PUBLIC HEARING 6:15 P.M. - A public hearing was conducted for the purpose of vacating an unimproved portion of Peabody Drive as requested by Mr. Bob Gibson. No opposition was voiced.
 
CITY COUNCIL MINUTES - September 17, 2001
 
The Jonesboro City Council met Monday, September 17, 2001, at 6:30 p.m. A full quorum was in attendance. Present were: Mayor Hubert Brodell, City Attorney Phillip Crego, City Clerk, Donna K. Jackson, and eleven council members. Those members were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Moore, Perrin and Roddy. Councilman Copeland was unable to attend.
 
Councilman Perrin moved, seconded by Councilman Roddy to approve the minutes of September 4, 2001, as previously delivered. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Moore, Perrin, and Roddy. Councilman Rega moved, seconded by Councilman Moore to approve the minutes of the Special Called meeting of August 24, 2001, as previously delivered. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Moore, Perrin, and Roddy.
 
The following ordinance was on the third and final reading:
 
ORDINANCE TO REZONE PROPERTY FROM RESIDENTIAL (R-1) TO COMMERCIAL (C-3), LOCATED ON THE WEST SIDE OF SOUTHWEST DRIVE, SOUTH OF HARWOOD DRIVE AND WEST OF OAK PARK DRIVE (RUBEN GRIFFIN)
 
Councilman Rega moved, seconded by Councilman Roddy for the adoption of the ordinance. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Moore, Perrin, and Roddy. Councilman Tate moved, seconded by Councilman Roddy for the adoption of the emergency clause. Mayor Brodell called for a roll call vote that resulted in all members voting aye. Those members were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Moore, Perrin, and Roddy. The ordinance was assigned ordinance number 3317.
 
Councilman Moore offered the following ordinance for the first reading:

Councilman Tate moved, seconded by Councilman Crockett to suspend the rules and place on second reading. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Moore, Perrin, and Roddy. Councilman Rega moved, seconded by Councilman Perrin to further suspend the rules and place on third and final reading. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Moore, Perrin, and Roddy. Councilman Perrin moved, seconded by Councilman Roddy for the adoption of the ordinance. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Moore, Perrin, and Roddy. Councilman Rega moved, seconded by Councilman Moore for the adoption of the emergency clause. Mayor Brodell called for a roll call vote resulting in all members voting aye. Those members were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Moore, Perrin, and Roddy. The ordinance was assigned ordinance number 3318.
 
Councilman Young moved, seconded by Councilman Crockett for the adoption of a resolution to set a public hearing for October 1, 2001, at 6:20 p.m. for the purpose of vacating a fifteen foot utility easement along the south side of Lot 2 of Nettleton Baptist Church Replat of Lots 15 through 21 and Lots 30 through 36 of Pardew's Addition. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Moore, Perrin, and Roddy. The resolution was assigned number 2001:51.
 
Councilman Moore moved, seconded by Councilman Perrin for the adoption of a resolution to proceed with condemnation action on two properties. The first located at 711 Amberwood, owned by Mr. Mark Rainwater, and the second located at 2920 South Caraway, owned by Mr. Nick Anagnostopolulos. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Moore, Perrin, and Roddy. The resolution was assigned number 2001:52.
 
Councilman Young moved, seconded by Councilman Crockett for the adoption of a resolution requesting City Water and Light to provide free utilities at 504 CWL Drive, Joe Mac Campbell Park. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Moore, Perrin, and Roddy. The resolution was assigned number 2001:53.
 
Councilman Rega moved, seconded by Councilman Province to appoint the Mayor's recommendation of Attorney Dennis Zolper to the Civil Service Commission with an expiration date of April 2, 2007.
 
Councilman Roddy moved, seconded by Councilman Crockett for the adoption of a resolution authorizing the City of Jonesboro to apply for an extension to continue operating the existing Class IV Landfill at the current permitted location, with an extension to the east. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Moore, Perrin, and Roddy. The resolution was assigned number 2001:54.
 
Under new business by the Mayor, Mr. George Catlett addressed the Jonesboro City Council regarding sewage problems on the Harold Kaffka property located on South Main. Mr. Catlett stated he noticed sewage being discharged into his yard sometime in August, and contacted the Mayor's Office, but only received lip service until Councilman Moore became involved. He stated he was satisfied now that there was no more drainage, but expressed concern that a portion of the sewage line may be broken that runs under his driveway. He questioned how long the City of Jonesboro was going to let this continue. Mayor Brodell recognized his assistant, Mr. Larry Johnson and asked him to address the Council regarding this matter. Mr. Johnson stated he had contacted Roto-Rooter who ran a video scope of the line. Mr. Johnson then provided Adams & Cooper Plumbing, the company who had installed the original sewer line, a copy of the video for them to review. Based on the video, Mr. Cooper of Adams and Cooper Plumbing had reported to Mr. Johnson that the line was clear. He believed the blockage could have been caused by sludge from City Water and Light's main line where it connects to Mr. Catlett's sewer line. Mr. Johnson stated he had contacted City Water and Light and was assured the line would be checked and flushed out if necessary. Mr. Johnson also involved State Plumbing Inspector, Matt Meyers, and Councilman Chris Moore. Mr. Meyers was satisfied with the video findings and requested the situation be monitored to make sure it did not stop up again. If it does, Mr. Catlett was instructed to contact the proper authorities. Mr. Catlett and Mayor Brodell both expressed concern about the line having a break or a crack in it. Alderman Moore explained, as did Mr. Larry Johnson that the line had been damaged when the side walk and retaining wall were being redone, but that was not the cause of the sewage drainage. Mr. Catlett questioned some white markings on the street, fearing it indicated a crack or break in the line. Councilman Moore explained the markings indicated two 45° turns back to back, preventing the scope from making it any further with the camera. Mr. Moore stated he was confident the line was clear and the blockage was not caused by the City of Jonesboro. Alderman Moore stated the line had been clear for two years and recommended any other situations be settled between Mr. Kaffka and Adams/Cooper Plumbing.
 
Councilman Roddy moved, seconded by Councilman Perrin to accept the recommendation of the Sanitation Committee to accept the low bid of Schaeffer Manufacturing Company for the purchase of 720 residential sanitation containers. He stated Schaeffer had exceeded bid specifications. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Moore, Perrin, and Roddy.
 
Councilman Moore recommended that the Harold Kaffka property, located at 103 W. Nettleton (the approved 911 address.), be turned over to the Planning and Inspection Department so they may follow condemnation guidelines established by the Jonesboro City Council. Mayor Brodell recognized Mr. Ron Shipley, C.B.O. of the Planning and Inspection Department. Mr. Shipley stated he did a physical inspection of the property on September 7, 2001, and found numerous code violations. He recommended reviewing the matter with City Attorney, Phillip Crego to determine the City of Jonesboro's legal options. Mayor Brodell requested the Planning and Inspection Committee; City Planner, Glenn Batten and City Attorney Phillip Crego to meet and determine what action should be taken, and to report their findings at the next council meeting.
