AN ORDINANCE TO VACATE AND ABANDON A PART OF PETE LANE, ALSO KNOWN AS MEAD DRIVE

WHEREAS, a petition has been filed with the City Council of the City of Jonesboro, Arkansas, asking that the City Council vacate and abandon that part of Pete Lane, also known as Mead Drive, lying between Lots 5 and 10 of Rolling Hills Subdivision, in Jonesboro, Craighead County, Arkansas, which appears of record in plat deed record book 158 at page 16 in the office of the clerk and ex-officio recorder of Craighead County, Arkansas; and
 
WHEREAS, after due notice, the City Council has heard all persons desiring to be heard on the issue and has ascertained that the vacation and abandonment of the street herein described will not adversely affect the public interest and welfare.
 
NOW, THEREFORE,      BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that:      
 
SECTION 1: The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all of its rights, together with the rights of the public generally, in and to that part of Pete Lane, also known as Mead Drive, lying between Lots 5 and 10 of Rolling Hills Subdivision, in Jonesboro, Craighead County, Arkansas, as shown on the plat attached hereto and which is incorporated herein.
 
SECTION 2: A copy of the Ordinance duly certified by the City Clerk shall be filed in the office of the clerk and ex-officio recorder of Craighead County, Arkansas and shall be filed in the deed records of such office.
 
SECTION 3: The City Council of the City of Jonesboro, Arkansas finds and declares that the above street is not necessary for the general benefit and welfare of the public; that the owners of all the property abutting the above street are in favor of the closure and vacation of the above street.
 
SECTION 4: The City Council further finds and declares that an emergency exists and that this ordinance is necessary for the preservation of the public peace, health, safety and welfare and shall take effect and be in full force and effect from and after its passage and approval.
