AN ORDINANCE TO ABANDON UNUSED ALLEYS IN BLOCK 8 OF THE R.L. HAYS’ ADDITION TO THE CITY OF JONESBORO, ARKANSAS

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS:
That, whereas, a petition was duly filed with City Council of the City of Jonesboro, Arkansas, on the 21st day of November, 1949, asking the City Council to vacate and abandon the following described alleys designated on the plat of the R.L. Hays’ Addition of Jonesboro, Arkansas, now appearing of record in Plat Book Deed Record 48, Page 47, at the office of the Recorder at Jonesboro, Craighead County;
(1) The alley running east and west between Turner Street and Kitchen Street in Block 8 of the R.L. Hays’ Addition to the City of Jonesboro, Arkansas, said alley being bounded on the south by Lots 4, 5, 6, 7, 8 and 9 of said Block 8 and on the north by Lots 10 and 3 of said Block 8 of R.L. Hays’ Addition, now appearing of record in Plat Book Deed Record 48, Page 47, at the office of the Recorder at Jonesboro, Craighead County, Arkansas.
(2) The alley running south from the south line of Steele Avenue in said Block 8 of R.L. Hays’ Addition to the City of Jonesboro, Arkansas, to the north line of the alley first described above, said alley being bounded on the east by Lots 10, 11 and 12 and bounded on the west by Lots 1, 2, 3 of said Block 8 of the said R.L. Hays’ Addition, now appearing of record in Plat Book Deed Record 48, page 47 at the office of the Recorder at Jonesboro, Craighead County, Arkansas.
Whereas, after due notices as required by law, the Council has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the alleys or the portion thereof hereinbefore described has heretobefore been dedicated to the public use as alleys herein described; has not been actually used by the public generally for a period of at least five years subsequent to the filing of the plat; that all the owners of the property abutting upon the portion of the alleys to be vacated have filed with the Council their written consent to such abandonment; and that public interest and welfare will not be adversely affected by the abandonment of such alleys.
Now, therefore, be it ordained by the City Council of the City of Jonesboro, Arkansas:
SECTION 1. The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all its rights, together with the rights of the public generally in and to the alleys designated as follows:
(1) The alley running east and west between Turner Street and Kitchen Street in Block 8 of the R.L. Hays’ Addition to the City of Jonesboro, Arkansas, said alley being bounded on the south by Lots 4, 5, 6, 7, 8 and 9 of said Block 8 and on the north by Lots 10 and 3 of said Block 8 of R.L. Hays’ Addition, now appearing of record in Plat Book Deed Record 48, Page 47, at the office of the Recorder at Jonesboro, Craighead County, Arkansas.
(2) The alley running south from the south line of Steele Avenue in said Block 8 of R.L. Hays’ Addition to the City of Jonesboro, Arkansas, to the north line of the alley first described above, said alley being bounded on the east by Lots 10, 11 and 12 and bounded on the west by Lots 1, 2, 3 of said Block 8 of the said R.L. Hays’ Addition, now appearing of record in Plat Book Deed Record 48, page 47 at the office of the Recorder at Jonesboro, Craighead County, Arkansas.
SECTION 2. A copy of this ordinance duly certified by the City Clerk shall be filed in the office of the Recorder of the County and recorded in the Deed Records of the county.
SECTION 3. This ordinance shall take effect and be in force from and after its passage.
