METROPOLITAN AREA PLANNING COMMISSION

SEPTEMBER 18, 2001 AT 7:00 P.M.

(RESCHEDULED FROM SEPTEMBER 11, 2001)

 

MEMBERS PRESENT: Beadles, Damron, Gott, Street, Krennerich, Johnson, Shaw

 

MEMBERS ABSENT: Phillips, Little

 

The minutes of the August 14, 2001 meeting were approved as prepared.

 

#1 RZ01-34 Tina Coots, Hunt Properties, requested approval of rezoning from Residential R-1 to Commercial C-3 for .50 acre located behind 2113 N. Church Street.  The general location of the property is north of Bettie Street, west of N. Church Street, south of Ginger Street and east of Tina Cove.

 

Properties to the east and north were rezoned earlier in 2001 and at that time it was recommended that the owners petition to rezone this contiguous tract which contains .50 acre.  Glenn Batten stated that the development of the property would have to meet the residential compatibility standards contained in the Zoning Ordinance.

 

No opposition was expressed by any in attendance.

 

Ms. Shaw made a motion to recommend approval of the rezoning to the City Council while advising the petitioner of the residential compatibility standards that would apply to development of this property, particularly buffering between the residential and commercial properties.  The motion was seconded by Mr. Gott.  Voting was 6 in favor, 0 opposed, MOTION CARRIED, REQUEST APPROVED.

 

#2 RZ01-35 Dean Tyrer requested approval of rezoning from Residential R-1 to Residential R-3 for 52.24 acres located on a part of the SE 1/4, NE 1/4 and a part of the NE 1/4 , SE 1/4 of Section 15, T14N, R4E. The property is principally located at 4303 Aggie Road, site of Meadowview Trailer Park on the south side of Aggie Road, east of Cornerstone Drive.

 

George Hamman, Engineer for Dr. Tyrer, stated that the purpose of the rezoning was to allow for expansion of the existing mobile home park.  When questioned about the rezoning signs, it was acknowledged by Mr. Hamman, that the rezoning signs had been placed on the back side of the existing park and not along the street frontage.

 

Several people from the surrounding areas were in attendance that were opposed to this rezoning.  Issues raised by those in opposition were the high density type development allowed in R-3 zoning, large increase in traffic on streets that are not adequate to handle current demand, decrease in property values, the close proximity of University Heights Elementary School, increase in crime associated with potential HUD homes, some of which are already in place.

 

Glenn Batten, City Planner, stated the proposal was consistent with the Future Land Use Plan that proposes medium density residential for this area.  The proposal is consistent with the Zoning Ordinance in that it will aid the implementation of the Comprehensive Plan, promote the general welfare of the citizens of Jonesboro specifically by providing affordable housing opportunities, provide orderly and adequate extension of utilities, and provide for the healthful and convenient distribution of population.  The surrounding land uses and character are compatible with those permitted in the R-3 zoning district.  Glenn further stated that the addition of new residential uses will increase the need for public facilities and public services.

 

Mr. Street made a motion to disapprove the request stating the density associated with R-3 zoning is too high considering the single family homes that comprise the developments in the area.  Mr. Damron made the second.  Voting was 6 in favor, 0 opposed, MOTION CARRIED, REQUEST DISAPPROVED.

 

#3 CU01-4 Dean Tyrer requested approval of a conditional use to expand a manufactured home park in Residential R-3 Zoning.  The current park contains 102 home spaces and the proposed use contains 193 additional spaces for a total of 295 home spaces.  The property is principally located at 4303 Aggie Road, site of Meadowview Trailer Park on the south side of Aggie Road, east of Cornerstone Drive. ITEM NOT CONSIDERED DUE TO BEING INCOMPLETE.

 

#4 RZ01-36 Joe C. Barrett requested approval of rezoning from Residential R-2 to Commercial C-2 for part of Block 4 of Knights First Addition containing 3,279.43 square feet in all.  The address of the property is 311 W. Matthews Avenue, and the general location of the property is on the south side of Matthews Avenue, east of Madison Street.

 

Mr. Barrett stated his intention of moving his law practice to the house currently located on the property.  Commissioners questioned Mr. Barrett about how he planned to meet the parking requirements in the Zoning Ordinance.   Mr. Barrett stated his plans included relocating steps from the front to the side and installing four parking spaces in front of the house and maybe getting the City to take the curb out in front.

 

City Planner, Glenn Batten, stated the proposal was consistent with the Future Land Use Plan as well the purpose of the Zoning Ordinance.  Glenn further stated that the proposal is compatible with the surrounding zoning, uses and character.

 

Commissioner George Krennerich stated there was little doubt that the property should be commercial but its use may be limited due to compliance with ordinance requirements; and therefore, made a motion to recommend approval of the rezoning to the City Council stating that the parking issue and other ordinance requirements would have to be addressed in the site development plan submitted for approval to the City Planner.  The motion was seconded by Mr. Johnson.  Voting was 5 in favor, 2 opposed, MOTION CARRIED, REQUEST APPROVED.

 

#5 RZ01-37 Buddy Bogan requested approval of rezoning from Residential R-1 to Commercial

C-3 for 6.05 acres located on a part of Lot 1 of Buddy Bogan Minor Plat.  The general location of the property is no the north side of Hudson Drive, west of Pleasant Grove Road.

 

Glenn Batten, City Planner, stated that the proposal is consistent with the Future Land Use Plan as well as the purpose of the Zoning Ordinance.  Glenn pointed out that there were two areas of incompatibility those being residences on both the west and south sides of the proposal.  When coupled with other zoning changes in recent months there would be an impact on public facilities and services particularly the intersection of Johnson Avenue, Pleasant Grove Road and Hudson Drive.  Glenn stressed that the all of the C-3 property west of the Pleasant Grove and Johnson Avenue intersection needed to be planned together to promote the best possible internal circulation; to place buildings so that visibility is maintained for all and avoid conflicts; and coordination of ingress-egress points.  Glenn recommended that the Commission consider a C-3 LU-O designation, instead of the general C-3 designation, which would allow a stipulation to be placed on the zoning that would require a coordinated planning effort to address the issues of street and driveway locations and interconnections; compatible land uses; complimentary building locations and appearance; and unified storm water drainage and utility systems. A realignment of Hudson Drive with Johnson Avenue was also discussed.

 

Skip Mooney, Attorney for Mr. Bogan, stated that he understood Mr. Batten’s comments and was in agreement with them.

 

No opposition was expressed by any in attendance; however, it was noted by someone in attendance that the rezoning signs were misplaced on properties not under consideration at this time.

 

Mr. Krennerich made a motion to disapprove the request for the C-3 general zoning district.  The motion was seconded by Mr. Damron.  Voting was 6 in favor, 0 opposed, MOTION CARRIED, REQUEST DISAPPROVED.

 

A second motion was made by Mr. Krennerich to recommend approval of a C-3 LU-O designation to the City Council with the stipulation that prior to specifying the land uses to be permitted in this zone district, a site development plan (meeting the general standards of Chapter 14.36 of the Zoning Ordinance) shall be submitted to the MAPC for review and approval.  This required site development plan shall illustrate the proposed layout for the subject six acre site and its relationship to existing and proposed streets, land uses, buildings, driveway locations, drainage, utilities, and other features on adjoining and nearby properties.  The motion was seconded by Mr. Damron.  Voting was 6 in favor, 0 opposed, MOTION CARRIED, REQUEST APPROVED WITH STIPULATIONS.

 

#6 RZ01-38 David Abernathy requested approval of rezoning from Residential R-1 to Residential R-2 for 1.69 acres located on a part of Tract One of Stonefield Addition and a part of the south ½ of the NW 1/4 of Section 14, T14N, R4E.  The address of the property is 3700 E. Johnson Avenue and the general location of the property is on the south side of Hudson Drive, west of Pleasant Grove Road.

#7 RZ01-39 Bob Mahoney requested approval of rezoning from Residential R-1 to Industrial I-1 for 74.55 acres located on a part of the North ½ of the SE 1/4 of Section 36, T14N, R4E.  The address of the property is 3410 and 3418 Moore Road, and the general location of the property is on the east side of Moore Road, north of Hwy. 63 Bypass.

 

Glenn Batten, City Planner, stated the Future Land Use Plan shows the property to be in the Planned Industrial category and I-1 zoning is recommended.

 

A motion was made by Mr. Gott and seconded by Ms. Shaw to recommend approval of the rezoning to the City Council as submitted.  Voting was 6 in favor, 0 opposed, MOTION CARRIED, REQUEST APPROVED.

 

#8 RZ01-40 George Siebert requested approval of rezoning from Residential R-1 to Commercial C-3 for17.52 acres located on a part of the east ½ of Section 9, T14N, R3E.  The address of the property is 3321 Dan Avenue and the general location of the property is on south and north sides of Dan Avenue, approximately 1,000 feet east of Harry Drive.

 

George Hamman, Engineer for Mr. Siebert, stated that the purpose for rezoning was to bring the existing, nonconforming uses into compliance. 

 

Glenn Batten, City Planner, recommended a C3 LU-0 designation limiting use to a plant nursery, greenhouses, and outdoor growing areas which are the current uses.

 

Skip Mooney, Attorney for Mr. Siebert, stated that Mr. Siebert may have other uses for that property at some future point and needed to be able to utilize his property.

 

No opposition was expressed by any in attendance.

 

A motion to recommend approval of the rezoning to the City Council as submitted was made by Mr. Krennerich and seconded by Mr. Street.  Voting was 6 in favor, 0 opposed, MOTION CARRIED, REQUEST APPROVED.

 

#9 RZ01-41 George DeRoeck requested approval of rezoning from Residential R-1 to Commercial C-3 for .30 acres located on a part of the NW 1/4, NW 1/4 of Section 33, T14N, R4E.  The address of the property is 2308 Sunnymeadow Drive, and the general location of the property is on the north side of Sunnymeadow Drive, east of Caraway Road.

 

Glenn Batten, City Planner, stated that the proposal was consistent with the Comprehensive Plan, and compatible with the uses, zoning and character of the surrounding area.  This is the only tract on the north side of the street that is not currently zoned C-3.

 

No opposition was expressed by any in attendance.

 

A motion to approve the request as submitted was made by Ms. Shaw and seconded by Mr. Street.  Voting was 6 in favor, 0 opposed, MOTION CARRIED, REQUEST APPROVED

 

#10 RZ01-42 Bob Gibson and others requested approval of rezoning from Residential R-3 to Residential R-1 for part of Lots 3, 4, 5, 6, & 7 in Block B, and part of Lots 5, 9, & 10, Block A, all in Griffin Park Addition Phase IV.  The general location of the property is on the west of Flintstone Drive, on the north and south sides of Trailwater Drive.

 

Glenn Batten, City Planner, explained that this was a technical adjustment that would decrease the amount of multi-family land and increase the single family land.  It will also remove mixed zoning from several lots.

 

No opposition was expressed by any in attendance.

 

A motion to approve the request as submitted was made by Ms. Shaw and seconded by Mr. Street.  Voting was 6 in favor, 0 opposed, MOTION CARRIED, REQUEST APPROVED.

 

Other business:

 

SP01-1  Beckwood, Inc. requested approval of site development plans for a commercial development containing 63,000 square foot on 6.16 acres.  The general location of the property is on the south side of Southwest Drive, east of Wimpy Lane.

 

George Hamman, Engineer for Beckwood, presented a revised site plan to the Commission at the meeting.  Mr. Hamman stated that he had received a list of noncompliances from City Planner Glenn Batten and had made several of those changes and had verbal approval from the AHTD on the drainage issues.  When asked if the site plan was in compliance, Mr. Batten stated that he had not seen the revised plans. 

 

Mr. Krennerich made a motion to approve the site plans and deferring final review of the plans to the City Planner.  Mr. Krennerich stipulated that final plans shall include all 31 items on the check list as provided by Glenn Batten a few weeks ago.  If after review the City Staff is not comfortable with the plans they can be referred back to the MAPC.  The motion was seconded by Mr. Street.  Voting was 5 in favor, 1 opposed, MOTION CARRIED, REQUEST APPROVED WITH STIPULATIONS.
