ORDINANCE TO AMEND THE ZONING ORDINANCE OF THE CITY OF JONESBORO, ARKANSAS

WHEREAS, the following described lands are currently Zoned “R-2" residential use classification:

 

TRACT 1:

Blocks 26 and 27 of Patrick Steet Third Addition to the City of Jonesboro, Arkansas as shown by plat in Deed Record 43, Page 397, at Jonesboro, Arkansas.

 

TRACT 2:

All that part of an unnamed street located between Blocks 26 and 27 of Patrick Street Third Addition to the City of Jonesboro, Arkansas located South of the South Right-of-Way of Logan Avenue and North of the North Right-of-Way of East Matthews Avenue; and

 

WHEREAS, the above described lands are now owned by Jonesboro Real Estate Holdings Company, Inc.; and

 

WHEREAS, the Jonesboro Metropolitan Area Planning Commission has recommended that said lands be rezoned to “C-3 LUO" commercial use classification with an accompanying limited use overlay district; and

 

WHEREAS, it appears to the City Council that all applicable laws of the State of Arkansas and the City of Jonesboro have been complied with in presenting this ordinance to the City Council. 

 

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that:

 

SECTION 1: The Zoning Ordinance of the City of Jonesboro, Arkansas, codified as Title 14 of the Jonesboro Municipal Code should be, and it hereby is, amended so that the lands hereinabove described are zoned “C-3 LUO" commercial use classification as restricted by the limited use overlay district hereinafter set forth.

 

SECTION 2: The limited use overlay district adopted with respect to the above described lands shall accommodate the following uses: 

 

(A)                     Automated teller machines;

(B)                     Bank or financial institutions;

(C)                     Daycare - general;

(D)                     Hospital;

(E)                     Hotel or motel serving medical center and downtown area;

(F)                     Medical service/office;

(G)                     Nursing home;

(H)                     Office - general;

(I)                     Parking lot - commercial;

(J)                     Restaurant - general - medically related;

(K)                     Retail service - medically related products and services;

(L)                     Utility - minor;

(M)                     Vocational school - medically related; and

(N)                     Research services - medically related with a conditional use permit.

 

SECTION 3: All ordinances and parts of ordinances in conflict herewith are hereby repealed.

 

SECTION 4: The City Clerk is hereby directed to amend the official zoning district boundary map of the City of Jonesboro, Arkansas, insofar as it relates to the lands described hereinabove so that the zoning classification of said lands shall be in accordance with the provisions of this Ordinance.
