AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORY TO WARD 3; ZONING SAID ANNEXED TERRITORY RESIDENTIAL (R-3) AND COMMERCIAL (C-3); DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES. WHEREAS, a petition for annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court of Craighead County, Arkansas, on August 6, 1996; and
WHEREAS, said petition for the annexation of said lands was duly signed by the sole owners of all of the acreage to be annexed to the City of Jonesboro, Arkansas; and
WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published of said hearing and a hearing upon said petition was duly had and held in the County Court of Craighead County, Arkansas, on September 10, 1996, at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas; whereupon an order of annexation was made and entered; and
WHEREAS, thirty days having expired since the order of annexation dated September 10, 1996, and no proceedings to prevent said annexation having been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas said annexation proceedings were in all things confirmed by the County Court by its order of October 14, 1996.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas:
SECTION 1: The territory and lands annexed to the City of Jonesboro by order of the County Court of Craighead County, Arkansas, by its order of September 10, 1996, be and are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all of the privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas, are more particularly described as follows:
A parcel of land lying in a portion of Sections 34 and 35, Township 15 North, Range 4 East, Craighead County, Arkansas, being more particularly described as follows: That portion of the North Half of Section 34 aforesaid, lying East of the centerline of State Road No. 351 80 right of way; together with the Northeast Quarter of the Southeast Quarter of Section 34 aforesaid, together with the North Half of the Southwest Quarter of Section 35 aforesaid, together with the South Half of the Northwest Quarter of Section 35 aforesaid, being more particularly described as follows: Beginning at the Southeast corner of the Northeast Quarter of the Northwest Quarter of Section 35 aforesaid; thence North 00°44'31' East along the East line of said Northeast Quarter of Section 35, a distance of 268.3 feet to a point; thence North 89°07'14' West a distance of 243.65 feet to a point; thence North 01°20'51" West a distance of 110 feet to a point; thence North 53°48'51" West a distance of 777.5 feet to a point; thence North 03°37'09" East a distance of 391.3 feet to the centerline of the County Road; thence North 74°29'51" West, along the centerline of said County Road, a distance of 219 feet to a point; thence North 88°21'51" West, continuing along the centerline of said County Road, a distance of 239.56 feet to the West line of the Northeast Quarter of the Northwest Quarter of Section 35 aforesaid; thence South 00°30'10" West, along said West line, a distance of 1287.80 feet to the Southwest Corner of the Northeast Quarter of the Northwest Quarter of Section 35 aforesaid; thence South 89°35'53" East, along the South line of the Northeast Quarter of the Northwest Quarter of said Section 35, a distance of 1307.38 feet to the point of beginning, containing in all 19,362.569 square feet or 440.50 acres, more or less, subject to easements, restrictions, reservations and rights of way of record.
SECTION 2: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward 3 of the City of Jonesboro, Arkansas.
SECTION 3: Said lands and territory annexed to the City of Jonesboro are hereby zoned Residential (R-3) and Commercial (C-3) as shown on the attached Exhibit "A".
SECTION 4: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas so that said property and the citizens and property owners of said territory described herein can be entitled to fire, police, zoning and other protection and benefits and that said benefits and protection are urgently needed now in order to allow orderly growth and development of said lands and territory. Therefore, an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health, and safety, it shall take effect and be in full force from and after its passage.
