AN ORDINANCE TO VACATE AND ABANDON AN UNIMPROVED STREET

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that:
SECTION 1: The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all of its rights, together with the rights of the public generally, in and to the streets designated as follows with the exceptions listed in SECTION 2:
Description of a portion of Martinbrook Drive as recorded on the record replat of South Ridge Sub-Division, Phase One, now Windover Heights, Jonesboro, Arkansas to be abandoned by the City Council of Jonesboro, Arkansas and being more particularly described as follows: begin at the Southeast Corner of Lot D of the replat of Lot 11 of Windover Subdivision of Block E of Windover Heights, Jonesboro, Arkansas, said point being the p.c. of a curve Right whose Radius = 646.87'; thence Southeasterly along said curve 248.57' to the P.T. of same; thence S45º40'E 185.52 to the P.C. of a curve Left whose Radius = 82.47'; thence Northeasterly along said curve 134.88' to the P.T. of same; thence N40º37'18"E 278.37'; thence S82º30'23"E 71.65'; thence S40º37'18"W 317.52' to the P.C. of a curve Right whose Radius = 142.47'; thence Southwesterly along said curve 233.02' to the P.T. of same; thence N45º40'W 185.52' to the P.C. of a curve Left whose Radius = 586.87'; thence Northwesterly along said curve 181.73' to a point on a curve Left whose Radius = 37.0'; thence Southwesterly along said curve 52.89' to the P.T. of same; thence S33º19'W 27.82'; thence N22º19'E 118.29' to the point of beginning, containing 1.26 acres, more or less, subject to all Rights Of Way and easements of record.
SECTION 2: A copy of the Ordinance certified by the City Clerk shall be filed in the office of the recorder of Craighead County, Arkansas and shall be filed in the deed records of such office.
SECTION 3: The City Council of the City of Jonesboro, Arkansas finds and declares that the above street or alley and portions of streets or alleys are not necessary for the general benefit and welfare of the public: that the owners of all the property abutting the above streets are in favor of the closure and vacation of the above street and that therefore an emergency is declared to exist and this ordinance shall take effect and be in full force from and after its passage and approval.
