AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORY TO WARD 2 ; ZONING SAID ANNEXED TERRITORY RESIDENTIAL (R-1); DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES.

WHEREAS, petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court of Craighead County, Arkansas, on December 10, 1990. And 

 

WHEREAS, said Petition for the annexation for said lands was duly signed by the sole owners of all of the acreage to be annexed to the City of Jonesboro; and

 

WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published of said hearing and the hearing upon said petition was duly had and held in the County Court of Craighead County, Arkansas, on January 11, 1991, at which hereinafter described shall be annexed to the City of Jonesboro, Arkansas, whereupon an order of annexation was made and entered; and

 

WHEREAS, thirty (30) days have expired since the order of annexation dated January 11, 1991, and no proceedings to prevent said annexation have been filed in the Circuit Court for the Western District of Craighead County, Arkansas, said annexation proceedings were in all things confirmed by the County Court of Craighead County, Arkansas by its order of February 11, 1991.

 

NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council for the City of Jonesboro, Arkansas:

 

SECTION 1: The territories and lands annexed to the City of Jonesboro by order of the County Court of Craighead County, Arkansas, by its order of January 11, 1991, be and are hereby accepted by the City of Jonesboro, Arkansas said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all of the rights and privileges of the inhabitants within the original limits of the City  of Jonesboro,  Arkansas.

 

SECTION 2: The lands and territories are hereby annexed to an accepted by the City of Jonesboro, Arkansas and more particularly described as follows:

 

Beginning at the Southeast corner of the Southeast Quarter of the Northeast Quarter of   Section Eight (8), Township Fourteen (14) North, Range Three (3) East, running West 2 rods for a point of beginning, thence North 260 feet, thence West 160 feet, thence South 260 feet, thence East 160 feet to the point of beginning.

 

SECTION 3: The lands and territories annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward 2 of the City of Jonesboro, Arkansas.

 

SECTION 4: Said lands and territories annexed to the City of Jonesboro are hereby zoned Residential (R-1.).

 

SECTION 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein be immediately annexed to the accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of said territory described   herein can be entitled   to fire, police, zoning, water and sewage and other protection and benefit; that said benefits and protections are urgently needed now in order to allow orderly growth and development of said lands and territory. Therefore, and emergency in hereby declared to exist; this ordinance being necessary for the preservation of public peace, health and safety, shall take effect and be in full force from and after its passage and approval.

 

PASSED AND ADOPTED this 4th day of March, 1991.
