AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORY TO WARD 1; ZONING SAID ANNEXED TERRITORY; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court of Craighead, County Arkansas, on February 28, 1986; and
WHEREAS, said petition for the annexation of said lands was duly signed by the sole owners of all of the acreage to be annexed to the City of Jonesboro, Arkansas; and
WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published of said hearing and a hearing upon said petition was duly had and held in the County Court of Craighead County, Arkansas, on April 2, 1986, at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas; whereupon an order of annexation was made and entered; and
WHEREAS, thirty days having expired since the order of annexation dated April 2, 1986 and no proceedings to prevent said annexation having been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas, said annexation proceedings were in all things confirmed by the County Court of Craighead County, Arkansas, by its order of May 5, 1986.
NOW, THEREFORE, be it ordained and enacted by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territory and lands annexed to the City of Jonesboro by order of the County Court of Craighead, County, Arkansas, by its order of April 2, 1986, be and are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all of the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows: (Walden, Timms - W. Washington - Skip Mooney)
TRACT 1: A part of the Southeast Quarter of Section 14, Township 14 North, Range 3 East, being more particularly described as follows: Begin at the Southeast Corner of Section 14, Township 14 North, Range, 3 East thence North on the Section line 962.5 feet to the North right-of-way line of Washington Avenue, thence with the meanderings with said North right-of-way line as follows: North 87°05’43” West 149.78 feet; South 89°04’30” West 100.0 feet; North 85°12’52” West 50.40 feet to the point of beginning proper; thence with the meanderings with said North right-of-way line as follows: North 85°12’52” West 50.10 feet; South 89°04’30” West 550.07 feet; thence North 175.00 feet; thence East 599.92 feet; thence South 170.00 feet to the point of beginning proper, containing 2.35 acres, more or less.
TRACT 2: A part of the Southeast Quarter of Section 14, Township 14 North, Range 3 East, being more particularly described as follows: Begin at the Southeast Corner of Section 14, Township 14 North, Range 3 East; thence North on the Section line 962.5 feet to the North right-of-way line of Washington Avenue; thence with the meanderings with said North right-of-way line as follows: North 87°05’43” West 149.78 feet; South 89°04’30” Wet 100.0 feet; North 85°12’52” West 50.40 feet to the point of beginning proper; thence West 599.92 feet; thence North 934.61 feet to a point 250.00 feet from and perpendicular to the main line of St. Louis and Southwestern Railway Co; thence North 83°37’18” East parallel with said main line 603.66 feet; thence South 801.67 feet to the point of beginning proper, containing 10.58 acres, more or less.
Section 3: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward 1 of the City of Jonesboro, Arkansas.
Section 4: Said lands and territory annexed to the City of Jonesboro are hereby zoned Commercial (C-3) for Tract 1 and Residential (R-3) for Tract 2.
Section 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of said territory described herein can be entitled to fire, police, zoning and other protection and benefits and that said benefits and protection are urgently needed now in order to allow orderly growth and development of said lands and territory. Therefore, an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, it shall take effect and be in full force from and after its passage.
