AN ORDINANCE PRESCRIBING THE LOCATION OF BUILDINGS HEREAFTER ERECTED, CONSTRUCTED, RE-CONSTRUCTED OR ALTERED ALONG THE STREETS OF THE CITY OF JONESBORO, ARKANSAS (NOTE: THIS ORDINANCE WAS AMENDED BY ORD-62:2766 ON APRIL 2, 1962)

BE IT ORDAINED by the City council of Jonesboro, Arkansas:
 
(1)   The master street plan for the City of Jonesboro, as prepared and presented in strict compliance with the provisions of the laws of Arkansas, and consisting of Map No. 1 showing community facilities, May No. 2 showing major street system, together with types and sizes of streets and right-of-way, and May No. 3 showing openings and extensions of streets, together with supporting documents, as certified by the City Planning Commission and filed with the City Clerk on June 2, 1955, be, and it is in all parts, adopted and approved.
 
(2)   Hereafter no building permit shall be issued and it shall be unlawful for any person, persons or corporation or other owner of land bordering on any street in the City of Jonesboro, to construct, erect, re-construct, or alter any building nearer or closer to the center line of the surfaced or traveled portion of any such street than:             
 
State and Federal Highways in un-platted areas      60 feet
State and Federal Highways in platted areas            50 feet
Major internal streets                              40 feet
Collector streets                              40 feet
Service streets                                    40 feet
Residential streets                              30 feet
 
The designation of type of street being fixed by the master street plan and its accompanying maps, together with any amendments or additions thereto, when the same shall have been adopted by the City Council.
 
(3)   The City Planning Commission or the City Council may waive the provisions of this Ordinance only within the part of the business district of Jonesboro consisting of Church Street, Main Street and Union Street from the tracks of the St. Louis Southwestern Railroad South to Matthews Avenue and on Burke Avenue, Huntington Avenue, Monroe Avenue, Washington Avenue, Jackson Avenue, Jefferson Avenue and Matthews Avenue between Madison Street and Church Street.
 
(4)   This Ordinance shall not repeal any other ordinance of the City of Jonesboro, but the provisions hereof shall be cumulative with and to such other laws and ordinances.
 
(5)   Any person, persons, corporations or owner or owners of land or persons constructing, erecting, re-constructing or altering any building or maintaining any such structure that has been constructed, erected, re-constructed, or altered since the passage of this Ordinance, closer or nearer to the center line of the streets than is permitted by this ordinance, shall be guilty of a misdemeanor, and on conviction thereof shall be fined not less than $25.00 or more than $100.00, and each and every day's violation shall constitute a separate misdemeanor and be subject to the same fine and punishment.
 
(6)   Whereas it being necessary in order to lessen congestion in the streets; to preserve and protect sufficient street and highway right-of-ways; to secure safety from fires, panic and other danger; and to provide adequate light and air; and to prevent the overcrowded of land; and to conserve the value of building and land; and this ordinance being necessary for the preservation of the public health, safety and welfare, an emergencies is hereby declared to exist, in this ordinance shall take affect and be in full force from and after its passage and approval.
