AN ORDINANCE CLOSING A CERTAIN ALLEY LOCATED IN THE CITY OF JONESBORO, ARKANSAS EXTENDING FROM JOHNSON TO WORD

Whereas, a petition was duly filed with the City Council of the City of Jonesboro, Arkansas, on the 4th day of March, 1986, asking the City Council to vacate and abandon all that portion of the alley between Johnson to Word now appearing of record on Plat of said survey filed for record in Deed Record Book 33, Page 309, dated July 14, 1910, and attached hereto and a copy of a Re-plat filed for record in Deed Record Book #46, Page 205, dated January 29, 1917.
Whereas, after due notices as required by law, the Council has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the alley or the portion thereof, hereinbefore described, has heretofore been dedicatee to the public use as an alley herein described; has not been actually used by the public generally for a period of at least five (5) years, subsequent to the filing of plat; that all the owners of the property abutting upon the portion of the alley to be vacated have filed with the Council their written consent to such abandonment; and that public interest and welfare will not be adversely affected by the abandonment of such alley.
Now therefore, be it ordained by the City Council of the City of Jonesboro, Arkansas:
Section 1: The City of Jonesboro, Arkansas, hereby releases, vacates, and abandons all its rights, together with the rights of the public generally, and in and to the alley designed as follows: (Word and Johnson - J.E. Hardin - Warren Dupwe)
The alley located in Lane & Stringer's Addition to the City of Jonesboro, Arkansas, being a part of the Northeast quarter of Section 13, Township 14 North, Range 3 East and part of the Northwest quarter of Section 18, Township 14 North, Range 4 East, commencing at the Northwest corner of Section 18, Township 14 North, Range 4 East, thence West 92.3 feet, thence South 108 rods 12 links, to point of beginning; thence East 444 feet, thence North 443.6 feet; thence West 444 feet; thence south 443.6 feet; to point of beginning. Said alley is bordered on the West by Lots number 1 through 8 and bordered on the East by Lots number 9 through 14 and re-plat of lots 15 and 16 of American Trust Company's sub-division of Lots 15 and 16 of Lane and Stringer's Addition. Said alley being shown on the copy of a Plat of said Survey filed for record in Deed Record Book 33, Page 309, dated July 14, 1910, and attached hereto and a copy of re-plat filed for record on Deed Record Boon #46, Page 205, dated January 29, 1917. Also being the said alley which extends from Johnson to Word, Jonesboro Arkansas.
Section 2: A copy of the ordinance duly certified by the City Clerk shall be filed in the office of the Recorder of the County and recorded in the deed records of the county.
Section 3: This ordinance shall take effects and be in force from and after its passage.
