AN ORDINANCE TO VACATE AND ABANDON A PORTION OF PROSPECT FARM ROAD LYING SOUTH OF AGGIE ROAD AND WEST OF PROSPECT FARM LANE FOR THE PURPOSE OF THE RE-ALIGNMENT OF THE INTERSECTION OF OLD PARAGOULD HWY. AND AGGIE ROAD, AND DECLARING AN EMERGENCY FOR THE PURPOSE OF FINAL SUBDIVISION RECORDING, BUILDING SEASON CONSTRAINTS CAUSED BY A DELAY IN EASEMENT WORK, AND PENDING SUBDIVISION CONSTRUCTION BY THE AFFECTED PROPERTY OWNER.

CRAIGHEAD COUNTY, JONESBORO, ARKANSAS.
BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that:
SECTION ONE: The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all of its rights, together with the rights of the public generally, in and to the part of Prospect Farm Road lying south of Aggie Road and west of Prospect Farm Lane, designated as follows:
DESCRIPTION:
A PORTION OF PROSPECT FARM ROAD LYING SOUTH OF AGGIE ROAD AND WEST OF PROSPECT FARM LANE FOR THE PURPOSE OF RE-ALIGNMENT OF THE INTERSECTION OF OLD PARAGOULD HWY AND AGGIE ROAD. THIS RIGHT-OF-WAY ABANDONMENT IS NECESSARY BECAUSE OF THE NEW ALIGNMENT AND WILL CAUSE THE RELOCATION OF UTILITY AND DRAINAGE EASEMENTS. SEE ATTACHED REPLAT OF LOTS 1, 2, 3 AND 4 OF PROSPECT FARMS SUBDIVISION FOR THE PROPOSED LOCATIONS OF RIGHT-OF-WAY AND EASEMENTS.
SUBJECT TO EASEMENTS, RESTRICTIONS, RESERVATIONS AND RIGHTS-OF-WAY OF RECORD.
SECTION TWO: It is further found that due to the immediate need of the affected property owner to record all new right of ways and easements, and re-platted lots affected by the described public improvements based on the fact that the abandonment was approved by all utility providers and all utilities are accessed from the street side of properties, an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, shall take effect from and after its passage and approval.
SECTION THREE: A copy of the ordinance duly certified by the City Clerk shall be filed in the office of the recorder of Craighead County, Arkansas and shall be filed in the Deed Records of such office.
