AN ORDINANCE TO CREATE A ZONE TO BE DENOMINATED AS C-1 J.I.D.; TO DEFINE THIS AREA AND TO PROVIDE FOR REGULATIONS OF THIS DISTRICT

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

 

Section 1:  It is hereby creating, a new zoning district to be denominated as C-1 J.I.D., which shall be a commercial district encompassing the Jonesboro Improvement District No. 1, which provides retailing, personal services and office space, for local and regional commercial activities. The regulations are designed to promote a concentrated development of permitted facilities.

 

Section 2: Permitted uses shall include the following; All or any lawful commercial, retain or wholesale, professional or personal services, except as prohibited below.

 

Section 3: Prohibited uses are as follows:

 

(a)                     Any new residence

(b)                     Any industrial or manufacturing plants

 

Section 4: The following uses shall be permitted according to the limitations imposed as variance by the Board of Zoning Adjustment and said permitted exceptions are as follows:

 

(a)                     Any small fabricating or processing establishment, provided that such use is not obnoxious or offensive by reason of the emission of odor, dust, smoke or gas, noise or vibration.

(b)                     Apartments, hotels, and motels

 

Section 5: All new construction, renovation, remodeling or restoration of any kind or nature, must be approved by the Jonesboro Improvement District Board of Commissioners, hereinafter referred to as Commissioners, or said Commissioners servants, agents or employees. All persons, partnerships, organizations, associations or corporations desiring to build, remodel, renovate or restore any building or buildings within this district shall submit plans which shall conform to the Master Plan for the Jonesboro Improvement District and shall meet all rules and regulations of said district properly adopted by said Commission. All persons, partnerships, organizations and/or corporations shall submit said plans to the Commissioners or their duly delegated agent or employee prior to a building permit being issued by the City of Jonesboro’s building official.

 

Section 6: Any persons, firm, association, organization or corporation dissatisfied with a decision of the Commission or of the Commissions employee or agent shall have the right to appeal that decision to the City Council as provided for in Section 2-3.2 of the Code of Ordinances for the City of Jonesboro, Arkansas.

 

Section 7: It is hereby found and declared by the City Council of the City of Jonesboro. Arkansas, that there is need for a new zoning district to be created to encompass the Jonesboro Improvement District and to permit said Improvement District to regulate activity within that district so that said construction within this district will conform with the Master Plan established y the Jonesboro Improvement District No. 1. Therefore, an emergency is hereby declared to exist and this Ordinance being necessary for the preservation of the public peace, health and safety, it shall take effect and be in full force from and after its passage and approval.
