AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS, ASSIGNING SAID ANNEXED TERRITORY TO WARD 6; ZONING SAID ANNEXED TERRITORY RESIDENTIAL (R-2); DECLARING AN EMERGENCY AND FOR OTHER PURPOSES

WHEREAS, a Petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described was duly filed in the County Court of Craighead County, Arkansas on October 25, 1977; and,
WHEREAS, SAID Petition for the annexation of said lands was duly signed by the sole owners of the acreage to be annexed to the City of Jonesboro; and
WHEREAS, an Order setting a hearing upon said Petition was entered, notice was duly published of said hearing and a hearing upon said Petition was duly had and held in the County Court of Craighead County, Arkansas on December 28, 1977, at which hearing it was duly found and declared that said Petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas, whereupon an Order of annexation was made and entered; and,
WHEREAS, thirty (30) days having expired since the Order of annexation dated December 28, 1977, and no proceedings to prevent said annexation having been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas,
NOW, THEREFORE, be it ordained and enacted by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territory in said lands annexed to the City of Jonesboro by Order of December 28, 1977, be and are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing herein shall have and enjoy all of the rights and privileges of the inhabitants within the original City Limits of Jonesboro, Arkansas.
Section 2: The lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas are more particularly described as follows, to-wit:
Lots 6 and 7 of Block “C” and Lots 4, 5, 6, 7 and 8 of Block “D” of Curtview Acres Sub-Division of a part of the NW1/4 SW1/4 Section 27, Township 14 North, Range 4 East and Sub-Division of a part of the NW1/4 SW1/4 of Section 27, Township 14 North, Range 4 East, Craighead County, Arkansas, being more particularly described as follows:
Begin Survey at the NW corner of the NW1/4 SW1/4 of Section 27, Township 14 North, Range 4 East; thence South 1 degrees 05 minutes West 641.0 feet to a point; thence South 89 degrees 46’ East 252.7 feet to the point of beginning proper; thence continue South 89 degrees 46’ East 224.0 feet to a point; thence South 1 degrees 05’ West 285.0 feet to point; thence South 89 degrees 46’ East 262.0 feet to appoint; thence South 1 degrees 05’ West 192.6 feet to a point; thence South 89 degrees 46’ East 185.0 feet to a point; thence South 1 degrees 05’ West 200.9 feet to a point; thence North 89 degree 46’ West 671.0 feet to a point; thence North 1 degrees 05, East 679.0 feet to the point of beginning proper. Containing 6.712 acres, more or less, and being subject to easements and right-of-ways as shown on plat.
Begin survey at the NW Corner of NW1/4 SW1/4 of Section 27, Township 14 North, Range 4, East; thence East 273.0 feet to the point of beginning proper; thence South 330.0 feet to a point; thence East 109.0 feet to a point; thence North 330.0 feet to a point; thence West 109.0 feet to the point of beginning, being subject to a dedicated street right-of-way along the North and West sides thereof, containing 0.825 acres, more or less.
Begin survey at the NW Corner of NW1/4 SW1/4 of Section 27, Township 14 North, Range 4 East, thence east 273.0 feet to a point; thence South 330.0 feet to the point of beginning proper; thence continue South 311.0 feet to appoint; thence East 189.0 feet to a point; thence North 241.0 feet to appoint; thence West 80.0 feet to a point; thence North 70.0 feet to appoint; thence West 109.0 feet to the point of beginning proper, being subject to a dedicated street right-of-way as shown on the plat containing 1.349 acres, more or less.
Begin survey at the NW Corner NW1/4 SW1/4 Section 27, Township 14 North, Range 4 East 109.0 feet to the point of beginning proper; thence continue East 80.0 feet to a point; thence South 70.0 feet to a point; thence West 80.0 feet to a point; thence North 70.0 feet to the point of beginning proper containing 0.128 acres, more or less.
Section 3: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward 6 of the City of Jonesboro.
Section 4: The said lands and territory annexed to the City of Jonesboro are hereby zoned residential R2.
Section 5: It is further found and declared by the City Council of the City of Jonesboro, Arkansas, that the property known as Crawford Drive extending from Race Street southwardly approximately 671 feet and being a drive 40 feet in width has not met the standards and does not qualify to be included in the City of Jonesboro Street Maintenance Program and this street an drive is specifically excepted from any maintenance or upkeep by the City of Jonesboro, Arkansas.
Section 6: It is hereby further found and declared by the City Council of the City of Jonesboro, Arkansas, that a 30 foot strip of property on the south side of the above described annexed lands, with a proposed name of Allison Drive be dedicated to the City, Arkansas, and the further stipulation and requirement that said strip of lands be improved to meet City Street requirements if and when the property immediately adjacent thereto on the south side is ever brought into the City limits of Jonesboro, Arkansas.
Section 7: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas so that said property and the citizens and property owners of said territory described herein can be entitled to fire, police, zoning and other protection benefits and that said benefits and protection are urgently needed in orderly growth and development of said lands and territory, therefore, an emergency is hereby declared to exist and this Ordinance being necessary for the preservation of the public peace, health and safety, shall take effect and be in full force from and after its passage.
