AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS, ASSIGNING SAID ANNEXED TERRITORY TO WARD 3; ZONING SAID ANNEXED TERRITORY RESIDENTIAL (R-2); DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court of Craighead County, Arkansas, for the Western District, on March 22, 1976; and
WHEREAS, said petition for the annexation of said lands was signed by all of the owners of real estate to be annexed to the City of Jonesboro; and
WHEREAS, an Order setting a hearing upon said petition was entered, notice was duly published of said hearing and a hearing upon said petition was duly had and held in the County Court on April 27, 1976, at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands, hereinafter described, should be annexed to the City of Jonesboro; whereupon, an Order of Annexation was made and entered; and
WHEREAS, thirty (30) days have expired since the Order of Annexation dated April 27, 1976, and no proceedings to prevent said annexation have been filed in the Circuit Court for the Western District of Craighead County, Arkansas, said annexation proceedings are in all things confirmed.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territory and lands annexed to the City of Jonesboro, Arkansas, by Order of the County Court of Craighead County, Arkansas, Western District, by its Order of April 27, 1976, be and are hereby, accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereinafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all of the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows, to-wit:
Being a part of the Southeast Quarter of Section Eight (8), Township 14 North, Range Four (4) East, more in particularly described as follows: Begin at the south east corner of said section eight (8); thence two hundred and ten feet (210’) north along east section line said section eight (8); thence four hundred and twenty feet (420’) west to a point; thence two hundred and ten feet (210’) south to a point; thence four hundred and twenty feet (420’) to point of beginning. Said lot containing two (2) acres more or less, less and except forty one feet (41’) measured west from center line, Caraway Road off eth east side for street right-of-way and thirty feet (30’) off the south side measured north from center line (L) of Belt Street for street right-of-way.
Section 3: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward 3 of the City of Jonesboro, Arkansas.
Section 4: The afore-described lands and territory annexed to the City of Jonesboro are hereby zoned Residential (R-2).
Section 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of owners of said territory described herein can be entitled to fire, police, zoning and other protection and benefits and that said benefits and protection are urgently needed now in order to allow orderly growth and development of said lands and territory. Therefore, an emergency is hereby declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety shall take effect and be in full force from and after its passage.
