All voted aye.

 

Mr. Stricklin offered the following ordinance:

 

AN ORDINANCE PROVIDING FOR CERTAIN TRAFFIC CONTROL DEVICES; TO PROVIDE PENALTIES FOR VIOLATIONS THEREOF; AND FOR OTHER PURPOSES

 

Mr. Sanderson moved that the ordinance be placed on 2nd reading, seconded by Mr. Park. All voted aye.

 

The following bids were received for duct return on air conditioning system:

Air Right Heating & Cooling                     $860.00

Comfort Mechanical                     1,096.00

S&I Sheet Metal                     1,736.00

Springle Electric                     1,480.00

 

Mr. Sanderson moved that the low bid meeting the specs be approved, seconded by Mr. Park. All voted aye.

 

On motion by Mr. Hinson, seconded by Mr. Shelton and unanimous vote of council, the request for an additional parking space on Union was denied. The reason for denying the request was because of blocking private parking spaces.

 

On recommendation from Parks Commission, Mr. Park moved that the City purchase .86 acres adjoining North-side Park for $10,000.00 from un-appropriated funds. Mr. Haggenmacher, seconded the motion. All council voted aye.

 

Permission was granted for placing mobile home at 1005 E. Washington, on motion by Mr. Park, seconded by Mr. Haggenmacher and unanimous vote of council.

                     

The Mayor recommended the following to serve on the Public Facilities Commission and advised council he would ask for their approval at the following meeting: Nancy Haigler, Bob McGough and Steve Baker.

 

By unanimous vote of council Mr. Ed Cunningham was appointed Chief of Police effective September 1, 1979.

 

Mr. Minx moved that the lot at 1515 Aggie be cleaned and a lien placed on the property. Motion seconded by Mr. Hinson. All voted aye.

 

On motion by Mr. Sanderson, seconded by Mr. Bridger, speed bumps will be removed as streets are overlaid and it residents want the bumps installed, petitions should be made to City Council. Mr. Minx cast the only dissenting vote.

 

On motion by Mr. Mays, seconded by Mr. Province and all council voting aye. Permission was granted for accepting bids on an air purifier for the Court Room.

 

There being no further business, council adjourned.
