IV.                     NEW BUSINESS

Farmer stated that the appointment of Todd Wilcox, representing the Home Builders Association, would need to be retroactive to January 16, 2008.

Farmer stated that he gave short presentation to the Home Builders Association.  He stated that he briefly discussed water quantity and quality.  He also stated that he has not had any feedback regarding the presentation.  Auld stated that Light would need a copy of the meeting agenda for his files.  Farmer did not have a copy available but will provide one.

V.                     PENDING ITEMS

Review of the Stormwater Management Regulations continued.  Light presented two items for discussion:  (1) suggested language for the second paragraph of Section 5 and (2) In-Lieu Contribution Fees clarification.

Light stated that Zolper has rewritten the second paragraph and that he was in agreement with the new version.  Farmer then read the new paragraph.  A motion was made to delete the existing paragraph and replace it with the new one just read.  The motion was made by Street, seconded by Shaw.   The motion was passed unanimously.

Light stated that he and Vance had met to discuss the standard fees for in-lieu contributions.  Light stated that he had purchased the BNI Public Works Cost Book and it was determined that the cost were not reasonable for this area and not the best to use.  Light stated that it was decided to use the most recent Arkansas Highway and Transportation Department (AHTD) weighted average unit price to determine the unit costs for construction estimates.  Cost items should also include a multiplier of 1.15.  Included in this multiplier is 5% for construction engineering and observation and 10% for contingencies.

In-lieu detention was discussed at great length.  It was stressed that in-lieu detention would be the last resort.  If there is a conflict, then the developer could appeal to the Board.  Appeals are made to the Board because all situations can not be planned for.  Farmer stated it is not fair for a developer to be penalized because of something done by a previous developer.  In-lieu is based on the site alone.

Farris stated that there are decision based tools available.  These tools would keep the objectivity and take out the subjectivity that comes from the Board making the decision.  Farmer questioned the cost of the decision based format and stated that he does not think this is available in the short-term.  A motion was later made by Farmer to continue pursuing decision based models and a sub-committee was formed.  This sub-committee consists of Farris (Chair), Young, Light, Wilcox, and Daniels.  Farmer stated that he would come to the some of the meetings but did not want to be a member. Motion was made by Street, seconded by Shaw.   Unanimously approved

After discussion, Zolper stated he has no problem with the language of the “In-Lieu Contributions Fees” section.  Any disgruntled developer will have the option to appeal to the Board.  Farmer requested one change in the wording for clarity purposes.

If was discussed if reference needed to be made to the SWPPP portion in the adoption of the Stormwater Design Manual.  Light stated that the entire manual was adopted under Secction 4.1.  It was suggested getting Phillip Crego’s comments on SWPPP and Design.

Farmer motioned to approve the “In-Lieu Contributions Fees” section with previously mentioned changes.  The language change for this section now reads as follows:

… Cost estimates for construction activities shall include a 5%

multiplier for construction engineering and observation and a 10%

multiplier for contingencies. …

Street moved to adopt, seconded by Shaw.  Pass unanimously.

The next meeting will be held at 8:30 a.m. on Wednesday, March 12, 2008 to discuss the Stormwater Design Manual.  The meeting date was changed due to scheduling conflicts.
