AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT DATED MARCH 30, 1987; ASSIGNING SAID ANNEXED TERRITORY TO WARD 5; DECLARING AN EMERGENCY AND FOR OTHER PURPOSES

WHEREAS, a Petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described was duly filed with the County Court of Craighead County, Arkansas, Western District, on February 15, 1987; and
WHEREAS, said Petition for Annexation of said lands was signed by all the real estate owners owning acreage to be annexed to the City of Jonesboro; and
WHEREAS, an Order setting a hearing on said Petition was entered, notice was duly published on said hearing and hearing was duly had upon said Petition in the County Court on March 30, 1987, at which hearing it was duly found and declared by the Court that said Petition for Annexation was right and proper and that said lands hereinafter described should be annexed to the City of Jonesboro, Arkansas, whereupon an Order of Annexation was made and entered; and
WHEREAS, 30 days have expired since the Order of Annexation dated March 30, 1987, and no proceedings to prevent said annexation have been filed in the Circuit Court of Craighead County, Arkansas, Western District;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
SECTION 1: The territory and lands annexed to the City of Jonesboro, Arkansas, by Order of the County Court of Craighead County, Arkansas, Western District, dated March 30, 1987, be and they are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall hereinafter be deemed and taken to be part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants within the new annexation shall have and enjoy all rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
SECTION 2: The lands and territory annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows: (Ron White, et al, W. of Jonesboro Human Development Center, E. of Craig hills Golf Course and S. of Fox Meadow Lane)
A part of the Northeast Quarter of the Southeast Quarter of Section 5, Township 13 North, Range 4 East, being more particularly described as follows: Beginning at the Northeast Corner of the Northeast Quarter of the Southeast Quarter of Section 5 aforesaid; thence South 1˚52’ West 593.5 feet to the point of beginning proper; thence North 89˚43’ West 1204.2 feet; thence South 1˚52’ West 368.4 feet; thence South 89˚43’ East 1201.2 feet; thence North 1˚52’ East 368.4 feet to the point of beginning proper.
SECTION 3: The lands and territories annexed to the City of Jonesboro, Arkansas, and accepted by the City are hereby assigned and attached to Ward 5.
SECTION 4: The lands and territories herein annexed to the City of Jonesboro, Arkansas, have been zoned R-2.
SECTION 5: Said lands are annexed to the City of Jonesboro subject to the following stipulations: If streets are paved and other utilities and improvements are made, it will be done at the present for future property owner’s expense, and the city will not bear the expense, and this will be recorded and included in the abstract.
SECTION 6: It is hereby found and declared by the City of Jonesboro, Arkansas, that the immediate plans for development of the area hereby annexed to the City of Jonesboro, Arkansas, require the immediate extension of fire, police, zoning, water and other protection and benefits in order to allow the orderly growth and development of said lands and territory and an emergency is hereby declared to exist and this ordinance, being necessary for the preservation of the public peace, health and safety, shall take effect from and after its passage.
