AN ORDINANCE TO AMEND ORDINANCE NO. 954, KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES.

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:    

 

SECTION 1: That Ordinance No. 954 known as the Zoning Ordinance of the City of Jonesboro, Arkansas, be amended as recommended by the Metropolitan Area Planning Commission by the change in zoning district boundaries as follows:

 

From Residential One to Commercial Three (R-1 to C-3) for the property described as follows:

 

LEGAL DESCRIPTION

 

A part of the Southwest Quarter of the Northwest Quarter (SW1/4, NW1/4) of Section 32, Township 14 North, and Range 4 East of the 5th Principal Meridian in Craighead County, Arkansas more particularly described as follows:

 

From the Southwest Corner of the Southeast Quarter of the Northeast Quarter of Section 31, Township 14 North, Range 4 East, thence N89°23'20"E 1,034.80 feet along the South Line of the Southeast Quarter of the Northeast Quarter of said Section 31 to a point, thence N32°08'08"E 518.51 feet to point on the West Line of the Southwest Quarter of the Northwest Quarter of said Section 32, thence N00°16'12"W 108.19 feet along the West Line of the Southwest Quarter of the Northwest Quarter of said Section 32 to the point of beginning;

 

Continue thence N00°16'12"W 351.72 feet along the West Line of the Southwest Quarter of the Northwest Quarter of said Section 32 to a point on the Southerly Right Of Way of Arkansas Highway 1 Business Route, thence S44°03'15"E 145.00 feet along said Right Of Way to the centerline of an existing drainage ditch, thence S26°22'48"W 104.09 feet along said centerline to a point, thence S14°36'35"W 51.98 feet along said centerline to a point, thence S19°29'55"W 131.71 feet along said centerline to a point, thence N47°29'58"W 29.89 feet to the point of beginning, containing some 0.475 acres, more or less, subject to a ten foot (10') utility easement adjacent and parallel to the Southerly Right Of Way of Arkansas Highway 1 Business Route and further subject to a utility easement twenty feet (20') in width along the centerline of an existing sanitary sewer line along the West Side thereof and further subject to a drainage easement fifteen feet (15') in width, the same being seven and one half feet (7.5') each side of an existing storm drain some 77.5 feet South and West of the Southerly Right Of Way of Arkansas Highway 1 Business Route and generally parallel thereto and further subject to a drainage easement fifteen feet (15') in width adjacent and parallel to the East Side thereof.

 

SECTION 2: It is found and declared by the City Council that proper use of the tract of land described in this Ordinance is being delayed because of improper zoning, and that therefore, an emergency exists and this Ordinance, being necessary for the preservation of the public peace, health and safety, shall take effect and be in full force from and after its passage and approval.
