AN ORDINANCE TO AMEND ORDINANCE NO. 954, KNOWN AS THE ZONING ORDINANCE, PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES.

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

 

SECTION 1:  That Ordinance No 954, know as the zoning ordinance of the City of Jonesboro, Arkansas, be amended as recommended by the Metropolitan Area Planning Commission by the changes in zoning classifications as follows:

 

From Residential (R-2) to Commercial (C- 2) the following described property: (Pat Hamlin, R-2   to C-2 corner of Huntington and Flint & Stephen Byard, R-2 to C-2, NW corner of Huntington) - Skip Smith.

 

HAMLIN PROPERTY

The East Half of Lot 3 and all of Lot 4  in Block 1 of Cole’s Subdivision of Lot 7 in Block 1 of  Cole’s Subdivision of Lots 1 and 2 in Block 4 of  Flint’s Addition to the City of Jonesboro,  Arkansas being 60 by 140 feet.

 

BYARD PROPERTY

The West Half of Lot Three (3) and the East Half of Lot Two (2) of Cole’s Subdivision of Lot  Seven (7) of Block One (1) of  Cole’s Subdivision of Lot One (1) of  Block Four (4) of  Flint’s Addition to the City of Jonesboro, Arkansas, being 40 by 140 feet.

 

SECTION 2:   The City of Jonesboro, Arkansas, hereby rezones the above described property from R-2 to C-2, with the following restrictions:

 

(A)   The use of these tracts shall be restricted to warehousing and distribution, and light manufacturing and wholesaling operations shall be prohibited.

 

(B)   Building  setback  requirements  shall  be  seven  and  one-half  (7 ½ )  feet on all sides,  including  rear  lot  line,  and  twenty-five  (25)  feet  on  all  sides  abutting  a dedicated  public  street.

 

(C)   If the use of this property for warehousing or distribution is discontinued for a period of  not  less than one (1) year, then the zoning of  C-2  shall terminate and the property shall  automatically revert to R-2 zoning, provided such change of zoning shall be confirmed by  action  of the City Council of the City of Jonesboro, Arkansas.

 

Said rezoning is further subject to the setbacks meeting the requirements of the R-2 zoning to the west and construction of a privacy fence on the west property line.

 

SECTION 3:   It is found and declared by the City Council that the proper use of the tracts of land described above in this ordinance is being delayed because of improper zoning, and that, therefore, an emergency is hereby declared to exist and this ordinance, being necessary for the preservation of the public peace, health and safety, shall take effect and be in full force from and after its passage and approval.
