APPEAL HEARING

6:50 - An Appeal Hearing was conducted regarding the MAPC decision to allow placement of a mobile home on 5002 Richardson Road for Mr. and Mrs. Claude Daley. The Daleys were represented by Attorney Don Mixon, while Attorney Arlon Woodruff represented the opposition to the MAPC decision.

 

PUBLIC HEARING

 

7:15 p.m. - A public hearing was conducted regarding the vacating and abandonment of a portion Marshall Street. The petition was submitted by Max Dacus Jr.

 

City Council Minutes - July 6, 1992

 

The Jonesboro City Council met in regular session at 7:30 p.m. Present were the Mayor, City Clerk, City Attorney, and all the Aldermen with the exception of Mr. Evans who was unable to attend.

 

The minutes of the June 15, 1992, were approved as mailed by motion of Mr. Shelton, seconded by Mr. Nix. All voted aye.

 

The following ordinance was on the third reading:

 

AN ORDINANCE TO AMEND SECTION 11.20.07, REINSPECTIONS; NOTICE TO PUT IN SAFE CONDITION; EXISTING BUILDINGS, SUBSECTION ( b ) OF THE CODE OF ORDINANCES OF THE CITY OF JONESBORO, ARKANSAS TO SPECIFY A TIME LIMIT FOR REQUIRING AN ELECTRICAL REINSPECTION OF A COMMERCIAL OR

INDUSTRIAL BUILDING; OTHER PURPOSES.

 

Fire Captain Clark recommended not to change the existing re-inspection law for safety reasons. Mr. Bridger moved, seconded by Mr. Shelton to amend the ordinance to exclude a “industrial buildings”. A roll call vote was taken with all Aldermen voting nay with the exception of Mr. Bridger who voted aye. Mr. Bridger moved seconded by Mr. Shelton for the adoption of the ordinance. A roll call vote was taken, resulting in an eleven (11) to one (1) vote against the motion. All Aldermen voted nay with the exception of Mr. Bridger.

 

The following ordinance was on the second reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 2173 JONESBORO MUNICIPAL CODE SECTION 5.16.16 ENTITLED WEEDS TO BE CUT, REMOVAL OF TRASH, TO MAKE IT ILLEGAL FOR PROPERTY OWNERS TO ALLOW DEAD OR ROTTING TREES ON PROPERTY,AND PROVIDING FOR THEIR REMOVAL.

 

Discussion followed regarding the wording of the ordinance. Mr. Nix moved, seconded by Mr. Bridger to amend the ordinance by adding “within 150 feet of a dwelling or structure”. All voted aye. Mr. Strauser moved, seconded by Mr. Nix to further suspend the rules and place on the third and final reading. All voted aye. Mr. Nix moved seconded by Mr. Shelton to adopt the ordinance as amended with the emergency clause. All voted aye. The ordinance was given number 2407.

 

The following ordinance was on the second reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 2173 PROVIDING FOR NOTICE TO REMOVE AND REMOVAL BY THE CITY OF ROTTING OR DEAD TREES.

 

Mr. Nix moved, seconded by Mr. Shelton to amend the ordinance to read “within 150 feet of a dwelling or structure”. All voted aye. Mr. Nix moved, seconded by Mr. Shelton to further suspend the rules and place on the third and final reading. All voted aye. Mr. Nix moved, seconded by Mr. Hinson for the adoption of the ordinance as amended, with the emergency clause. All voted aye. The ordinance was given number 2408.

 

Mr. Strauser offered the following ordinance for the first reading:

 

AN ORDINANCE TO VACATE AND ABANDON AN UNIMPROVED PORTION OF MARSHALL STREET.

 

Mr. Hannah moved, seconded by Mr. Hinson to suspend the rules and place on second reading. All voted aye. Mr. Sanderson moved, seconded by Mr. Bridger to further suspend the rules and place on the third and final reading. However, Mr. Sanderson requested to hold the third reading and give everyone a chance to go look at the area, then vote on the matter at the next Council meeting.

 

Mr. Mays offered a resolution to certify Best Diversified Products, Inc. to participate in the Arkansas Enterprise Program. Mr. Shelton moved, seconded by Mr. Province for the adoption of the resolution. All voted aye. The resolution was given the number 1992:26.

 

The following bids were up for review:

 

92:27 - Recaps - Street & Sanitation

Mr. Hannah moved, seconded by Mr. Shelton to accept the low bid which met specifications. All voted aye.

 

92:28 - Sand & Gravel - Street Department

Mr. Shelton moved, seconded by Mr. Nix to accept the low bid which met the specifications. All voted aye.

 

92:29 - Labor for Sidewalk, Curb and Gutter - Street Department

Mr. Mays moved, seconded by Mr. Hinson to split the bid and accept the bids which met the specifications. All voted aye.

 

92:30 - Pagers - Fire Department

Mr. Shelton moved, seconded by Mr. Strauser to accept the low bid which met the specifications. All voted aye.

 

92:31 - Personal Alert System - Fire Department

Mr. Shelton moved, seconded by Mr. Bridger to accept the low bid which met the specifications. All voted aye.

 

Mr. Stricklin moved, seconded by Mr. Shelton to reappoint to Adjustments & Appeals:

- Mr. Larry Duke, exp. 5/96

- Mr. Albert Frankenburger, exp.5/96

- Mr. Robert Scott, exp.5/96

- Mr. Jim Farmer, exp. 5/96

- Mr. Bill Waldrip, exp. 5/96

All voted aye.

 

Mr. Hinson moved, seconded by Mr. Shelton to reappoint to Jonesboro Handicap Advisory Commission:

- Mr. Bob Rubenstein, exp. 6/96

- Ms. Frances Puryear, exp. 6/96

 

Under new business Mr. Shelton moved, seconded by Mr. Province to uphold the MAPC decision to allow a mobile home at 5002 Richardson Road owned by Mr. and Mrs. Claude Daley. A roll call vote was taken, resulting in all the Aldermen voting aye.

 

Mr. Province moved, seconded by Mr. Hannah to continue with Blue Cross/ Blue Shield Insurance and not rebuild as recommended by the Insurance Committee. All voted aye.

 

Mr. Strauser asked about pick up from tree limbs which had been blown down by the recent storm. Mr. Strauser was informed that Sanitation would be picking up through Friday and if anyone needed assistance they could call the Sanitation Department at 932-2438.

 

Mr. Stotts, after being recognized by the Mayor, asked about a house at 700 East Washington, stating he was afraid it was a fire hazard. Mr. Stotts was informed the matter was being taken care of, and should be cleaned up within thirty days. July 20, 1992 was Mr. Stotts’ birthday, he stated he would not tell his age, just that he was 14 years on July 20, 1936.

 

With no further business the meeting was adjourned.
